461. After the Failed Military Coup: The Need for the Organizational Reform in the Turkish Military

Abstract:
The failed military coup of July 15, 2016, led by the Fethullah Terrorist Organization (FETO), indicates that military reform in Turkey at the operational level needs to be re-considered as an extremely urgent issue. The Justice and Development Party (AK Party) governments have made very notable structural changes in the military and have tried to control the military politically and organizationally. The need for military reform in Turkey derives from two primary reasons: the tendency of coup action and the need to improve the military’s effectiveness. This article highlights the importance of reforms actualized at the strategic level during the Justice and Development Party era. It also points out the need for organizational reform in the military; reform which should be done by the civilian government in order to cope with challenges.

462. Five Takeaways on the Future of Humanitarian Reform

Abstract:
The world’s humanitarian aid architecture is growing outdated. Relief programs are most effective when they are integrated, locally owned, and demand driven. But humanitarian action in the 21st century remains constrained by a 20th-century aid model: siloed, supply driven, and centered on the individual mandates and sectors of major international aid agencies. This makes aid both less effective and less responsive than it could be. In a world where displacement is at the highest levels in generations, climate disasters are increasing, and humanitarian funding is beginning to level off, this disconnect is no longer tenable. But fixing it is not a simple matter—multiple rounds of humanitarian reform over the past 15 years have made progress but fallen short of fundamental change. Earlier this summer in Geneva, CGD convened two high-level private roundtables, one with leaders from humanitarian donor institutions and another with senior executives from major humanitarian aid agencies (both multilaterals and NGOs), to discuss how to make humanitarian aid more cohesive and user-centered. The meetings were part of a multiyear research initiative exploring how modernizing the humanitarian business model and humanitarian governance are integral to improving field-level humanitarian impact. CGD teed up the conversation with three emerging ideas from our research (you can see the presentation slides here). These ideas—the subjects of several forthcoming papers CGD is developing —explore ways of better aligning aid delivery around enhanced impact toward affected people’s priorities

463. The State and Local Self-Government. Territorial Organization of the State

Abstract:
Local self-government constitutes a part of executive power in the state, with the state’s law underlying its functioning. Local government remains under the state’s supervision, representing a form of the political system within the decentralized public administration. 2018 marks 20 years of the functioning of local self-government based on a three-tier structure. The aim of the paper is an attempt at finding the answer to the question whether or not the organizational solutions adopted by the legislator and established in practice need to undergo reforms and if so, to what extent? The question thus formulated relates directly to the argument that the organization of local government system is not sound while the criteria assumed in the territorial breakdown of the local government organization do not correspond to the conditions in which those units operate, and therefore what appears necessary is for the system to be reorganized and the number of units at individual tiers to be reduced. The paper presents selected problems of the local administration in the context of a systemic organization and suggest possible (or necessary) changes which, in the author’s view, should become a subject of discussion (and in practice are such) between local selfgovernment and government administration.

464. Wrocław Civic Budget. Social Innovation Adapted in Polish Local Government

Abstract:
The paper explores Wrocław Civic Budget in the context of procedures and impact. It reviews various data to present different aspects of this process: number of projects submitted and implemented, citizens’ participation in the selection process, geographical distribution of the implemented projects and their contents, showing the significant fall in the citizens’ interest in the process after two years of its implementation. The paper aims to analyze whether the project in its current form actually succeeds in activating the citizens’ and involving them in the local decision-making on one hand, and changing the city on the other. The effectiveness of participatory budgeting in Wrocław is explored, considering such criteria as reliability, impact, activation and innovativeness. The data reveal both the successes and drawbacks of Wrocław Civic Budget, allowing for presentation of recommendations.

465. The CCP’s Renewed Focus on Ideological Conditioning, Part 2: The New Five-Year Plan for Training Party Cadres

Abstract:
The leadership of the Chinese Communist Party (CCP) has long pointed to the collapse of the Soviet Union as a cautionary example, and party organs have produced books and films that warn of the dire consequences that would follow from any steps to loosen the CCP’s grip on the economy, public discourse, or political power. These materials have been made the focus of mandatory study under CCP General Secretary Xi Jinping (SCMP, November 18, 2013). Alongside alleged villains such as the reformist Mikhail Gorbachev, ideological laxity among Soviet Communist Party members has been identified as a key factor in the downfall of the Soviet state. [1] To address this, the CCP leadership has undertaken concerted efforts throughout 2019 to bolster ideological indoctrination among its own membership. Party members have been made subject to mandatory use of the smartphone app Xuexi Qiangguo (学习强国), which was introduced in January of this year. [2] Users are required to meet quotas of “study points” for spending time on the app, reading and commenting on articles, and taking tests about party policies (SCMP, February 14, 2019). In addition to serving as a channel for ideological indoctrination, the app also serves as a surveillance tool: it both “collects and sends detailed app log reports on a daily basis, containing a wealth of user data and app activity,” and contains “code that amounts to a backdoor to rooted devices… granting complete administrator-level access to a user’s phone” (Open Technology Fund, September 12). The CCP’s current official ideology is “Xi Jinping Thought on Socialism with Chinese Characteristics in the New Era” (习近平新时代中国特色社会主义思想, Xi Jinping Xin Shidai Zhongguo Tese Shehui Zhuyi Sixiang). This ideological program is grounded in Xi’s ever-growing cult of personality, and relies heavily on the dogmatic repetition of slogans rather than clearly articulated ideas. In broad terms, it strikes three general themes: (1) achieving the “China Dream” (中国梦, Zhongguo Meng) of restored national greatness; (2) unyielding CCP control over politics and Chinese society; and (3) continuing reforms in party-state institutions and governance. The latter element is often expressed in terms of greater centralization of power at the top echelons of the CCP, and demands for stricter personal loyalty to Xi Jinping (China Brief, November 19). 467. Dual Practice of Public Hospital Physicians in Vietnam

Abstract:
Although many public hospital physicians in Vietnam offer private service on the side, little is known about the magnitude and nature of the phenomenon of so-called dual practice, let alone the dynamics between the public and private health sectors. This study investigates how and to what degree public hospital physicians engage in private practice. It also examines the commitment of dual practitioners to the public sector. The analysis is based on a hospital-based survey of 483 physicians at 10 public hospitals in four provinces of Vietnam. Nearly half of the participants in the study sample reported themselves as dual practitioners. Various types of private practice were mentioned. Private practice at health facilities owned by the private sector was the most prevalent, followed by private practice delivered at health facilities owned by the dual practitioners themselves. Private practice inside public hospitals was also noted. Dual practitioners were likely to be senior and hold management positions inside their public hospitals. Substantial income differences were found between dual practitioners and those physicians practicing in only the public sector. The majority of dual practitioners, however, reported the willingness to give up private practice if certain conditions were met, such as a basic salary increase or non-pecuniary benefits. The main reasons dual practitioners gave for not leaving the public sector included a sense of public responsibility and opportunities to gain a broader professional network and more training. This study reiterates the significant challenges associated with dual practice, including its financial implications and possible effects on health care quality and access. The need for a high-quality workforce committed to the public sector is particularly critical, given the possibility of universal insurance coverage. Future research should address the need to improve data collection on physicians’ dual practice and incorporate the topic in policy debates on health reform.

468. Set the Torturers Free: Transitional Justice and Peace vs Justice Dilemma in Burma/Myanmar

Abstract:
Burma/Myanmar seems to be a perfect ground for transitional justice with both long-failed transitions to democracy that seemed to succeed in 2015 finally and smouldering civil war taking place there since 1948 (since the 1990s limited to Borderlands). Unfortu- nately, the political realities in Burma/Myanmar make it unlikely, if not impossible, for tran- sitional justice to be applicable in Burma/Myanmar. The victorious in 2015 elections demo- cratic opposition party, National League for Democracy (NLD) came to power thanks to the political deal with the former military government and is consequently being forced to co- habitate politically with the army that still holds critical political checks over the government. It made NLD’s leader, Aung San Suu Kyi to conduct moderate domestic policy without trying to charge the generals for their former crimes. In this circumstances, transitional justice is unwanted by mainstream political actors (NLD, the army) and seen as threatening to peace by many in the Myanmar society. This approach firmly places Burma/Myanmar on one side of the ‘peace vs justice’ dilemma. It answers the “torturer problem”, one of the central problems of transitional justice – how to deal with members of the previous regime which violated human rights – in ‘old fashion’ way, by granting them full amnesty. As such Burma/Myanmar case also falsifies an optimistic claim that transitional justice is necessary for political reforms.

469. The Impact of the European Court of Human Rights on Justice Sector Reform in the Republic of Moldova

Abstract:
For this study, I reviewed the judgments of the European Court of Human Rights against the Republic of Moldova and the corresponding reports of the Committee of Ministers from 1997 through 2014. In addition, I interviewed more than 25 lawyers, judges, and human rights advocates. After analyzing the effectiveness of the Court in terms of compliance with the judgments in specific cases (individual measures), I will assess the broader impact of these decisions (general measures) on legal reforms and public policy in the Republic of Moldova. I will evaluate the effectiveness of the decisions of the ECtHR in the context of the implementation of Moldova’s Justice Sector Reform Strategy (2011-2015), the Council of Europe’s Action Plan to Support Democratic Reforms in the Republic of Moldova (2013-2016), and Moldova’s National Human Rights Action Plan (2011-2014). My findings will offer insights into the constraints faced by the ECtHR in implementing its decisions and the impact of the ECtHR on national legal systems.

470. The European Union as a Reforming Power in the Western Balkans: The Case of Albania

Abstract:
This paper tries to further elaborate one of the most important external powers of the European Union: Its “reforming power” which goes in parallel with its ability as “normative actor” in the Western Balkans. Through Albania as a case study, it tries to argue that the process of Albania’s integration to the EU has transformed the country in several directions: by introducing a deep juridical reform and by the full alignment of its foreign policy with CFSP and the “regional cooperation”. In fact, under the auspices of the EU integration, the country is making all the efforts to deliver on one of the most transformative reforms undertaken in the region, that of the justice system. This gives to EU the features of a “reforming power”. The term shows the EU as a driving force which makes countries undertake deep reforms they would not have differently realized, if not under the conditionality for the EU integration.
