Abstract:
The examples of Egypt and Saudi Arabia show the risks in betting on the stability of autocratic regimes in the region. Despite the Arab uprisings of the last decade, most countries in the Middle East remain in the grip of autocrats, with a widespread view that this is the 'default setting' for the region. However, an examination of Egypt and Saudi Arabia, where authoritarianism has been revived, reveals both regimes are struggling for popular legitimacy. Increasingly reliant on repression, these regimes risk provoking civil unrest, and external powers should reconsider their assumption that autocracy guarantees stability in the Middle East.

Abstract:
The paper examines the conflict over the control of the integration of Poland’s Constitutional Tribunal (CT) that evolved into a constitutional crisis in October 2015 - and has extended for more than two years. It identifies issues that help understand how the Polish Democracy does not impede the erosion of constitutional democracy as the conflict has undermined the CT and the function of judicial review (JR). The article examines issues of legitimacy that emerge from the crisis; it also examines the extent to which the institutional settings condition the operation of the JR function; in particular, it looks at the role of executive actors (the Government and the President), and the role of the political/parliamentary party in bridging the separation of powers.

Abstract:
Uganda has the world’s second youngest population. The Museveni regime is increasingly struggling to build legitimacy among this group, which wants public services and employment rather than distant stories about how the regime brought an end to war when it came to power in 1986. This brief aims to explain the ways in which the Museveni regime has dealt with these changing circumstances. Concretely, it argues that the regime’s attempts to improve public services largely fail because of existing patronage dynamics. This has made the regime even more dependent on the use of patronage and violence.

Abstract:
EU-level parliamentarism is at a crossroads. The hybrid form of parliamentarism, combining elements of parliamentarism as control of the executive and parliamentarism as a separation of powers, has rendered the public image of the European Parliament obscure, and decreased the democratic legitimacy of the EU’s political system. Even the contradictory elements of the two main models of parliamentarism have been incorporated into the Union’s political governance. Lack of clarity concerning the contours of parliamentarism tends to support an underestimation of the role it plays at the EU level. The path towards the revision of the Union’s democratic governance along the lines of the separation of powers system is currently shorter than the one provided by parliamentarism as control of the executive.

Abstract:
The legitimacy of traditional authorities in areas of limited statehood in Mali, Niger and Libya In many countries in the Sahel and northern Africa, the state lacks an effective presence in border regions. This has dire consequences for communities that reside there, as the state is generally unable or unwilling to provide them with basic security and services. State absence has become a particularly pressing concern since the 2011 fall of Gaddafi in Libya, which set in motion a chain reaction of armed group formation and the spread of violent extremist organisations that now threaten the stability of the region. By capitalising on both the absence of state security and local populations’ grievances about central state neglect, these groups have been able to cement their presence throughout the Sahel, in Mali and Niger for example. This report explores whether traditional authorities in Mali, Niger and Libya could play a role in addressing these dynamics. Since pre-colonial times, traditional authorities such as tribal chiefs and religious leaders have performed governance tasks, such as the administration of justice and conflict mediation. They also play ‘an important symbolic role as representatives of community identity, unity, continuity, and stability. This has earned them a high degree of legitimacy among the public. In areas of state absence, traditional authorities could therefore provide pivotal entry points for local dispute resolution and mediation initiatives. Yet, as this report shows, traditional authorities have always been part of the political context, and are thus liable to be drawn into political – and sometimes violent – conflict. To assess whether traditional authorities can contribute to governance and stability, this report aims to provide a better understanding of how traditional authorities come to power, the extent to which their communities regard them as legitimate authorities, and the extent to which communities feel that traditional leaders are best-placed to address their concerns. The application of this multidimensional perspective to legitimacy, as advanced by Beetham (2013), leads to the following central research questions: How do the traditional authorities engaged in local governance in fragile settings, such as areas of limited statehood, build and maintain legitimacy? And what consequences does this have for (inter)national interventions that aim to foster (formal) local government and stability?

Abstract:
Post–civil war democracies are characterized by intense electoral competition. To ensure continued political relevance, ex-military-turned-politicians, or “warlord democrats” (WDs), can either engage in a rhetoric of fear or ease societal tensions by employing a rhetoric of peace. WDs’ choice of rhetoric can have a profound impact on durable peace by altering societal discourses concerning the legitimacy of using violence. A key question is therefore: Why do some WDs employ a rhetoric of fear, and others a rhetoric of peace, when running for office? We argue that the choice of rhetoric is a function of the patrimonial endowments WDs possess; if WDs lack the resources and social networks needed to distribute patronage, they may instead use a rhetoric of fear to rally voters. To highlight the explanatory value of this proposition, we compare two Liberian WDs who ran for the Senate in 2005—Adolphus Dolo and Prince Johnson.

In light of rising internal cleavages and centrifugal tendencies, differentiated integration (DI) has (re)arisen as a major topic in debates on the future of the European Union. As new forms of participation below the threshold of full membership are needed, this paper provides a conceptualisation of effective and legitimate DI. Going beyond existing scholarship’s focus on the legal dimension of DI, the paper emphasises its organisational component, meaning the variegated participation of EU member states, sub-state entities and third-country actors in the panoply of EU policy-making institutions, such as regulatory agencies and transgovernmental networks. The paper subsequently discusses how to measure effectiveness of such differentiated arrangements in terms of their output, outcome and impact, before theorising under what conditions we are likely to see effective DI. Finally, the paper turns to the question of legitimacy of DI, discussing its meaning, measurement and determinants.

39. Traditional authority and state legitimacy: Evidence from Namibia

Do African traditional leaders weaken state legitimacy at the local level? Past scholarship raises the possibility that unelected chiefs might undermine trust in national-level institutions. Relying on an original map of areas governed by chiefs and survey data from Namibia, this study examines whether respondents governed by traditional leaders are less likely to trust state institutions. I find that compared to individuals not living under traditional authority, chiefdom residents are more likely to trust government institutions. To partially alleviate the concern that chiefdom residence is endogenous to trust in national-level institutions, I use a genetic matching strategy to compare relatively similar individuals. I further find that the association between chiefdom residence and trust in state institutions is considerably weaker and less statistically significant for individuals who do not share ethnicity with their chief. This evidence suggests that traditional leaders’ ability to complement state institutions at the local level is compromised by ethnic diversity.

Abstract:
In 2016, Islamist political party Ennahda decided to abandon preaching and focus on politics, precipitating an identity crisis within the party. It faced new challenges, including rethinking the role of Islam, addressing its own neutralization as a driver of socioeconomic change, and managing its core supporters while appealing to a broader electorate. Ennahda’s shift to politics has forced it to rethink its ideological framework and rebuild its legitimacy based on arguments other than religion.
