Abstract:
This publication offers the Key Issues and Policy Recommendations based on the results of the Forth International Conference “Security Sector Governance: the Role of the Media”. In established democracies, free and independent media play a crucial role in the democratic oversight of the security sector, allow for channels of communication to be established between government and society, and present a crucial foundation for guaranteeing and protecting human rights and freedoms. This security sector reform conference was unique in that journalists were invited as not just reporters but the main participants of the debates. The dialogue had a multi-dimensional, multi-levelled character that touched upon national and international questions of security as it pertains to information warfare, particularly in Ukraine.

Abstract:
This publication offers the Key Issues and Policy Recommendations based on the results of the Eighth International Conference “Human Rights and Security Sector Governance: Ukraine’s Reform Challenges”. Since 2014, Ukraine’s security sector has been undergoing reforms. The implementation of state reforms are supported and monitored by Ukrainian civil society and the international community. Whereas certain aspects of reforms have been considered successful, the need for enhanced human rights compliance in the security sector of Ukraine, in particular with respect to ensuring accountability for human rights violations, the protection of the rights of civilians in the Anti-terrorism Operation (ATO), as well as preventing and responding to gender-based violence has been repeatedly pointed out. Conference Eight, following to the previous conferences recommendations, provided a platform to discuss the above mentioned issues.

This publication offers the proceedings of the Conference II “Security Sector Governance: The Role of Democratic Institutions & International Best Practices”. Following the Conference I findings, participants elaborated current challenges related to the role of democratic institutions in the Ukrainian Security Sector Governance and worked out solutions based on possible accommodation of best international practices in Ukrainian realities. This publication offers presentations of the key speakers and the summaries of the Working Group discussions. General assessments, conclusions and proposals are those of the participants and do not necessarily coincide with the positions of DCAF, the Razumkov Centre or the official position of the Ministry of Foreign Affairs of the Netherlands. Abstract:
There are often misunderstandings among member states in international organizations (IO) regarding the legal nature of certain acts. Issues of privileges and immunities based on the principle of functional necessity, both inherent and implied powers, and the principle of good faith under common law are continuously criticized and debated by both member states and IOs alike. For this reason, international legal order can be a process of continuous transition and constant evolution. This essay analyzes the development and changes of legal norms in the European Union’s (EU) Common Foreign and Security Policy (CFSP). On that basis, it will unfold by looking at the EU’s legal structure to create a solid framework for understanding the current challenges for common European defense policy in relation to Russia’s involvement in Ukraine. Although there have been substantial legal improvements introduced by the Treaty of Amsterdam (effective 1999) and by the Treaty of Nice (effective 2003) to help clarify the ambiguous nature of the CFSP, its objectives remain wide and abstract. With 190 state members, the Nuclear Nonproliferation Treaty (NPT) is almost universal. However, it has fallen on hard times. North Korea violated it and withdrew in 2002. Israel, Pakistan, India, and North Korea—the nuclear-armed states most likely to use them—refuse to sign. Others—e.g., Syria, South Korea, and Egypt—have violated its safeguards and yet suffered no serious consequences. Also, with the Iran deal, enriching uranium or re- processing spent reactor fuel, which can bring states to the very brink of bomb making, is now less taboo. Finally, with President Trump’s suggestion that South Korea’s and Japan’s acquisition of nuclear weapons is inevitable, the prospect of the treaty lasting in perpetuity is easily open to question.1

38. The Idolatry of Force: How Israel Embraced Targeted Killing

Not until the Second Intifada did assassination emerge as an explicit, legally codified, and publicly announced doctrine of so-called targeted killing in Israel. This study, the first of a two-part series, explores the doctrine’s historical roots and ideological lineage and tracks its rise under the premiership of Ariel Sharon. Targeted killing became institutionalized not just to reduce direct and imminent threats against Israelis but also to mobilize electoral support, field- test weapons and tactics, and eliminate key figures in order to sow chaos and stunt the development of an effective Palestinian national movement. The study frames the analysis within a wider meditation on Israel’s idolatry of force. As much symbolic performance as military technique, targeted killing reenacts and ritualizes Palestinian humiliation and helplessness in the face of the Zionist state’s irresistible power, making this dynamic appear a fact of life, ordained and immutable.

39. The Time Inconsistency of Long Constitutions: Evidence from the World

Abstract:
This paper analyzes the mechanisms that establish time consistency of constitutions. It explains why shorter and more locked constitutions are more likely to be time consistent (change less), whereas long constitutions are more time inconsistent (change more, despite locking). Empirical evidence from all the democratic countries in the world indicates that the length and locking of constitutions are not independent criteria and that their combination leads to less time consistency. To address this interrelationship, I develop a measure of time inconsistency (a combination of locking and amendment rate) and show that it is connected with the length of constitutions. I show how time inconsistency is incompatible with theories of “constitutional amendment culture” (Ginsburg and Melton 2015), not only at the theoretical level but also empirically. Finally, I demonstrate that the empirical findings of Tsebelis and Nardi (2016) that length of constitutions is related to lower per capita income and higher corruption are not only in agreement with time inconsistency arguments but are corroborated beyond OECD countries to all democracies.
