911. Perceptions Of The War Against Terrorism (WAT): A Malaysian Case Study

Abstract:
Though terrorism has existed for more than 2,000 years, the 9/11 attacks on the U.S. brought international repercussions unlike any previously experienced. In response to the attacks, the U.S. immediately attempted to build a broad-based anti-terrorism coalition in what is known as the “War against Terrorism” (WAT) or “War on Terrorism.” Malaysia has its own experiences with terrorism, such as during the 'communist emergency' of the 1950s. In light of Malaysia's unique history in overcoming terrorism and the present-day WAT, this study aimed to explore Malaysian's perceptions of the WAT. Findings from the study indicate that Malaysians hold mostly negative views on the WAT, i.e.: they doubt the intentions of the US government; they view the WAT as a fight against Muslims and as a means for US control; they view the military approach as ineffective; they perceive a conscious effort to link terrorism to Islam; they view the Western media as being insensitive to non-Westerners and they believe that the WAT has had little impact on reducing terrorism due to hidden political agendas. Qualitative findings from the study stress the need for counter-terrorism policy makers to identify the root-causes of terrorism in order to develop appropriate socio-economic programs for the poor, marginalized, discontented and discriminated groups in societies.

912. The Philippines: The Collapse of Peace in Mindanao

Abstract:
On 14 October 2008 the Supreme Court of the Philippines declared a draft agreement between the Moro Islamic Liberation Front (MILF) and the Philippines government unconstitutional, effectively ending any hope of peacefully resolving the 30-year conflict in Mindanao while President Gloria Macapagal-Arroyo remains in office. The Memorandum of Agreement on Ancestral Domain (MOA-AD or MOA), the culmination of eleven years' negotiation, was originally scheduled to have been signed in Kuala Lumpur on 5 August. At the last minute, in response to petitions from local officials who said they had not been consulted about the contents, the court issued a temporary restraining order, preventing the signing. That injunction in turn led to renewed fighting that by mid-October had displaced some 390,000.

Abstract:
One of the most striking aspects of operations in Iraq during the “surge” of 2007 was the growing tribal uprising against al-Qa`ida. In late 2006 and 2007, this uprising began to transform the war. I spent considerable time on the ground throughout May and June 2007 in Baghdad and the surrounding districts working with U.S. and Iraqi units, tribal and community leaders and fighters engaged in the uprising. Listening to them talk, watching their operations and participating in planning and execution alongside American commanders supporting them provided insight into their motivations and thought processes. Moreover, during this process of participant observation I was able to gather some field data on the relationship between globally-oriented terrorists in Iraq (primarily al-Qa`ida) and the locally-focused militants who found themselves fighting as “accidental” guerrillas in the early part of the war, only to turn against the terrorists in 2007.

Imagine three cases: Corporal Greene returns to the United States in a body bag having been killed by an elite armed guard in a war that had been officially authorized as a defense of her country against foes who have the capability and desire to attack her fellow citizens and soldiers at home and abroad with acts of terrorism. Such foes may either be planning eventually to launch their own attacks or to facilitate attacks by others who have an established record of using terrorism against U.S. soldiers and citizens.

Abstract:
The Clash Within is a lengthy account of the rise of the Hindu right and of anti-Muslim violence in contemporary India. There is little in the book that strikes the specialist as new or original, since the events and arguments it deals with are well known and extensively dealt with in the existing literature, but the author wants to address a wider audience. Nussbaum argues that her contribution is as that of a loudspeaker, since she feels that Indian developments are wrongly ignored in the United States and Europe. In her view, the reason for this neglect is ''the way in which terrorism and the war on Iraq have distracted Americans from events and issues of fundamental significance'' (p. 1). This is not self-evident, since one might plausibly contend that Iraq and the Middle East (including Israel) rightly attract more attention and are of more fundamental significance for American foreign policy than Hindu-Muslim antagonism in India. How-ever, Nussbaum's argument is not located at the level of geopolitics, but at the level of national political systems. She argues that the problem of how religious nationalism affects the largest democracy in the world is instructive for all democracies. From a philosopher one might expect a theoretical argument about democracy, nationalism, and religion to frame what we can learn from the Indian case, but Nussbaum's book surprisingly offers more journalism than theory.

918. Terrorist Crimes and International Co-operation: Critical Remarks on the Definition and Inclusion of Terrorism in the Category of International Crimes

Notwithstanding the emphasis placed on the need for concerted international action to confront the problem of terrorism, positive international law is far from treating the issue of defining the criminal notion of terrorism coherently; the discussion of such a notion is being made hostage [sic!] to the abuse of the term 'terrorism' in the course of the debate and to the confusion between an empirical description of a phenomenon and its treatment under criminal law. Proposing a core-definition approach, this article elaborates a notion based upon the basic rights of civilians and on the unacceptability of their violation by terrorist methods carried out by private organized groups. The definition proposed here, which does not recognize in the perpetrator's motivations any material relevance because of the overwhelming importance of the value infringed, is able to minimize the relevance of some abused arguments (such as state terrorism or the treatment of 'freedom fighters'), could quickly gain customary status and would prove useful in interpretation and in drafting exercises, both at international and national level. As for the inclusion of terrorism in the category of international crimes, it is submitted that two interpretive options are open: to consider the category of crimes against humanity as already able to embrace core terrorism; or to place the strong rationale underlying the stigmatization of terrorist crimes in the perspective of the gradual emerging of a discrete international crime of terrorism. National case law seems to point to the latter option, but the question does not appear settled: for this reason, the discussion regarding the prospect of an amendment to the ICC Statute expressly to include terrorist crimes continues to be of interest. An express inclusion could be useful to avoid doubts or discrepancies at national level and to solve some outstanding issues of the international community's criminal policy.

919. Saudi Arabia's “Soft” Counterterrorism Strategy: Prevention, Rehabilitation, and Aftercare

Abstract:
In the aftermath of a wave of deadly terrorist attacks that began in 2003, the Kingdom of Saudi Arabia launched a wide-ranging counterterrorism campaign. Central to Saudi counterterrorism efforts has been the use of unconventional “soft” measures designed to combat the intellectual and ideological justifications for violent extremism. The primary objective of this strategy is to engage and combat an ideology that the Saudi government asserts is based on corrupted and deviant interpretations of Islam. The impetus for this soft approach came in large part from the recognition that violent extremism cannot be combated through tradition security measures alone. This Saudi strategy is composed of three interconnected programs aimed at prevention, rehabilitation, and post- release care (PRAC).

As the third anniversary of the assassination of former Lebanese Prime Minister Rafik Hariri approaches, Lebanon is witnessing its worst crisis since the 15-year civil war. Hariri's February 14th assassination—widely suspected to have been orchestrated by Syria—enraged the Lebanese who took to the streets one month later, demanding the withdrawal of Syrian troops. Dubbed the Cedar Revolution, this mass protest movement succeeded in ending nearly 30 years of Syrian military occupation. It was to have ushered in a new era of democracy. Instead, Lebanon has suffered through bombings, assassinations, war between Hezbollah and Israel, and bouts of sectarian violence.
