Abstract:
On May 12, 2016, the United Nations (UN) Special Rapporteur on the rights of indigenous peoples, Victoria Tauli-Corpuz, and the Columbia Center on Sustainable Investment hosted a one-day workshop on international investment and the rights of indigenous peoples. This outcome document synthesizes the discussions that took place during the May 12 workshop. The workshop was part of a series of consultations undertaken to support the Special Rapporteur’s second thematic analysis on the impact of international investment agreements on the rights of indigenous peoples (available here). Held at the Ford Foundation in New York, the workshop brought together 53 academics, practitioners, indigenous representatives, and civil society representatives to explore strategies for strengthening the rights and interests of indigenous peoples in the context of international investment. The workshop provided an opportunity for participants to share their diverse perspectives, experiences, and insights regarding the intersection of international investment and human rights, and to discuss creative and pragmatic approaches to short and long-term reform of both the investment and human rights regimes, with the ultimate goal of ensuring that indigenous rights are respected, protected, and fulfilled.

32. In Defence of Freedom of Speech and against the Publication of Certain Cartoons

Abstract:
This paper explores the concept of freedom of speech, as it relates to religion, focusing on recent European examples of tensions that surface secular mores and Islamic sensibilities, primarily the Charlie Hebdo incident. This paper argues that while offence to others does not breech free speech, when considering cartoons of the Prophet Muhammad, we cannot ignore the geopolitical context. Such images may perpetuate stereotypes and be perceived as part of a neo-colonial project to denigrate minorities and the Muslim world. In particular, Islamophobia and the post-colonial context provide a context wherein the Islamic “Other” within Western societies is marginalised and often experiences oppression. Therefore, what appears to be legitimate freedom of speech may actually be a discourse of suppression. The paper also considers possible objections around individual autonomy and the power of religion, and suggests principles when considering the limits of freedom of speech.

Abstract:
Since the nineteenth century, North Africa’s religious life has witnessed a slow and uncertain metamorphosis. It is still unable to settle into a constant and sustainable model. The traditional order could not resist the emergence of the nation-state, modern education and new forms of social organisation. However, religion has remained on the margins of these developments. Although used in the anticolonial struggle, religion was then abandoned during the formation of the postcolonial state. Yet the difficulties faced by governments since the 1970s have entrusted religion with a predominantly opposition function, which is negative and sometimes violent. This paper argues that only neo-reformism can give a positive spin to religion’s role in politics and can serve as the basis for a new religious order.

Religion was a pillar of pre-modern political identity in the Middle East, arising out of Muslims’ understanding of Islam’s foundational moment and state institutions that developed with the spread of Islamic Empire. Beginning at the turn of the 19th century, European colonial powers and indigenous reformers questioned the centrality of religious identity; instead, it was to be the nation that defined the political community. Since then, the nationalist project has permeated 20th century ideological conflicts in the region, equally shaping the claims of secularists and Islamists. Today, advocates of religious change refer back to early Islamic history as they seek to place religious over national identity, yet they, like their competitors, are unmistakably shaped by the secular nationalist project.

The term “post-colonial” has presented a seminal problem for historians of the 20th century Middle East. As this essay will detail, debates over the term have provided an important axis around which discussions of political identity revolve. Following World War Two European power in the Middle East crumbled and a number of post-colonial states emerged. These states often justified their existence in terms of ideologies that were tied to specific post-colonial, political identities. Endless debates have occurred over how much emphasis to put on the post-colonial nature of these states and their political identities. In this essay, I will discuss whether a state’s status as post-colonial matters. If so, how? And what are the consequences? Following a general discussion of debates over post-colonialism, will look more closely at three case studies: Egypt, Iraq, and Iran.

This article approaches two International Court of Justice judgments on the cases concerning Ligitan/Sipadan (2002) and Pedra Branca (2008) from the perspective of the law of territory in the post-colonial context, showing that the Court managed to free the concepts of ‘original title’ from ‘terra nullius’. It is prefatorily explained that the concepts of ‘original title’ and ‘terra nullius’, which operate in combination, had both functioned as bases for the traditional law of territory and as unilateral justification for colonization by European powers. By contrast, analysis of the two recent judgments illustrates that the Court contrived to separate the two concepts from the context of colonialism by avoiding the determination of the islands as ‘terra nullius’ and expanding the concept of ‘original title’ while preserving the existing framework of law of territory. The problem is presented with a caveat, however; overemphasizing the significance of ‘original title’ in the post-colonial context might lead to disregard for the foundations of title to territory, that is effective control of territory and its legitimizing logic, on which the territorial order of today’s international society is based.

Abstract:
The volume under review publishes the proceedings of a colloquium held at the University of Paris in July 2010. The aim of this colloquium was to fill a lacuna that characterizes the contemporary francophone international legal scholarship. Indeed, as noted by the editors in their foreword to the book, after a prolific period during the 1970s and 1980s, French and francophone scholars have gradually lost interest in Third World-related issues and ignored this topic in their research and teachings. This trend is regrettable and unfortunate because despite some progress and improvements, international relations are still marked by significant inequalities and disparities between rich and poor countries, while several regions of the world remain in a situation of extreme poverty. Therefore, there is an urgent need to renew and revive the reflection of French-speaking international lawyers on their discipline by inciting them to critically question the present existence and effects of the rules of international law relating to the Third World in the current globalized context. To achieve this goal, Mark Toufayan, Emmanuelle TourmeJouannet and Hélène Ruiz Fabri had the idea of bringing together, in Paris, francophone and anglophone scholars and prominent representatives of the critical Third World Approaches to International Law (TWAIL). TWAIL scholars were invited to expose their ideas and thoughts, and their French-speaking counterparts were asked to react and comment on these thoughts.

Abstract:
In the aftermath of the 2003 U.S.-led invasion of Iraq, scholars of international relations debated how to best characterize the rising tide of global opposition. The concept of “soft balancing” emerged as an influential, though contested, explanation of a new phenomenon in a unipolar world: states seeking to constrain the ability of the United States to deploy military force by using multinational organizations, international law, and coalition building. Soft balancing can also be observed in regional unipolar systems. Multinational archival research reveals how Argentina, Mexico, and other Latin American countries responded to expanding U.S. power and military assertiveness in the early twentieth century through coordinated diplomatic maneuvering that provides a strong example of soft balancing. Examination of this earlier case makes an empirical contribution to the emerging soft-balancing literature and suggests that soft balancing need not lead to hard balancing or open conflict.

Un an après l'intervention française, l'intégrité territoriale et l'ordre constitutionnel ont été rétablis au Mali. Mais la persistance des tensions intercommunautaires et de violences localisées témoigne d'une stabilisation encore précaire du Nord, alors que les forces françaises et onusiennes peinent à consolider leurs progrès en matière de sécurité. Les attentes à l'égard du président Ibrahim Boubacar Keïta sont immenses. Il doit à la fois élaborer un compromis sur le devenir du Nord et engager la réforme d'un Etat affaibli par la crise. Son gouvernement doit aller au-delà des déclarations d'intention et passer à l'action. Pour consolider la situation à court terme, il est tenté de renouer avec un système clientéliste qui a conduit les précédents régimes dans l'impasse. Le président ne peut certes pas tout réformer brusquement mais l'urgence de la stabilisation ne doit ni faire manquer l'occasion d'entamer une réforme profonde de la gouvernance ni occulter la nécessité d'un dialogue véritablement inclusif sur l'avenir du pays.
