241. Purveyors of Terror: Counterterrorism in Africa's Failing States

Abstract:
Weak and failing states in Africa continue to offer challenging environments for counterterrorism campaigns in both a military and a civil law enforcement context. Weakly governed and ungoverned spaces in these states offer venues that violent extremist groups continue to exploit as platforms for terrorism. These groups – Al-Qaeda in the Islamic Maghreb (AQIM) and Al-Shabaab in Somalia are simply two of the more prominent examples – use these weakly governed and ungoverned spaces to recruit new followers, build capability and capacity, and launch new terrorist attacks while avoiding the scrutiny and attention of African security sectors and their international partners. A defining feature of these weakly governed and ungoverned spaces in Africa is the predominance of non-state security actors, including local militias, neighborhood watch organizations, traditional hunting societies, and traditional, customary, or religious justice processes that operate outside of the formal court system. Some of these non-state actors themselves represent violent extremist groups involved in acts of terror. Others play central roles in the mediation of disputes (administration of justice), delivery of police services, or as military surrogates in providing for local defense. I argued in Counterterrorism in African Failed States that collaboration between U.S. military forces and law enforcement agencies is essential to effective counterterrorism interventions in African failed states.[i] Subsequent counterterrorism operations in the region have confirmed that argument, and African senior police and militaryleaders increasingly emphasize the importance of collaboration between military and police forces.[ii] In addition to military forces and law enforcement services, counterterrorism in Africa must effectively address the need for effective partners in the justice sector – prosecutors (and defense counsels), courts, prisons and corrections – in implementing counterterrorism strategies. All three components of counterterrorism strategies must confront the reality that weakly governed and ungoverned spaces are ground zero for counterterrorism on the continent, and that non-state security actors are a defining feature of those spaces. To address the purveyors of terror – in most cases, non-state security actors like Al-Shabaab in Somalia or AQIM in the Sahel – counterterrorism strategies in ungoverned and weakly governed spaces in Africa must address all of the non-state security actors that proliferate in those areas.

242. Fear and Loathing in Mexico Narco-Alliances and Proxy Wars

Abstract:
In December 2012, Enrique Peña Nieto took the helm of Mexico’s Presidency after running on an electoral agenda in which he distanced himself from the Calderón Administration’s (2006-2012) security policies against organized crime. These policies have received substantive criticism over the past years for leading to a direct increase in violence in the country. The total number of homicides for the Calderón Presidency doubled, reaching approximately 120,000, over those recorded during the previous administration of Vicente Fox Quesada (2001-2006). The number of organized crime style executions – over 60,000 – associated with Felipe Calderón’s war on drugs significantly surpassed the threshold of 1,000 battle-related deaths within a twelve months period – the definition of war according to the Correlates of War Project. The levels of violence in this internal conflict have been comparable to those in war zones such as Iraq and Afghanistan. Additionally, Calderón’s war against the drug cartels had another unintended effect. It transformed Mexico into the most dangerous country for journalists in the Western Hemisphere – and the eighth worldwide – with 67 journalists murdered and 14 disappeared since 2006. Last but not least, for three consecutive years (2008, 2009, and 2010) Ciudad Juarez, the second largest metropolitan area on the border with the U.S., registered the highest rate of homicides worldwide, earning the nickname “Murder City.” ​ Today, more than one year into the new Peña Nieto Presidency, violence in Mexico has not significantly subsided, and the country has witnessed an increase in kidnappings, forced disappearances, and extortion. Despite the promises made on the campaign trail, the 18-month old Peña Nieto Administration still has not been able to carry out the security measures that it intended, such as creation of a new security force under the guise of a national gendarmerie. On the contrary, its security policies have de facto remained the same as those of the previous administration. Equally, they have contributed to the festering of the narco-violence problem that the country has been facing over the past seven years, and that has resulted in the rise of the self-defense forces across the country, particularly in rural areas and the state of Michoacán.

Abstract:
The Islamic State (IS) movement needs to be understood as a political project whose primary objective is to establish a viable entity in areas it can control rather than engage in permanent insurgency against more powerful adversaries. The conditions for its emergence were created by the U.S. occupation of Iraq, the dissolution of the Iraqi state and its replacement with a sectarian political system and conflict, and the collapse of state authority in regions of Syria. The available evidence indicates that the IS is at best uninterested in achieving the conventional forms of legitimacy and integration pursued by other Islamist movements; engagement is therefore unlikely to prove a viable option. There are no quick or simple solutions to the challenges posed by the IS. Those being considered, particularly Western military intervention, are almost guaranteed to make a catastrophic situation worse, while a strategy that relies on disaffected Sunni tribes and sectarian Shiite militias is unlikely to succeed. A comprehensive approach is needed involving a re-evaluation of policy towards the Syrian crisis, engagement with regional parties on a much broader spectrum of relevant issues, and a focus on establishing legitimate institutions that are able to address deep-seated grievances and resolve the conflicts that allow movements like IS to thrive.

Abstract:
The U.S. commitment to "ultimately destroy" the Islamic State implies an extended military commitment in a highly complex Middle East environment. By looking at the strategic issues that emerge from this dynamic, we can hope better to understand impending developments. These issues centre on the motive behind the U.S. decision to enter the conflict; the U.S. relationship with its European and regional partners and, by contrast, with other major actors in the region like Iran, Syria, Turkey and Egypt; the options for the Islamic State’s response; and issues of U.S. strategy and grand strategy regarding the Islamic world.

245. Sealing a Colombian peace deal: challenges of citizen ratification

Abstract:
While a peace agreement between the Revolutionary Armed Forces of Colombia (FARC) and the Colombian government seems to be within reach, a number of substantial and procedural issues might still cause controversies. One such topic is the question of how a potential peace agreement should be ratified. Both parties have made clear that ratification should involve direct citizen participation. The FARC’s proposal for a broadly mandated Constituent Assembly is effectively not politically viable. Other constitutional options have practical, political and legal implications. A final formula will need to deal with the armed group’s concern for the legal security of its members while rapidly generating a political mandate to proceed with implementation. The inevitable time lag between signature and ratification will most certainly become a political liability because the FARC is likely to refuse to lay down its weapons in this period. With low levels of trust between the parties and a society deeply sceptical of the guerrilla’s intentions to abandon the armed struggle, all sides will feel the need to be protected against risks of non-compliance. The greatest risk related to citizen ratification remains non-approval, because large parts of the population continue to be sensitive – if not opposed – to the idea of granting wide-ranging concessions to the FARC. Mobilising a strong political and social majority behind the peace process and a potential deal is a priority if a final agreement is to survive popular scrutiny and become a foundation for lasting peace.

Abstract:
This paper examines factors that determine citizens’ tax-compliance attitude in Kenya, Tanzania, Uganda and South Africa. Using the 2011/12 Afrobarometer survey data, we find that tax-compliance attitude is positively correlated with the provision of public services in the four countries. However, the correlation depends on the specific service in question and differs between countries. Tax knowledge and awareness are found to be positively correlated with tax-compliance attitude. On the other hand, frequent payment to non-state actors in exchange for security and individual’s perception that their own ethnic group is treated unfairly by the government are negatively correlated with tax-compliance attitude.

247. On the Social Conditions of Governance: Social Capital and Governance in Areas of Limited Statehood

Abstract:
Unlike what Hobbesian theories argue, the provision of governance is not necessarily undermined by a lack of statehood. Empirical findings show that – contrary to many voices in current debates on weak, failing, or failed states – various (non-state) actors provide governance even when statehood is limited. This paper addresses the puzzle of how to account for cases where governance exists although the state cannot or does not provide it. Transferring insights from political sociology to the analysis of such “gov- ernance without the state,” the paper holds that the way societies manage their affairs critically depends on social conditions, which are captured here following social capital theory. Working toward a political sociology of “governance without a state,” this paper links social capital, resulting in interpersonal trust, to social coordination underlying the provision of governance. In this context, governance is interpreted as a collective action game (“governance game”), in which socially embedded (collective) actors are seen as players whose behavior (in particular their decisions to cooperate) depends critically on their social capital endowments. The main argument is that specific types of social capital endowments facilitate – and, thus, explain – specific modes of social coordination in areas of limited statehood. Explorative in nature, con- ceptual and theoretical arguments will be developed that offer new perspectives to explain the variance and mechanisms of governance outside the OECD world.

248. A Turn to Non-State Actors: Inducing Compliance with International Humanitarian Law in War-Torn Areas of Limited Statehood

Many of the perpetuated armed conflicts in the Great Lakes Region in Africa take place in war- torn areas of limited statehood. These conflicts are characterized by a high number of civilian victims, often resulting from utter disregard for international humanitarian law. Here, the rise of armed, violent non-state actors collides with the State-centric traditional nature of public international law. Thus, (classical) compliance structures seem to lose their significance, as they predominantly rely on the State for law enforcement and therefore mainly accommodate States’ interests when inducing compliance. The working paper suggests that the international com- munity responds to these challenges by allocating competences to other actors than the State. Particularly, international organizations increasingly contribute to enforcing international hu- manitarian law. However, since these organizations are dependent on their member States’ political willingness to support measures for inducing compliance effectively, a proliferation of humanitarian non-state actors can be observed that step in where third States and international organizations are reluctant to act. The paper investigates reasons for compliance and arrives at the conclusion that traditional motives rooted in a logic of consequences, as well as appropriate- ness are still valid and must therefore be addressed by the corresponding compliance mecha- nisms. These compliance mechanisms are interdependent and mutually reinforcing. Persuasion and incentives work more effectively if they are used under a shadow of hierarchy thrown by coercive legal enforcement instruments, such as international criminal justice and UN targeted sanctions. These instruments are in turn more effective if they are part of a concerted effort.

249. Colombia, the peace process and the political participation of the armed groups

Abstract:
One of the key indicators to determine the degree of success of any given peace process is the stable participation in national politics of former members of armed groups in rebellion against the state. In the case of Colombia, the traditionally exclusive nature of its political system explains why both the enlargement of spaces for democratic participation and the political participation itself of the Revolutionary Armed Forces of Colombia – People’s Army (FARC-EP) have become key issues to be discussed at the talks in Havana. It would be highly desirable for the obstacles and reticence evinced by specific political sectors to be overcome so that the current peace process can result in both the political participation of the demobilised members of the FARC-EP and greater democracy in Colombia.
