282. Trade policy issues in the Wider Europe – that led to war and not yet to peace

Abstract:
This paper looks at the trade policy landscape of the EU and the wider Europe, with a focus on issues arising from the signature on 27 June 2014 of Deep and Comprehensive Free Trade Agreements (DCFTAs) between the EU and three East European countries (Georgia, Moldova and Ukraine), and actual or prospective issues relating to the customs union of Belarus, Russia and Kazakhstan (BRK), and the Eurasian Economic Union whose founding treaty was signed on 29 May 2014.The huge expansion of intercontinental free trade area negotiations currently underway, in which the EU is an active participant alongside much of the Americas and Asia, stands in contrast with Russia's choice to restrict itself to the Eurasian Economic Union, which is only a marginal extension of its own economy. Alone among the major economies in the world, Russia does not seek to integrate economically with any major economic bloc, which should be a matter of serious concern for Moscow. Within the wider Europe, the EU's DCFTAs with Ukraine, Moldova and Georgia are a major new development, but Russia now threatens trade sanctions against Ukraine in particular, the economic case for which seems unfounded and whose unilateral application would also impair the customs union.The Belarus-Russia-Kazakhstan customs union itself poses several issues of compatibility with the rules of the WTO, which in turn are viewed by the EU as an impediment to discussing possible free trade scenarios with the customs union, although currently there are far more fundamental political impediments to any consideration of such ideas. Nonetheless, this paper looks at various long-term scenarios, if only as a reminder that there could be much better alternatives to the present context of conflict around Ukraine.

283. The Transparency Rules and Transparency Convention: A good start and model for broader reform in investor-state arbitration

Abstract:
In July 2013, after nearly three years of work, the United Nations Commission on International Trade Law (UNCITRAL) adopted a set of arbitration rules that will help open some investor-state arbitrations to public view. The UNCITRAL Rules on Transparency in Treaty-based Investor-State Arbitration (Transparency Rules) were crafted with input from governments, academics, arbitration practitioners, and non-governmental organizations, and approved by consensus by the member states. When applied, the Transparency Rules will require disclosure of information submitted to, and issued by, arbitral tribunals throughout proceedings, mandate open hearings and expressly allow for participation by non-parties to a dispute. The Transparency Rules also guard against disclosure of confidential information and establish a repository in which all information will be published.

285. Water Pressures in Central Asia

Abstract:
Water has long been a major cause of conflict in Central Asia. Two states – Kyrgyzstan and Tajikistan – have a surplus; the other three say they do not get their share from the region's great rivers, the Syr Darya and Amu Darya, which slice across it from the Tien Shan, Pamir Mountains, and the Hindu Kush to the Aral Sea's remains. Pressures are mounting, especially in Kyrgyzstan, Tajikistan and Uzbekistan. The population in Central Asia has increased by almost ten million since 2000, and limited arable land is being depleted by over-use and outdated farming methods. Extensive corruption and failing infrastructure take further toll, while climate change is likely to have long-term negative consequences. As economies become weaker and states more fragile, heightened nationalism, border disputes, and regional tensions complicate the search for a mutually acceptable solution to the region's water needs. A new approach that addresses water and related issues through an interlocking set of individually more modest bilateral agreements instead of the chimera of a single comprehensive one is urgently needed.

287. Mediating Transition in Yemen: Achievements and Lessons

Yemen remains the only site of an Arab Spring uprising that has ended in a negotiated agreement and a structured, internationally supported transition process. As Jamal Benomar, the United Nations Special Adviser to the Secretary-General on Yemen, stated, “Yemen was definitely heading towards a Syria-type scenario” before international actors, including the United Nations (UN), helped to shepherd a complex transition process, which continues at the time of writing. Benomar, with support from a wide array of stakeholders, helped avert an escalating conflict in Yemen by stepping in to offer the good offices of the UN secretarygeneral without waiting for the UN Security Council or the embattled Yemeni regime to demand UN action. Benomar's interventions— including bringing Yemen's major political parties together amid the uprising—helped ensure that the country did not devolve into civil war when President Ali Abdullah Saleh stepped down after thirty-three years in power. That is, the UN opened a space for dialogue where none had previously been considered possible.

For the United States, the Arabian Gulf region remains one of the most geostrategically important locations in the world. Home to over half of the world's oil reserves and nearly a third of its natural gas, the Gulf states continue to supply world markets with an important share of their energy supplies. Continuing to be one of the world's largest regional suppliers of energy and holding much of the world's spare capacity in crude oil production makes the region central to the stability of the global oil market.

In August 2012, my colleague, David Sarcone, and I learned that a proposal for a workshop entitled, “The U.S.-India Relationship: Cross-Sector Collaboration to Promote Sustainable Development,” that we had submitted to the Strategic Studies Institute (SSI) of the U.S. Army War College (USAWC) had been selected for funding under the Academic Engagement Program of SSI. The workshop, which we coordinated and directed in conjunction with SSI, was held at our home institution, Dickinson College, from March 12- 14, 2013. The roster of participants was diverse and impressive: It included leading scholars, military officers, government officials, and representatives from the for-profit and not-for-profit sectors from India and the United States. The purpose of this volume is to share formal contributions made to the workshop by participants, and to convey some of the insights that surfaced during workshop sessions.

Governments have funded most of the nuclear industry's research and development, financed or guaranteed loans for its construction and export of nuclear plants, capped its liability for offsite damages in the case of nuclear accidents, and promoted its development internationally. Throughout, officials have insisted that the dangers of nuclear weapons proliferation attendant to the further spread of nuclear energy programs are manageable.
