Abstract:
The term maritime security often evokes destroyers and aircraft carriers, disputes over territorial waters or islands, or piracy and terrorist attacks such as the USS Cole bombing in 2000. High profile crises can lead us to forget that maritime security is an everyday event; it is about enabling safe transit. Each step within the maritime transport of goods has security challenges and considerations. At the same time, the continued stability and effectiveness of maritime trade is itself a broader security matter of importance to consumers, businesses, and governments. With the “weaponization of finance” maritime trade will play a central role in economic actions being taken out of geopolitical concerns.

The Arctic region sits at a jumping-off point. The international community may choose to leap toward global tension and a reinvigoration of Cold War-style conflict in the high north. Or, those with interests in the region may choose to elevate the current spirit of cooperation and build extant multilateral partnerships into lasting formal relationships that will safeguard and develop regional interests. Organizations such as the Combined Maritime Forces (CMF) and its affiliated organizations already work together to promote security, stability, and prosperity across 3.2 million square miles of international waters. Naval forces, nation-states, international organizations, non-governmental organizations, and private industry voluntarily work together without political or military mandate.[1] The organizational structure is flexible, maximizes each contributing partner’s assets, encourages communication among all interested stakeholders, and builds upon already established networks. Arctic stakeholders need only turn to CMF and its affiliated organizations to find a model for future Arctic cooperation. The necessary international will,[2] multilateral partnerships, and international organizations currently exist to serve as the foundation for an Arctic organizational structure in the spirit of CMF operations. Current momentum is toward more cooperation among Arctic stakeholders. However, the global order is fragile and tides are subject to ambiguous change. 113. Title to Territory in the Post-Colonial Era: Original Title and Terra Nullius in the ICJ Judgments on Cases Concerning Ligitan/Sipadan (2002) and Pedra Branca (2008)

Abstract:
This article approaches two International Court of Justice judgments on the cases concerning Ligitan/Sipadan (2002) and Pedra Branca (2008) from the perspective of the law of territory in the post-colonial context, showing that the Court managed to free the concepts of ‘original title’ from ‘terra nullius’. It is prefatorily explained that the concepts of ‘original title’ and ‘terra nullius’, which operate in combination, had both functioned as bases for the traditional law of territory and as unilateral justification for colonization by European powers. By contrast, analysis of the two recent judgments illustrates that the Court contrived to separate the two concepts from the context of colonialism by avoiding the determination of the islands as ‘terra nullius’ and expanding the concept of ‘original title’ while preserving the existing framework of law of territory. The problem is presented with a caveat, however; overemphasizing the significance of ‘original title’ in the post-colonial context might lead to disregard for the foundations of title to territory, that is effective control of territory and its legitimizing logic, on which the territorial order of today’s international society is based.

Abstract:
One week before the third Eastern Partnership summit in Vilnius on November 28-29, 2013, Ukraine suspended the preparation of an association agreement with the European Union, which had been under negotiation since 2007. When the agreement was finally signed in June 2014, President Yanukovych had fled the country under people’s pressure, and the integrity of Ukraine was challenged in the East by separatists and their Russian allies. These events came paradoxically at a time when the country's cohesion seemed stronger than in the 1990s. Far from being divided into two parts, Ukraine consists of the pieces of broken empires that all have good reasons to join in the state, as recent as this one may be. Indeed, its geography, electoral or economic, does not show a split between two blocks, but various lines of division that do not necessarily herald the breaking up of the state. Since the independence, this diversity had never been translated into new institutions: for several reasons, the reshaping of the centralized regime inherited from the Soviet era was deemed untimely by the country’s political forces. Presented as a priority by the members of the Parliament elected in 2014, the reform of territorial government is being implemented while Ukraine’s driving regions are either paralyzed or threatened by war.

Daniel Khachatryan is a Hrant Dink Foundation fellow at the Turkish Economic and Social Studies Foundation (TESEV) within the framework of the Support to the Armenia-Turkey Normalisation Process Programme financed by the European Union. Khachatryan’s academic background includes studies at Yerevan State University, University of Oslo and Fletcher School of Law and Diplomacy, Tufts University. Abstract:
This document analyzes the tools that at present Russia uses with the intention of modifying and extending his area of strategic influence in the East of Europe. It centers fundamentally on the external action of Russia after the change of Government on Ukraine. The document tries to give response, first, to which they are the intentions of Russia with regard to his relations with the European Union; secondly if Russia uses as political tool his energetic resources; and thirdly, if the actions of not linear war developed in the peninsula of Crimea form a part structurally of the external action of Russia. In his development it does not think that the Euromaidan constitutes a point of inflexion in the strategic Russian thought, but rather the point of decision of a strategic approximation to the new world order presented in 2007 and that was applied by the first time in Georgia's war in 2008.

Abstract:
Although disputes in the South China Sea are in general under control since 2009, developments show that China-Philippines and China-Vietnam are two key relationships that have experienced incidents leading to fluctuating levels of tension in the South China Sea region. This study reviews the evolution of these two relationships in relation to bilateral disputes in the South China Sea and the respective approaches to managing these disputes, with emphasis on the post-2009 period. By comparing the China-Philippines and China-Vietnam approaches, it intends to analyse the differences/similarities and their implication on the management of the South China Sea disputes, as well as their bilateral relations in a broader sense.

Abstract:
Northeast Asia is one of the most important crucibles of global economic and strategic change, and it is far from a stable one. The modern histories of China, Japan and South Korea were forged by Japan's colonisation of China and Korea and the Korean War that divided the peninsula and saw China on the side of North Korea and Japan on the side of South Korea. This recent history has left the bilateral relations on each side of this turbulent triangle strained by a lack of trust, popular antipathy and unresolved territorial disputes. As noted in the project's Beijing workshop, the stalled trilateral free trade agreement negotiations between the three Northeast Asian neighbours, launched with great hope in 1997, have been the victim of this turbulence and strain.

119. Ukraine: Running out of Time

Abstract:
Ukraine's provisional government faces an uphill struggle to make it to the 25 May presidential election. Shaken by separatist agitation and distracted by Russian troops on its borders, it has not asserted itself coherently and has lost control of the eastern oblasts (regions) of Donetsk and Luhansk, which have voted for independence in contentious referendums. It appears incapable of keeping order in much of the south east, where separatists, supported and encouraged by Moscow, threaten the state's viability and unity. Kyiv and the presidential candidates should reach out to the south east, explaining plans for local self-government and minority rights, and for Ukraine to be a bridge between Russia and Europe, not a geopolitical battleground. With relations between Moscow and the West deeply chilled, the U.S. and EU should continue tough sanctions to show Russia it will pay an increasing cost for destabilising or dismembering its neighbour, while pursuing parallel, vigorous diplomacy to reach understandings that avoid the worst and respect mutual interest.
