81. What Ukraine Should Demand of Itself and from the West

Abstract:
This paper is part of CTR's Working Paper Series: "Eastern Voices: Europe's East Faces an Unsettled West." Once again, the world is grappling with historic challenges, as it did when the Soviet Union fell in 1991, and once more, Ukraine is at the forefront of these challenges. The Kremlin’s attempts to destroy Ukraine’s European aspirations is simply one of Russia's many challenges to the post-World War II international liberal order. The actions of the Kremlin -- be they in Ukraine, Georgia, Moldova, and Syria; in the U.S. electoral process; or in the funding of far-right and far-left political parties throughout Europe -- have but one purpose: to destroy the transatlantic partnership and the principles of the post-World War II order and peace. Ukraine is simply one of the battlegrounds, but it is a key because it is in Europe. Unity of the transatlantic partnership and of the democratic nations is critical. Unity of support for the Ukrainian transition process is a serious part of this battle, because Ukraine’s successful democratic, rule-of-law based transformation is key to ensuring a Europe whole, free and at peace.

Abstract:
Armed combatant and leader of the Hizbul Mujahideen Burhan Wani was killed by the Indian Army in July 2016. This killing triggered a new phase of insurgency in Kashmir. In the Valley, the local populace started mobilizing against the Indian State in the name of azadi, (freedom). In such volatile context, the production of the national sentiment of the Kashmiris is documented from a distanciated perspective. Frontiers of the national group are explored from New Delhi, as well as the logics of differentiation and otherification of the Kashmiri group towards the Indian one. Kashmiri nationalism therefore more clearly appears in a negative definition (what a Kashmiri is not) than in a positive definition (what a Kashmiri is). The slight and incremental slip of the meaning of azadi demands is at the heart of Kashmiri nationalism. From an original demand for greater autonomy within the Indian Republic, demands of azadi now refer to the independence of the Valley – yet there are nuances that will be studied. They also convey an utter rejection of “Indianess” whether national or citizen. In that respect, New Delhi’s negating the political aspect of the mobilizations that are taking place in the Kashmir Valley has dramatically fuelled the national sentiment of the Kashmiris. The current insurgency that started in July 2016 has sped up the pace of the process. Despite the escalating tensions in the Valley, New Delhi keeps refusing to consider the political dimension of the local social movements, be they violent or peaceful. That is the reason why, beyond Kashmir and Kashmiris themselves, studying the political demands of the Kashmiri population does shed a light on the functioning of the Indian nation and the Indian state.

Abstract:
India adopted a democratic parliamentary constitution in January 1950. This constitution enumerates all fundamental civil and political rights irrespective of religion, caste, language or region. However, in practice these rights are denied to religious minorities and low caste and out caste Hindus called Dalits. The Muslims being the largest religious minority have faced more discrimination than any other minority. Their religious cultural identity has been under pressure and they are underrepresented in the parliament or state assembly. The rise of Hindu revivalist movements under the BJP has made the Muslims more vulnerable to Hindu extremism and intolerance. Pakistan has raised the issue of India’s atrocities in Kashmiri at the international level. It supports the Kashmiri struggle for political and civil rights and their right to decide on their own about their political future. The UN and the international community must restrain India from resorting to “state terrorism in Kashmir”.

Abstract:
With the partition of the Indian Subcontinent Jammu and Kashmir presented a very chaotic and confusing picture. It was a Muslim majority state ruled by a Hindu monarch. Both India and Pakistan wanted to control Kashmir because of its strategic location and geo-political importance. Geographically, economically and demographically, Kashmir was contiguous more to Pakistan than India. However, events moved with lightening rapidity and the state ended up being part of India by virtue of the controversial accession. This paper is an attempt to understand the political conditions and loyalties of Kashmir at the time of partition. An endeavour has been made to understand the background of the tribal invasion and the accession of the state to India

Abstract:
India has long been obsessed with its rivalry with Pakistan, and for many years India viewed Pakistan as its principal security threat. Pakistan continues to support terrorist attacks directed against India and India-controlled Kashmir, and is continually increasing its nuclear arsenal and delivery systems for nuclear warheads. Despite this, Indians have come to feel more self-assured and no longer see Pakistan as the country’s principal security threat.China now occupies this position. India no longer views itself simply as the predominant regional power in South Asia, but as an aspiring world power and is gearing up for what many in India believe is an inevitable conflict with its neighbor the Peoples Republic of China. India has embarked on an outreach program to solidify friendly ties to other Asian nations that feel threatened by China, and is devoting a lot of attention to the ASEAN states (particularly Viet Nam), Taiwan, South Korea, and Japan. There is increasing speculation that this relationship could develop into a formal alliance, especially if the United States becomes less active in Asia.

Abstract:
The world is witnessing higher levels of displacement than ever before. The statistics tell the story. Today, an unprecedented 65 million people—including 21 million refugees—are displaced from their homes. Since the start of the Syrian crisis in 2011, 5 million people have fled to nearby Turkey, Lebanon, Iraq, and Jordan. And refugees now spend an average of 10 years away from their countries. Equally striking as the scale of the crisis are the consequences of an inadequate response. Individual lives hang in the balance; refugees are struggling to rebuild their lives, find jobs, and send their children to school. Developing countries that are hosting the overwhelming majority of refugees— and at the same time trying to meet the needs of their own citizens—are shouldering unsustainable costs. We are seeing global stability and hard-won development gains threatened.

They can be explained as the conscious choice of a regime striving to maintain power, decisions conditioned in turn by deep-seated pathologies that limit the Kremlin's room for maneuver. This article addresses the legality and desirability of States asserting universal jurisdiction without the suspect being present on their territory when prosecuting international crimes before domestic courts. First the legality under international law of States asserting universal jurisdiction in absentia (or absolute universal jurisdiction) will be discussed. No comprehensive regulation in this regard appears to exist in codified international law. Based on State practice, it would seem that no customary law either fully permits or entirely prohibits States asserting absolute universal jurisdiction. Applying the Lotus paradigm, it could arguably be concluded that the lack of a prohibition under international law results in States being allowed to assert universal jurisdiction in absentia when prosecuting certain international crimes. Having established its legality, this article will consequently approach absolute universal jurisdiction from a normative point of view, i.e. whether States should assert it. Although a tool in ending impunity of perpetrators of international crimes, it will be concluded that it is undesirable for States to assert absolute universal jurisdiction. Its use is likely to compromise fundamental rights of the accused and has a destabilizing effect on international relations while only suboptimally serving the goals of criminal prosecution.
