1. Lessons from the Nuclear Waste Negotiator Era of the 1990s for Today’s Consent-Based Siting Efforts

Abstract:
Nuclear power is being weighed in energy transition plans around the world, as countries seek to replace fossil fuels with low-carbon alternatives while also meeting growing energy demand and maintaining reliability and affordability. When considering extension of existing nuclear reactor licenses as well as approving new ones, there is an ethical obligation for today’s users to develop plans for long-term management of the resulting nuclear waste and not defer its disposition to future generations. In the United States, the federal government is contractually obligated to take ownership of the spent nuclear fuel (SNF) produced at power plants, but this has not happened. The one deep geologic repository project named in law by Congress for potential disposal of SNF—Yucca Mountain in Nevada—has reached a stalemate, with Congress appropriating no money to move the project forward since 2010 due to Nevada’s opposition. Negotiations with US states and tribes to host storage and disposal facilities have been sensitive in the past due to both a stigma around nuclear waste and a perception of risk associated with such facilities. A federal “nuclear waste negotiator” role existed in the early 1990s to overcome these difficulties and find a state or tribe willing to host a repository or interim storage facility, though this short-lived, volunteer-based program did not lead to deployment of either. This report, part of a series of publications on nuclear waste policy at the Center on Global Energy Policy at Columbia University SIPA, reveals lessons learned from the experiences of the two prior negotiators that could benefit a recent, congressionally directed effort at the Department of Energy (DOE) to begin a “consent-based” siting program for nuclear waste. Those individuals were authorized to negotiate terms and conditions—including financial and institutional arrangements—with a state or tribe in a written agreement that would then have to be approved by Congress. Importantly, a state or tribe was assured it could explore the potential of hosting a site while retaining the right to withdraw at any time, and if it did proceed, would have a measure of power in setting terms for the project.

2. Revisiting GTCC and GTCC-Like Nuclear Waste Disposal in the United States

While the United States (US) has facilities that can and do dispose of most low-level nuclear waste (LLW), it does not yet have a viable disposal pathway for two categories of waste: so-called greater-than-class-c (GTCC) nuclear waste, and nuclear waste with characteristics similar to it, or “GTCC-like.” These two categories essentially straddle the United States’ LLW inventory, for which disposal facilities are in operation, and high-level nuclear waste (HLW) inventory, for which no disposal capability exists. GTCC nuclear waste is produced by multiple sources: commercial nuclear power plants, medical procedures, industrial and research activities, and Department of Energy (DOE) missions, including those related to national security and the cleanup of legacy facilities. These activities carry with them an ethical responsibility to dispose of the nuclear waste they generate rather than pass it on to the next generation. Security task forces have also identified the lack of a disposal pathway for sealed sources of GTCC nuclear waste as a concern, given the potential for its theft and use in a dispersal device. This report, part of a series of publications on nuclear waste policy at the Center on Global Energy Policy, Columbia University SIPA, explores the history of DOE, Nuclear Regulatory Commission (NRC), and state efforts to develop disposal capabilities for GTCC and GTCC-like inventories. It explains why this gap merits greater attention from policymakers now and identifies measures Congress, the DOE, and the NRC could take, should they decide to address it. US government efforts to develop disposal capabilities for GTCC waste date back to 1985 when Congress made it a federal responsibility. For a time, disposal in the planned repository at Yucca Mountain, Nevada, was contemplated. But in the absence of appropriations to move that project forward since 2010, the federal government recently issued planning documents that identify generic commercial LLW disposal facilities and the Waste Isolation Pilot Plant (WIPP) deep geologic repository in New Mexico as preferred alternatives. Of the commercial LLW disposal facilities in operation, only the WCS facility in Texas has expressed interest in the GTCC disposal mission. The political climate for GTCC disposal in both New Mexico and Texas has darkened in recent years, though, casting doubt on the federal government’s plans. If the US government decides to prioritize the goal of establishing disposal capability for GTCC and GTCC-like nuclear waste, Congress, the DOE, and the NRC could take the following steps to help realize it in the near term.

Abstract:
In the 117th Congress, the United States Senate is evenly divided, 50-50, between the two major political parties, and the margin for control of the US House is small. One nonpartisan—and overdue—policy issue that Congress and the executive branch could focus on is the US nuclear waste management program. The US is currently paying billions to utilities to house spent nuclear fuel (SNF) at operating and shutdown facilities, and high-level waste (HLW) remains at former nuclear weapons complex sites around the country. Add to this the potential for greater future reliance on nuclear power in a decarbonizing economy, and the need to finally get a handle on managing radioactive waste is clear. An earlier report from the Center on Global Energy Policy on the US nuclear waste management program examined larger structural changes that the federal government could pursue to help the program make progress, such as fixing the funding mechanism and updating regulatory standards.[1] This commentary discusses the US program as it stands in the 117th Congress and proposes a series of comparatively smaller actions that could be considered and perhaps pursued on a bipartisan basis in the next few years.

4. Deep Borehole Disposal of Radioactive Waste: Next Steps and Applicability to National Programs

Abstract:
Deep borehole disposal of high-level radioactive waste has been proposed repeatedly and in multiple countries over the last several decades, but the concept remains unproven in the field. A straightforward research, development, and demonstration test program could provide answers to basic questions about the viability of the concept. This program would involve the construction of two or perhaps more boreholes to test disposal concepts using surrogate, nonradioactive waste. Field tests would focus on the engineering and operational feasibility of deep borehole disposal, the availability of favorable rock types at depth, appropriate designs for waste forms and waste packaging, and the long-term performance of borehole repositories. Because of the scale of the project, it might best be undertaken as an international collaboration, perhaps led by the US Department of Energy but with participation from multiple national programs to ensure it meets a wide range of needs. Mined geologic repositories, which have been the preferred approach for permanent disposal of high-level radioactive wastes for most national programs for many decades, will likely remain the preferred disposal option for countries with large inventories of commercial spent nuclear fuel. If deep borehole disposal can be demonstrated as a viable concept, however, it may be an attractive alternative disposal option for countries with small inventories of materials requiring permanent geologic isolation. For example, national programs with limited amounts of waste from research or medical isotope production reactors may not need to incur the cost of a full-scale mined repository. Other countries may find borehole disposal a useful option for permanently disposing of small quantities of waste that could otherwise pose security risks, including both fissile materials and high-activity sealed radioactive sources used in industrial and medical applications. For programs committed to disposing of large inventories of spent nuclear fuel and high-level waste in mined repositories, deep boreholes may provide options for prompt disposal of small volumes of specialty wastes that may otherwise have to wait for repository construction. This report reviews the borehole disposal concepts proposed to date, identifies potentially suitable waste forms worldwide, and proposes a field-testing program that could resolve many remaining technical questions and inform future programmatic decisions. The report also summarizes the potential benefits of borehole disposal in terms of public acceptance, cost, and security.

5. Forging a Path Forward on US Nuclear Waste Management: Options for Policy Makers

Nuclear power is considered in many countries a critical facet to maintaining reliable access to electricity during a global transition to low-carbon energy sources. One challenge to its potential in the United States, however, is the current standstill regarding a disposal pathway for spent nuclear fuel (SNF) from commercial reactors. This impasse has a negative bearing on nuclear energy’s ability to supply more zero-carbon electricity and may cost US taxpayers tens of billions of dollars in government liability for failing to meet contractual obligations to take possession of the waste from utilities. Despite the scientific community assessing that commercial SNF and other high-level radioactive waste (HLW), such as from defense activities, can be safely isolated in deep underground repositories, US efforts to license and operate one have flatlined. The original plan for siting at least two repositories for such waste was abandoned first by DOE and then by Congress. Yucca Mountain in Nevada was designated in law as the nation’s sole potential disposal site by Congress in 1987, fomenting the state’s opposition to the project. As a result of that opposition, Congress has not funded the project since 2010. Still, progress has been made over the last few decades in nuclear waste disposal programs in countries such as Finland, Sweden, and Canada. And the United States has seen the successful opening and operation of the Waste Isolation Pilot Plant in New Mexico to dispose of generally less radioactive but long-lived transuranic nuclear waste from defense activities. Such programs offer insights for how the United States can try to resolve the challenges with commercial nuclear waste disposal and potentially alleviate one obstacle to wider adoption of nuclear energy to decarbonize the US economy. This report, part of wider work on nuclear energy at Columbia University’s Center on Global Energy Policy, explains how the United States reached its current stalemate over nuclear waste disposal. It then examines productive approaches in other countries and a few domestic ones that could guide US policy makers through options for improving the prospects of SNF and HLW disposal going forward

THe RAPID DeVeLOPMeNT of the nuclear industry in the 20th cen- tury, the widespread use of radioactive isotopes in medicine and in mili- tary programs, the usage of nuclear submarines, as well as the operation of radiochemical plants, factories, nuclear power plants, and scientific research centers all around the world are accompanied by a constant accu- mulation of radioactive waste (RW) and spent nuclear fuel (SF). Mishandling of RW and SF could possibly inflict significant damage on the whole planet, not merely a single nation. Thus, the question of plac- ing RW and SF in storage is the main component of an environmental issue shared by the whole planet due to the use of nuclear energy. Disposal of RW is a touchy issue for any nation that has a nuclear industry. Handling RW and SF – i.e., obtaining them, ensuring safe and final safe isolation (disposal), transportation, warehousing, and storage – all require specific legal regulation and control, on the part of both the state and the international community via international organizations. What is most crucial are the actions of specific individuals, companies, transnational corporations (TNCs), state corporations and state entities, and international organizations (eURATOM, IAeA, UN, CIS), as well as laws and juridical acts on the national level and international treaties.

7. Nuclear Enrichment: Russia’s Ill-Fated Influence Campaign in South Africa

Amid the widespread attention the Kremlin’s recent inroads in Africa have attracted, there has been surprisingly little discussion of South Africa, a country which, for nearly a decade, unquestionably represented Russia’s biggest foreign policy success story on the continent. As relations soared during the ill-starred presidency of Jacob Zuma (2009–2018), the Kremlin sought to wrest a geopolitically significant state out of the West’s orbit and to create a partnership that could serve as a springboard for expanded influence elsewhere in Africa. Moscow’s strategy was multifaceted, capitalizing on well-established close ties with Zuma, a former African National Congress senior intelligence official with extensive Soviet bloc connections. Russian President Vladimir Putin and other senior officials pursued a series of initiatives, such as the inclusion of South Africa in the BRIC (Brazil, Russia, India, and China) grouping and the launch of ambitious forms of cooperation between state-backed energy interests primarily in the nuclear sector. Yet relations were undermined by the Kremlin’s propensity to overreach, to lean too heavily on the legacy of Cold War–era relationships forged with leaders of national liberation movements, and to take advantage of cultures of corruption. The controversy arising from a massive $76 billion nuclear power plant construction deal triggered strong pushback and legal challenges from South Africa’s institutional checks and balances, civil society groups, and independent media. Key parts of the Russian national security establishment view civil nuclear power exports as an important tool for projecting influence overseas while creating revenue streams for sustaining intellectual and technical capabilities and vital programs inside Russia itself. Yet such cooperation is often a two-edged sword. On the one hand, costly projects such as the one pushed by Zuma typically make little economic sense for the purchasing country, spurring uncomfortable questions about who stands to benefit. On the other hand, heavily subsidized projects pursued mainly for geopolitical reasons risk saddling Russia’s nuclear power monopoly Rosatom with burdens it can ill afford. Ongoing investigations of high-level corruption during the period of so-called state capture under Zuma shed remarkable light on how the Kremlin operates in Africa and other parts of the world. In retrospect, the sustainability of Moscow’s embrace of South Africa was highly questionable due to its paltry tool kit. Russian involvement in the South African economy is miniscule compared to that of other trading partners such as the EU, China, the United States, India, and the UK, accounting for a mere 0.4 percent of South Africa’s foreign trade. While the Soviet Union was an important patron during the anti-apartheid struggle, modern-day Russia offers little in the way of practical assistance for helping South Africa deal with its deep-set economic and societal challenges.

8. RESET OF AMERICA’S NUCLEAR WASTE MANAGEMENT

Abstract:
The U.S. government has worked for decades and spent tens of billions of dollars in search of a permanent resting place for the Nation’s nuclear waste. Some 80,000 tons of highly radioactive spent fuel from commercial nuclear power plants and millions of gallons of high-level nuclear waste from defense programs are stored in pools, dry casks and large tanks throughout the country at more than 75 sites in 39 states. A Stanford-led study recommends that the United States “reset” its nuclear waste program by moving responsibility for commercially generated, used nuclear fuel away from the federal government and into the hands of an independent, not-for-profit, utility-owned and funded nuclear waste management organization. The three year study led by Rod Ewing in the Center for International Security and Cooperation has made a series of recommendations focused on the back-end of the nuclear fuel cycle.

9. The Secrets of Containment: Making the Invisible Visible

Abstract:
Peter Galison, the Joseph Pellegrino University Professor at Harvard University, is fascinated by the “concrete visuals behind what might appear to be pure abstraction.” His new film Containment is about nuclear waste and its safekeeping for now and the next 10,000 years. The film is co-directed with Robb Moss, Harvard College Professor and chair of the Department of Visual and Environmental Studies, a friend with whom Galison also produced the documentary Secrecy, which premiered at the Sundance Film Festival in 2008. A historian of science and a physicist, Galison, the recipient of a MacArthur Foundation “Genius Grant,” is known for his keen investigations into the outer edge of physics and scientific experimentation. He spoke with the Weatherhead Center for International Affairs, where he is a Faculty Associate, about the recurring concepts that drive his curiosity and the thought process that led to Containment.
