241. The Flow of Foreign Fighters to the Islamic State

Abstract:
Foreign fighters have long been a key element of transnational jihad. In the 1980s, foreigners flocked to South Asia to fight alongside the Afghan mujahedeen. The same thing occurred to a lesser extent in Bosnia and Chechnya in the 1990s and again following the 2003 invasion of Iraq. But the Syrian civil war and the subsequent rise of the Islamic State—also known as IS, ISIS, or ISIL—have broken new ground. Never before have jihadi foreign fighters rallied at the speed and scale as they have in the territory that IS now controls. Today, between 31,000 and 27,000 fighters from more than 86 countries are estimated to have made the journey to join the ranks of IS and other extremist groups, doubling the 2014 numbers. These foreign fighters fill leadership roles within the organization’s hierarchy and seem to be disproportionately responsible for the atrocities and brutality for which IS has become infamous. IS uses this extreme violence to create a climate of impunity and to intimidate both civilian populations and potential enemies. In addition, the recent attacks in Paris vividly demonstrated the international terrorist threat that foreign fighters pose. Finally, these fighters present a long-term challenge to their source countries if and when they return. In response, the U.S.-led Global Coalition to Counter ISIL has prioritized the flow of foreign fighters as one of its five major lines of effort. In 2015, United Nations Security Council Resolution 2178, or UNSCR 2178, was adopted with the specific aim of addressing the foreign fighter threat. Similarly, the coalition has established a working group to coordinate multilateral efforts to impede the flow of foreign fighters to Syria and Iraq and to implement the UNSCR. But much work remains to be done.

Abstract:
The UN Declaration on the rule of law at the national and international levels seems to open new possibilities for listed terrorist suspects claiming legal protection or those seeking damages for harm caused by UN peacekeepers because the Declaration provides that the rule of law applies to the United Nations itself. However, the Declaration raises questions regarding the elements of the rule of law, its legal basis, and binding nature. This paper attempts a reconstruction of the UN Declaration and relevant UN practice under an international public authority perspective to explain and develop elements of the rule of law applicable to the UN, to determine its legal basis, and to investigate its binding nature. It argues, that since measures under Chapter VII must be effective if the UN wants to fulfil its purpose (Article 1 (1) UN Charter), the UN is bound by the rule of law insofar as “effective” measures require that related legitimacy concerns are addressed by rule of law safeguards.

243. Judgement Day for ISIL and What It Would Mean for Canada

Abstract:
Despite the carnage wrought by ISIL around the world, the days appear numbered for its caliphate in Syria and Iraq. We are likely talking the shorter to medium term at most. ISIL faces intense military pressure on all fronts. It continues to lose territory and its leadership figures are being targeted and killed. Increasingly ISIL faces significant challenges in replenishing its losses due to efforts by Turkey and most nations internationally to block the flow of foreign fighters into the caliphate. As leadership figures are eliminated, internal factionalism will create serious stresses and vulnerabilities. The forces aligned against ISIL are powerful, despite conflicting agendas. Add to this reports of financial problems, including a strained ability to pay its militants, and the result is a picture of an entity on a downward trajectory. This in no way means that the caliphate or its extremist message will die easily or that we are nearing an end to the scourge of ISIL inspired terrorism – only that its ability to sustain itself territorially has limits. If one accepts the above assessment, now is the time to consider what this will mean. Now is the time for thinking and planning directed at dealing with the eventual collapse of a self-proclaimed state in which countless thousands have been radicalized, traumatized, received military and terrorists training, let alone the reality of child soldiers and intense psychological scarring caused by ISIL.

Abstract:
A paradox in the study of violent radicalization is that while each of the empirical findings can be explained with multiple theories, very few theories can explain a relevant number of these findings simultaneously. This paper conducts a functional behavior assessment of violent radical behavior, investigating the factors responsible for its initial learning and subsequent maintenance. Specifically, a model of radicalization is proposed that can explain a wide range of observed phenomena, accommodate apparent exceptions, and obtain testable consequences. It also challenges some firmly rooted ideas, as the alleged existence of aggressive influence practices, or brainwashing. Finally, the model can also provide valuable predictions for subsequent research, such as those related to the reversibility of the process of radicalization.

245. Defining Down Sovereignty: The Rights and Responsibilities of Nations

Abstract:
Defining down sovereignty" refers to the normative thesis that sovereignty should not grant a state absolute protection against armed intervention in its internal affairs by other states, and that instead the international community should condition such immunity on states living up to particular standards. This essay suggests two modifications to this thesis. First, the international community should spell out the kinds of failures to protect civilians that can justify armed interventions by other states, as well as which agency has the authority to determine when such failures have occurred. In other words, the international community should determine how low to set the bar for intervention, and who makes the rules. Second, the international community needs to establish an additional international responsibility, namely, a responsibility to prevent international terrorism. The essay treats both of these modifications as shared international normative understandings; it does not attempt to translate these changes into international law.

Abstract:
The postwar development of the Intelligence Services in Japan has been based on two contrasting models: the centralized model of the USA and the collegiality of UK, neither of which has been fully developed. This has led to clashes of institutional competencies and poor anticipation of threats towards national security. This problem of opposing models has been partially overcome through two dimensions: externally through the cooperation with the US Intelligence Service under the Treaty of Mutual Cooperation and Security; and internally though the pre-eminence in the national sphere of the Department of Public Safety. However, the emergence of a new global communicative dimension requires that a communicative-viewing remodeling of this dual model is necessary due to the increasing capacity of the individual actors to determine the dynamics of international events. This article examines these challenges for the Intelligence Services of Japan and proposes a reform based on this new global communicative dimension.

Highly enriched uranium (HEU) is the simplest nuclear material to use for an improvised nuclear device, making it a target for terrorist groups seeking to inflict mass destruction. This paper examines the current status of HEU in naval propulsion programs worldwide, with a specific focus on the U.S. Navy’s program. It includes a technical assessment of less risky low-enriched uranium (LEU) alternatives and recommendations to enable conversion to such alternate technologies.

248. How to Build a More Sustainable and Mutually Beneficial Relationship with Saudi Arabia

The United States is not taking Saudi Arabia’s outsized responsibility for human rights abuses within or beyond the kingdom’s borders seriously enough. President Barack Obama did not raise the issue in his meeting last year with the late King Abdullah. On his way to meet the new Saudi monarch, King Salman, in January 2015 the President remarked, “Sometimes we have to balance our need to speak to them about human rights issues with immediate concerns that we have in terms of countering terrorism or dealing with regional stability." He did not mention that Saudi Arabia’s policies (denying rights and freedoms at home while leading a vigorous, region-wide effort to push back against popular calls for better governance) have themselves contributed to regional instability and undermined counterterrorism efforts. Such policies harm U.S. interests and those of the people of Saudi Arabia and the region as a whole.

249. How to Counter Terrorism by Supporting Civil Society in the United Arab Emirates

President Obama recently made a series of commendable declarations supporting civil society and affirming its importance to securing stability and fighting extremism. At the White House’s Summit on Countering Violent Extremism in February 2015 he announced, “When people are oppressed, and human rights are denied—particularly along sectarian lines or ethnic lines—when dissent is silenced, it feeds violent extremism. It creates an environment that is ripe for terrorists to exploit. When peaceful, democratic change is impossible, it feeds into the terrorist propaganda that violence is the only answer available.” The President added, “[W]e must recognize that lasting stability and real security require democracy. That means free elections where people can choose their own future, and independent judiciaries that uphold the rule of law, and police and security forces that respect human rights, and free speech and freedom for civil society groups.” That same month he said, “My argument to any partner that we have is that you are better off if you've got a strong civil society and you've got democratic legitimacy and you are respectful of human rights.” In April 2015, speaking specifically about the six U.S. allies that comprise the Gulf Cooperation Council (GCC)—Bahrain, Kuwait, Qatar, Oman, Saudi Arabia, and the United Arab Emirates (UAE)—he noted, “The biggest threats that they face may not be coming from Iran invading,” and warned of “populations that, in some cases, are alienated, youth that are underemployed, an ideology that is destructive and nihilistic, and in some cases, just a belief that there are no legitimate political outlets for grievances.” A lack of peaceful outlets for political grievances does indeed drive extremism and instability, but the Obama Administration continues to provide seemingly unconditional political and military support for GCC countries that have actually increased their repression against civil society in recent years. This contradiction at the heart of U.S. policy must be confronted and resolved, especially because it has a direct bearing on counterterrorism cooperation and U.S. national security interests. The president promised to have a “tough conversation” with the GCC leaders about their destructive policies. The \ White House and Camp David meetings with GCC leaders on May 13-14, 2015 provides the perfect opportunity to develop that conversation. Human Rights First produced blueprints in 2015 for how the United States can support civil society in Bahrain and Saudi Arabia to encourage reform and respect for human rights—advances that would help bring stability to a volatile region and align with the administration’s stated policy goals. This report extends that series to an analysis of the repression of another U.S. security partner in the Gulf: the United Arab Emirates. It examines the UAE’s relations with the United States and what Washington can do to support a besieged Emirati civil society. Strong, functioning civil societies across the world—including in the UAE—are, as President Obama rightly identified, “a matter of national security” for the United States. This report is based on research conducted during a Human Rights First fact-finding trip to the UAE in April 2015, including dozens of discussions with human rights defenders, civil society activists, journalists, academics, lawyers, independent experts, officials from the United States and other governments, and others. Local human rights activists spoke to Human Rights First on condition of anonymity out of fear for their safety. Human Rights First thanks all those who provided information for this report.

250. The Role of Human Rights in Countering Violent Extremism

On the sidelines of the annual United Nations General Assembly meeting, the United States is sponsoring briefings and meetings with allies to develop strategies to counter the spread of violent extremism. These activities will build on the February 2015 White House Summit to Counter Violent Extremism (CVE). The CVE initiative is designed to advance a more preventive and proactive approach to countering violent extremism. It takes into account the lesson of the past decade that addressing the threat of violent extremism requires a truly comprehensive strategy that goes beyond military intelligence and law-enforcement tools. The United States government has played a leading role in moving forward a global conversation on countering violent extremism since convening the White House Summit. If this process is to yield results, the United States will have to continue to provide leadership in close coordination with the efforts of the United Nations and other multilateral organizations, notably the U.N. Secretary General’s Plan of Action on Preventing Violent Extremism to be presented to the U.N. General Assembly later this year. While sustained U.S. engagement with this multilateral process will be essential, just as important will be a clear demonstration from the United States that it is putting the principles of its CVE approach into practice. The United States must show its commitment to the principles it has been championing through its more comprehensive, preventive CVE strategy in each of its bilateral relationships, particularly those with states facing challenges from the threat of terrorism, which also engage in systematic violations of human rights. It is no accident that these two conditions often coincide. This blueprint brings together examples of existing bilateral relationships with some U.S. allies that fit this category. The material collected here illustrates the vital importance for the United States to encourage its allies to implement security policies rooted in the reality that good governance, the rule of law, and respect for human rights are essential tools in countering violent extremism.
