Abstract:
Gender justice sees equal power relations, privilege, dignity, and freedom for people of different genders as a necessary component for any “just” society and a prerequisite for development.1 Gender justice includes gender equality, meaning substantive freedom for all genders to have genuine choices about their lives. Mirroring a global pattern in peace and security practice and policy-making, transitional justice (TJ) practice has tended to reduce gender justice concerns to violence against women (VAW). This policy brief advocates for policy-makers to adopt a broader and more meaningful understanding of gender justice, and to incorporate it into their TJ policymaking.

Abstract:
As the Syrian regime regains territory, there have been growing calls in neighboring countries for refugees to go home. Yet refugees have conditions for a return—conditions that political efforts to resolve the Syrian conflict have largely ignored. To understand refugee attitudes toward return, the Carnegie Middle East Center listened to the concerns of Syrians—both male and female, young and old—struggling to build meaningful lives in Lebanon and Jordan. What is most striking is that despite the increasingly difficult challenges they face, a majority are unwilling to go back unless a political transition can assure their safety and security, access to justice, and right of return to areas of origin. Economic opportunity and adequate housing are important but not requirements. Above all, their attitudes make it clear that both a sustainable political settlement and a mass, voluntary return are contingent upon international peace processes that account for refugee voices.

The Danish Peace and Stabilisation Fund is a prime example of how to combine civilian and military instruments to address conflicts in fragile states. However, there is still room for stepping up synergies of the military-civilian balance in Denmark’s comprehensive conflict management. Recommendations ■ Increase the frequency of formal feedback between the field and the strategic level of the PSF to avoid loss of knowledge. ■ Synergies between civilian and military instruments should take place through complimentary-but-separate interventions. ■ Take PSF instruments into account when planning Denmark’s broader engagement in conflicts to ensure a more comprehensive security policy effort.

Abstract:
This discussion paper connects the sustaining peace agenda and conflict prevention with the police component in United Nations (UN) peace operations. UN Police (UNPOL) play a critical role in conflict prevention through: (a) direct operational actions aimed at mediating disputes, defusing tensions and deterring violence; (b) structural prevention linked to mentoring, training and advising host state police, and the development of more effective, accountable and legitimate law enforcement institutions; and (c) systemic prevention through support for international norms and mechanisms to combat transnational organized crime, illicit arms flows and human trafficking. UNPOL’s role in conflict prevention can be further developed by a stronger focus on relationships with host state counterparts and civil society; more qualitative assessments on drivers of conflict and the inclusion of such assessments in early warning systems as well as UN reporting; and greater integration of UNPOL contributions to UN conflict prevention efforts.

According to Human Rights Watch there are estimated to be over fourteen million child brides worldwide, many of whom are traded for debt, bondage, and in contexts where polygamy and sexual activities with children go hand in hand, justified by religion or custom.(United Nation, 2013:31) There occurs a victimization of a new rising class of feminists in countries like Pakistan, where Islamist extremism from 1977 to 1988 especially targets and instances even murders or attempts to murder women who challenge their patriarchal power base. The analysis that represents these forms of violence against women and women’s struggles for justice delivery in Pakistan by using their voices and their stories, from their frame of analysis have been failed miserably.

Large parts of the world, irrespective of their level of economic development, are at the cusp of severe environmental crises. In these regions, the operations of extractive projects such as large scale plantations, mining and industrial development have negated or worsened the economic, social and physical well-being of communities in their neighbourhoods and beyond. Their robust national and regional laws and institutions for the protection and governance of the environment and natural resources have remained on paper and the non-compliance by governments and corporations has had profound effects on community livelihoods, health, access to land and quality of life. CPR-Namati's Practice Guide for Environment Justice Paralegals is a step in the direction of closing this environmental enforcement gap. The guide provides a methodology for community mobilisers, activists and citizens groups to shift their attention from stating the problem to getting grievances addressed by environmental institutions. The guide is based on four years of work done by the paralegals of CPR-Namati Environment Justice Program to assist affected communities file complaints and seek remedies in over 150 cases of non-compliance in India. We hope that this guide will help local organisations and community groups to address environmental conflicts and seek useful remedies for affected people.

Last Wednesday an international court found Ratko Mladić, the notorious “butcher of Bosnia,” guilty of genocide, war crimes and crimes against humanity. As Commander of the Bosnian Serb Army during the 1992-1995 Bosnian war, Mladić’s troops forced thousands of civilians to flee from “ethnic cleansing” – a cruel euphemism that will forever be associated with the wars in the former Yugoslavia. At the time Mladić appeared all-powerful and untouchable, presiding over the genocide at Srebrenica and wantonly committing war crimes. He will now die in prison. It took decades for international justice to catch up with Mladić. And while the verdict is a welcome warning to other perpetrators, it also poses the uncomfortable question of whether the international community is doing enough to hold those responsible for atrocities today accountable for their crimes?

Abstract:
Based on the major normative political theory contributions on global climate justice, the present paper analyzes the new international agreement on climate change, adopted at COP 21 in Paris (2015). Therefore, a literary review of the extensive normative theoretical discussion about global climate justice is made, with special attention to the two approaches that have permeated multilateral political negotiations - historical responsibility and equal per capita emissions. From this normative discussion, this paper recalls the global climate change negotiation process, focusing on the Kyoto Protocol. Next, the analysis emphasizes on the Paris Agreement in an effort to evaluate the normative questions on justice and equity within the environmental governance regime. Finally, the set of conclusions indicates that, although the flexibility of the Agreement has encompassed some dimensions of responsibility, necessity and ability to bear the costs, the most complex dimensions of justice and equity has not been completely solved, which may hinder the operation of environmental governance in a near future.

Abstract:
The theories behind extradition, the rule of “prosecute or extradite” and the idea of using due diligence when prosecuting and punishing a criminal offender need to be explored in detail, relying on both customary international law and treaty-based law. Luring fugitives into international waters or cooperating with another state in the frames of the process of extradition are options that may help in bringing fugitives before justice. The Republic of Macedonia among other states has recognized the need for cooperation in criminal matters through the use of extradition as one of the earliest forms of inter-state cooperation in any domain. This paper explains how extradition is governed in the internal legislation of the Republic of Macedonia and the necessary changes which have been made in order to increase the effectiveness of extradition and to preserve human rights from possible violations.
