Following a decade-long impasse, the Southeast Asia Nuclear-Weapon-Free Zone (SEANWFZ) is finally on a path to being endorsed by the world's five recognized nuclear-weapon states—China, France, Russia, the United Kingdom, and the United States. Agreement by these nuclear powers to respect the prohibition of nuclear weapons in Southeast Asia and to provide legal assurances that they will not use such weapons against zone members helps to strengthen the commitment by regional states not to pursue nuclear weapons, and contributes more broadly to global nonproliferation and disarmament efforts,

Abstract:
The Copenhagen Climate Summit in 2009 was aimed at building on an international agreement through a new environmental accord for the post-Kyoto period (2008-2012), including new targets for greenhouse gas emissions. Although various options have been suggested since then, no definite agreement has yet been achieved. The recent United Nations Climate Change Conference in Durban, South Africa further negotiated the implementation of the Convention visa- vis the Kyoto Protocol, the Bali Action Plan, and the Cancun Agreements. The main outcome included the decision to adopt a universal legal agreement on climate change as soon as possible and no later than 2015. This commentary looks at the strengths and problems faced with the Protocol and what will constitute a fair differentiation of commitments among countries to address the issue more effectively post-Kyoto.

Abstract:
The initial Safety of Life At Sea (SOLAS) Convention which dates back to 1914 was a direct consequence of the sinking of the Titanic two years earlier a century ago. The 100-year anniversary of the tragedy of the Titanic is the theme for the World Maritime Day 2012 proposed by the International Maritime Organization (IMO). According to the former Secretary General of the IMO, Mr. Mitropoulos, this theme would provide an opportunity to take stock of improvements in maritime safety over the 100 years since the sinking of the liner, and examine whether the lessons drawn from one of the most costly (in terms of human lives lost) accidents have been applied.

The nuclear negotiations between Iran and the West have had their share of dashed expectations, but even by this peculiar standard, the recent diplomatic roller coaster stands out. Brimming with hope in Istanbul, negotiators crashed to earth in Baghdad, a few weeks later. That was not unexpected, given inflated hopes, mismatched expectations and – most hurtful – conviction on both sides that they had the upper hand. But if negotiations collapse now, it is hard to know what comes next. Washington and Brussels seem to count on sanctions taking their toll and forcing Iran to compromise. Tehran appears to bank on a re-elected President Obama displaying more flexibility and an economically incapacitated Europe balking at sanctions that could boomerang. Neither is likely; instead, with prospects for a deal fading, Israeli pressure for a military option may intensify. Rather than more brinkmanship, Iran and the P5+1 (UN Security Council permanent members and Germany) should agree on intensive, continuous, technicallevel negotiations to achieve a limited agreement on Iran's 20 per cent enrichment.

Less than a year after the old “greater” Sudan split into the northern Republic of Sudan and the new Republic of South Sudan—or North and South Sudan, for clarity—the two countries were again in a state of war. Years of international efforts to bring an end to decades of conflict by helping to negotiate the Comprehensive Peace Agreement of 2005 and later efforts to ensure a smooth separation of North and South appear to have come to naught.

Every year, the UN climate negotiations seem to fail the test of saving the global climate in the public eye. The expectations placed on the UN climate regime are simply too high. The great expectations of the UN climate regime—and the subsequent inability to meet them–are damaging, as they resonate with sceptics of international climate policy and UN multilateralism in general. The world has changed since the early 1990s, when post-Cold War optimism provided fertile ground for establishing several environmental regimes. The new geopolitical and domestic realities provide the backdrop for the progress that can be achieved through multilateral climate negotiations. However, the UN climate regime plays a crucial role by catalysing climate action, building a common vision between different states, enhancing transparency, and promoting the diffusion of novel policy ideas and instruments. The role of the UNFCCC could be further strengthened by allowing it to act as an orchestrator which coordinates the array of initiatives.

408. Israel and the Palestinians After the Arab Spring: No Time for Peace

Abstract:
While spared from internal turmoil, Israel and the Palestinian Territories have nonetheless been affected by the region's political transformation brought about by the Arab Spring. Reflecting what can be described as Israel's “bunker” mentality, the Israeli government has characterized the Arab revolutionary wave as a security challenge, notably given its concern about the rise of Islamist forces. Prime Minister Netanyahu has capitalized on this sense of insecurity to justify his government's lack of significant action when it comes to the peace process. On the Palestinian side, both Hamas and Fatah have lost long-standing regional backers in Egypt and Syria and have had to contend with their increasingly shaky popular legitimacy. This has spurred renewed efforts for reconciliation, which however have so far produced no significant results. Against this backdrop, the chances for a resumption of serious Israeli-Palestinian peace talks appear increasingly dim. An effort by the international community is needed to break the current deadlock and establish an atmosphere more conducive for talks. In this context, the EU carries special responsibility as the only external actor that still enjoys some credibility as a balanced mediator between the sides.

The absence of comprehensive, international legal obligations to prevent irresponsible transfers of arms has resulted in at least $2.2bn worth of arms and ammunition being imported by countries under arms embargoes between 2000 and 2010; • To have real impact, a prospective Arms Trade Treaty (ATT) must include legally binding criteria that prevent arms transfers to abusers of human rights or into situations where there is a substantial risk that they will undermine development or exacerbate armed violence; • The ATT can build on existing regional and sub-regional initiatives: as of 2012, 100 countries are already party to various regional agreements that include legally binding obligations to control the trade of arms and ammunition

410. Piecing It All Together: Why the Arms Trade Treaty must regulate parts and components for weapons and military equipment

Abstract:
Modern weapons and military equipment cannot be made or maintained without parts and components that are sourced and traded around the world. Without regulating this trade alongside the trade in complete weapons, it will be impossible to reduce the impact of irresponsible arms transfers on human rights, security, and development. Between 2008 and 2011, the global trade in parts and components was worth at least $9.7bn. This vast stockpile of weapons parts ranged from high-end components for aircraft to parts for small arms and light weapons. Weapons are assembled from components sourced from all corners of the world–frequently from countries without any effective arms transfer controls. Without global regulation of the trade in parts and components, it will be impossible to effectively regulate any part of the arms trade, as companies will be able to circumvent the rules by shipping weapons in pieces from multiple countries around the globe. The Arms Trade Treaty represents a unique opportunity to regulate the specialised parts and components used in the arms trade and, indeed, will be fatally flawed if it does not do so.
