1. How to Unbind the State Capture in Serbia? Towards Security Institutions and Foreign Policy in the Service of Citizens

Abstract:
There are many findings of domestic and foreign research organisations that unequivocally indicate that Serbia is a captured state, with a hybrid political regime. Security institutions play a major role in the capture of the state and the collapse of democracy in Serbia, as well as in preserving the situation the way it is. The Belgrade Centre for Security Policy (BCSP) was one the first organisations in Serbia to notice this negative trend; consequently, in 2019 and 2020, we investigated and documented in detail the role of the security intelligence services, the police, the army and private security companies in capturing the state, as well as the impotence of oversight and control bodies. In the research that followed in 2021, we established that the government of the Serbian Progressive Party, led by Aleksandar Vučić, had completed the capture of the state and that today’s security institutions are operating with the aim of preserving such a state of affairs. We also researched the foreign policy aspects of this negative process. Public opinion surveys conducted by BCSP have also established that the majority of the citizens are aware that Serbia is a captured state, i.e. that politicians, organised into interest groups, use state institutions together with financially powerful actors to further strengthen their political and financial power, all to the great detriment of citizens. Since state institutions are deeply captured and the citizens are aware of that fact, we have decided not to further document this process; in this study, we rather tried to determine how to organise the security institutions and strengthen their external overseers so that the security sector can no longer be easy prey for those who are politically and financially powerful. In other words, we wanted to determine how to ensure that security institutions work in the interest of citizens, precisely as the Constitution of Serbia requires. The starting point of this endeavour were the findings of the above mentioned BCSP research, in which we identified the “gray areas” and “veto points” within the security sector, that is, legal and institutional solutions that made it possible to capture these institutions quite easily. We verified the solutions for the reorganisation of these gray areas against the opinions of our interlocutors, former and current employees of the security institutions and the judiciary, diplomats, journalists, attorneys, politicians and representatives of civil society. Abstract:
The purpose of this article is to review the works of several academics specialized in the matter of security, which the authors will use as an analytical setting and revision their outcomes to define and understand the concept of state capture. Once the concept of state capture is defined, then the case of Mexico will be analysed. This article intends to discuss several indicators regarding state capture such as the rule of law, how political violence has also influenced the issues of corruption, impunity, and mentions how money laundering prevention serves as a tool for tackling corruption. In order to grasp an understanding what state capture is, we must first develop conceptualizations of corruption, impunity and its classifications, the rule of law, and the state apparatus. This article intends to analyse the implications that all of the above might have with regards to a state captured democracy, from an academic approach.

3. Don’t Talk to Me about Democracy while I’m Guarding Kosovo – analysis of narratives used to capture the state

Abstract:
Based on an analysis of top officials’ speeches, this text will show how officially promoted narratives about Kosovo serve to capture the state. This analysis has shown the mechanism by which the Serbian authorities, by controlling and strategically using narratives on resolving the Kosovo dispute, manage to increase their own discretionary powers while simultaneously abolishing control mechanisms. In other words, under the pretext of resolving the Kosovo issue, the separation of powers and democratic decision-making are being abolished, leading to an even greater level of state capture. The analysis is divided into five thematic units. The first chapter shows how the executive power instrumentalises Kosovo and, using the media, creates a false impression in the public that, when it comes to Serbia’s membership in the European Union, Kosovo is more important than the rule of law, thus putting a false premise before the citizens: that their choices are either Kosovo or a future governed by the rule of law. The second part of the analysis shows how the government in Belgrade traded stability for democracy and ensured the tacit consent of the West in preserving political stability in Serbia for the purpose of reaching a final agreement with Pristina. The third and fourth parts point to the absence of real social dialogue on Kosovo, and reveal how the President of Serbia and a narrow circle of his associates strive to increase their discretionary power to decide on Kosovo beyond the Constitution and democratic institutions, all under the pretext of protecting national interests. Finally, in the last part, the authors will provide additional evidence for understanding why citizens of Serbia cannot come to terms with the loss of state control over Kosovo, that is, why the opinion of the majority of Serbian citizens – that Kosovo should not be recognised – is still relevant.

Abstract:
We are presenting you the Dossier on organized crime in the Balkans, produced in cooperation between the Italian Institute for International Political Studies (ISPI) and Belgrade Centre for Security Policy. In some of the countries of the Western Balkans, criminal groups and political elites have grown increasingly interdependent. In particular, Serbia’s and Montenegro’s societies have suffered the most from these links. The two countries have long been considered frontrunners in the EU integration process, whose final completion, however, is difficult to foresee. Similarly, Albania’s EU negotiating process has also been delayed for years, in part because of the country’s role in global drug trafficking schemes. The crime-politics nexus is contributing to the erosion of the rule of law in several Balkan countries, where the risk – or reality – of state capture is increasingly worrisome. In light of recent events, Serbia appears to be the most concerning case as its authoritarian drift currently seems hard to reverse. Which consequences does the situation in Serbia have on other Balkan countries? What impact does state capture have on regional stability? Abstract:
This CEPS Policy Insight takes a lively rhetorical approach to showing how state capture in the Western Balkans has been ignored since the launch of the region’s EU accession process, despite the many examples highlighted by civil society and independent media. It argues that while the EU first acknowledged the clear signs of state capture in an official document in 2016, Western Balkan political elites had already built powerful networks of corrupt interests around them. Not only that, they had already reached the highest point of state capture – tailor-made laws.
