121. Analysis of Payment Delays and Delay Compensation in MGNREGA

Abstract:
The Mahatma Gandhi National Rural Employment Guarantee Act (MGNREGA) provides a minimum of 100 days of work in a year for every rural household at a minimum wage. Because of MGNREGA, for the first time in the country, a transaction-based Management Information System (MIS) has been made available in the public domain; a great feather in the cap of transparency. An essential safeguard in MGNREGA is delay compensation to be paid, as penalty, when workers don’t receive wages within 15 days of completion of work. Despite several progressive measures, payment delays are rampant and the method of delay compensation is flawed leading to massive under-calculation of the true payable compensation. By analysing over 9 million transactions for the financial year 2016-17 across 10 states, we observe that only 21% of the payments were made on time. In 47% of the records analysed, only partial delay compensation is being captured and the remaining 32% of the records are not even being considered as delays in the NREGA MIS. These are due to the flawed method of calculating delay compensation. On aggregate, in our sample, while the true total compensation payable is about Rs 36 crore, only about Rs 15.6 crore is being calculated in the MIS.

122. Efficacy for Fighting Corruption: Evidence from 36 African Countries

Corruption is a major obstacle to economic growth, human development, and poverty reduction (Mauro, 1995, 2004; Asiedu, 2006). The practice of demanding or expecting monetary or other benefits in exchange for preferential treatment has plagued the global South, and high-profile revelations of corruption in politics and business have shed light on the magnitude of the problem (Baker, 2016; McCool, 2015). The poor are most vulnerable to both the immediate effects of having to pay bribes or do favours and the longer-term impacts of hampered growth and weakened investment power (Hosken, 2017; Baker, 2016). Recent research by Peiffer and Rose (2014) and Justesen and Bjørnskov (2014) notes that poor citizens faced with official corruption have fewer means to seek out services from alternative providers and are thus forced to “play the game.” In recent years, headlines have pointed toward a stronger stance against corruption in Africa. In South Africa, Ghana, Sierra Leone, and other countries, scandals and government responses have placed corruption at center stage. In Nigeria, President Muhammadu Buhari’s winning ticket in 2015 included zero tolerance for corruption, and he has taken several steps to try to fight what he calls the “hydra-headed monster” (Maclean, 2016; Gaffey, 2016). In Tanzania, President John Magafuli won the 2015 election after a campaign denouncing corruption and misconduct among civil servants (Muvunyi, 2016). No doubt strong and committed leadership is necessary if meaningful progress is to be made in fighting corruption. But as with any attempt to change the status quo, it is equally important that the policy be accepted, “lived,” and enforced by ordinary citizens. To what extent do ordinary Africans feel they can combat corruption? What informs whether citizens believe they can play a role? Findings from Afrobarometer Round 6 (2014/2015) surveys suggest that education and material security contribute to building efficacy among ordinary citizens for the fight against corruption. But leadership also matters: Perceptions that elected leaders or officials are corrupt make citizens less likely to think they can make a difference.

Abstract:
In this paper, I seek to discuss the conduct of monetary policy in an inflation targeting framework. The objective is to understand structural and institutional nuances in settings where this framework is successful in controlling inflation and challenges that emerge in the implementation of inflation targeting. I deal with the question: which institutional conditions should exist to support the successful implementation of inflation targeting in countries that use it? I find several institutional and legal elements which are common and can potentially explain much of the success in the implementation of inflation targeting among their monetary authorities. I benchmark these elements with the concepts of transparency and accountability of the central bank which are central tenets in the discussion of inflation targeting. I note that central bank credibility is a key outstanding element in explaining the success of inflation targeting. Components such as central bank independence and commitment to low stable inflation as the overriding objective of monetary policy represent critical preconditions for inflation targeting and can sustain the credibility of monetary policy.

124. A Better Process, a Stronger UN Secretary-General: How Historic Change Was Forged and What Comes Next

When on October 13, 2016, the General Assembly appointed by acclamation António Guterres of Portugal as the United Nations’ ninth secretary-general, there was a sense of excitement among the organization’s 193 members. For once, so it seemed, they felt they had played an important role not only in choosing the secretary-general but also in appointing a man generally considered to be an outstanding candidate for a position memorably described as “the most impossible job on this earth.”1 The five permanent, veto-wielding members of the Security Council (Perm Five) still exercised the greatest power in the selection process, as they always had in the past. Yet the candidate chosen appears, surprisingly, not to have been the first choice of either the United States or Russia, two of the Perm Five that until then had effectively chosen the secretary-general between them in an opaque and outdated process. It is doubtful that António Guterres would have been appointed if the General Assembly had not embarked on a novel process to select him. All previous secretaries-general were chosen on the basis of a haphazard and secretive process that occurred behind closed doors and was not merit based. The method to select the UN secretary-general is laid down in a few words in the UN Charter. Article 97 allocates responsibility for appointing the secretary-general to all members of the General Assembly acting on the recommendation of the Security Council. However, for the last seventy years—with one circumstance-specific exception2—the General Assembly has had no say in the selection: its member states merely rubber-stamped the decision of the Perm Five, which recommended just one candidate each time for the General Assembly to appoint. All previous secretaries-general were chosen on the basis of a haphazard and secretive process that occurred behind closed doors and was not merit based. The process was geared toward appointing the lowest common denominator candidate,3 but nevertheless produced a few outstanding secretaries-general. There has never been a female secretary-general, and until 2016 only three women had ever made it on a Security Council shortlist.4 The entire process lacked transparency and accountability and fell far short of the UN’s own standards and ideals, let alone the current recruitment practices for top international positions. Selections of all previous secretaries-general were made without appointment criteria, without a call for nominations or for CVs, without a timeline for nominations, and without public hearings or other effective methods of public scrutiny. In recent selections, candidates were often pushed into horse trading with the Security Council’s permanent members to gain their support in exchange for making promises of senior UN posts for their nationals. This has led to some countries holding monopolies over key posts.5 Moreover, the tradition of appointment for a five-year, once-renewable term, with reappointment controlled by the Perm Five, has effectively secured a secretary-general beholden to the Council’s most powerful members. The whole process “would be rejected as a bad joke by any serious institution in the private sector,” noted one senior UN authority who worked under multiple secretaries-general.

In established democracies, free and independent media play a crucial role in the democratic oversight of the security sector, allow for channels of communication to be established between government and society, and present a crucial foundation for guaranteeing and protecting human rights and freedoms. This security sector reform conference was unique in that journalists were invited as not just reporters but the main participants of the debates. The dialogue had a multi-dimensional, multi-levelled character that touched upon national and international questions of security as it pertains to information warfare, particularly in Ukraine.

126. How Anonymous Shell Companies Finance Insurgents, Criminals, and Dictators

Abstract:
The Panama Papers leak of eleven million documents in April 2016 revealed that former Iraqi Prime Minister Ayad Allawi, the brother-in-law of Chinese President Xi Jinping, longtime friends of Russian President Vladimir Putin, drug kingpins, and even a soccer megastar had something in common: they all channeled money through anonymous shell companies. Anonymous shell companies are entities that usually employ few or no workers, do not conduct any substantive business, and allow their owners to store or route money while hiding their identities. Because of the secrecy they can provide, anonymous companies represent an important nexus of corruption, money laundering, transnational organized crime, and terrorism, which directly harm U.S. interests. As one of the main facilitators of anonymous companies, the United States should pass legislation to disclose ownership information for all companies, increase federal contract transparency, and boost other business and government transparency mechanisms at home and abroad. Doing so would significantly cut back on the ability of terrorists, criminals, and their ilk to use American corporations, real estate, and trusts to finance activities that harm the United States and its foreign interests.

The Small Arms Survey’s Trade Update 2017: Out of the Shadows provides an overview of the international trade in small arms and light weapons in 2014, identifies the world’s top and major exporters of small arms and light weapons, and assesses changes in trade patterns from 2013 to 2014. The Update also presents the 2017 edition of the Small Arms Trade Transparency Barometer, which scores key exporters from the most to the least transparent. The main findings include the following: In 2014, the top exporters of small arms (those with annual exports of at least USD 100 million), in descending order, were: the United States, Italy, Brazil, Germany, South Korea, Austria, Turkey, the Russian Federation, the Czech Republic, Belgium, Croatia, Israel, Spain, Switzerland, and Japan. Brazil exported more than USD 500 million worth of small arms for the first time during 2001–14. In 2014, the top importers of small arms (those with annual imports of at least USD 100 million), in descending order, were: the United States, Canada, Indonesia, Saudi Arabia, Germany, Australia, Iraq, France, the Netherlands, and the United Kingdom. The United States remains the world’s largest importer, but the value of its imports declined for the first time since 2001, from USD 2.5 billion in 2013 to USD 2.2 billion in 2014. The international small arms trade was worth at least USD 6 billion in 2014. Ammunition accounted for 38 per cent of global transfers. The value of ‘military firearm’ shipments increased by 49 per cent between 2013 and 2014, from USD 475 million to USD 708 million. In contrast, the value of the trade in pistols and revolvers declined by 16 per cent, from USD 1 billion to USD 845 million. The 2017 edition of the Small Arms Trade Transparency Barometer identifies Germany, Switzerland, the Netherlands, and Serbia as the most transparent top and major small arms exporters. Iran, Israel, North Korea, Saudi Arabia, and the United Arab Emirates (UAE) are the least transparent major exporters. The average score in the 2017 Barometer is 11.33 out of 25 points. The areas that have seen the most improvement over the past year are: comprehensiveness (+17 per cent), access and consistency (+12 per cent), licences denied (+11 per cent), and clarity (+4 per cent). In their first ATT annual reports, Austria, Costa Rica, the Dominican Republic, and Liberia—none of which had reported small arms transfers to the UN Register—provided information on small arms transfers, thus increasing overall transparency on international small arms transfers. Although Iran, North Korea, and the UAE rarely, if ever, recorded small arms exports worth USD 10 million or more in Comtrade, Survey research indicates that they are major small arms exporters. It is more difficult to determine the status of Saudi Arabia, which appears to be a significant re-exporter of small arms.

130. Democratic Governance and the Frightening Impact of Corruption in Contemporary Nigerian Society

Abstract:
This work examines democratic governance and the frightening impact of corruption in contemporary Nigerian society in a bid to restore confidence in good governance and also improve the socio- economic development of the citizenry after fifty seven years of independence. Related literatures to the variables were reviewed including the adoption of the descriptive and content analytical method in the analysis of the secondary data in order to achieve the objectives of this study. Also, the social learning theory was employed as theoretical framework to find essence. Findings reveal that the phenomenon of corruption has evidently graduated beyond impunity, both in volume, scale, breadth, depth and has become a national cancer. In addition, the study notes that corruption has swallowed up Nigerian politicians into yet other webs of delusion, and deception such that the pursuit of corrupt practices by them, seem greeted with ovation. Aside this, the paper also highlights that since the mad rush for corrupt practices, especially amongst politicians seems impossible to abate, the alarming rate of vicious opulence which has engulfed the Nigerian nation clearly demonstrates naivety, desperation and un-Godly helplessness. Based on all these, the paper suggests that there is the urgent need to halt the hypocritical position in corruption cases involving high influential members of the government as well as the immunity covertly granted their cronies. The paper recommends that amongst other measures, government should not only be transparent in enforcing all relevant laws against corruption, but prosecute all those found culpable. Finally, Judicial Service Commission as autonomous body should halt the incessant dismissal of corrupt cases by judges on technical grounds, as well as continuing to beam its searchlight on all corrupt judicial officers.
