For a more comprehensive overview of events related to the al-Aqsa intifada and of regional and international developments related to the peace process, see the Quarterly Update on Conflict and Diplomacy in this issue. 16 FEBRUARY As the quarter opens, Israel's siege of Gaza continues, with Israel barring all exports, all but limited humanitarian imports, and most cross-border transit by individuals (with very limited exceptions for extreme medical cases, VIPs, and international NGO workers). The Israel Defense Forces (IDF) enforces a 300-meter-deep no-go zone along the full length of the Gaza border and limits the Palestinian fishing zone off Gaza to 500–1,000 m off the immediate Bayt Lahiya and Rafah coasts, and 3 nautical miles elsewhere. In the West Bank, the IDF conducts late-night arrest raids, house searches in and around Hebron, nr. Tubas. (PCHR 2/18) 17 FEBRUARY IDF troops on the n. Gaza border fire on Palestinians scavenging building materials fr. destroyed buildings n. of Bayt Lahiya, forcing them to flee but causing no injuries. In the West Bank, the IDF demolishes a livestock pen nr. Kiryat Arba settlement after the settlers filed a petition with the IDF asking for it to be removed; conducts late-night arrest raids, house searches in al-Am`ari refugee camp (r.c.) nr. al-Bireh and nr. Gaza to level land inside the no-go zone e. of al-Maghazi and al-Musaddar, demolishing 3 Palestinian homes (displacing 13 residents), leveling 17 dunams (d.; 4 d. = 1 acre) of agricultural land, exchanging gunfire with armed Palestinians throughout the day (no injuries reported). In the West Bank, the IDF patrols in Bayt Sira village w. of Ramallah in the evening, firing rubber-coated steel bullets at stone-throwing youths who confront them, causing no injuries; conducts late-night arrest raids, house searches nr. IDF troops in observation towers on the Gaza border e. of Jabaliya fire on Palestinian farmers working land 400 m fr. the border (outside Israel's no-go zone), forcing them to leave. Israeli naval vessels fire on Palestinian fishing boats off the n. Gaza coast, forcing them to return to shore. Late in the evening, IDF troops on the n. Gaza border fire at Palestinian homes in Bayt Hanun for 40 mins., causing no injuries. In the West Bank, the IDF opens fire on a Palestinian vehicle driving nr. Gaza border fire on Palestinians scavenging construction material from destroyed buildings 400 m fr. the border, forcing them to flee; no injuries are reported. Shortly after, the same IDF unit shells the area where the Palestinians had been scavenging as well as a Palestinian home in Bayt Lahiya, causing damage but no injuries. In the West Bank, the IDF patrols in Bayt Rima nr. Ramallah during the day; conducts late-night arrest raids, house searches nr. Hebron. Some 50 Jewish settlers break into the ancient Na'aran synagogue in Palestinian-controlled area A in Jericho to hold religious services, declaring their hopes of “renewing Jewish settlement in Jericho” (see Quarterly Update for details); the IDF removes the settlers, arresting at least 35. Jewish settlers escorted by IDF troops enter Kafr Haris village n. of Salfit to perform Jewish prayers at monuments in the village. (HA 2/22; PCHR 2/24; OCHA 2/25) Israeli PM Benjamin Netanyahu adds 2 key West Bank Jewish shrines, the Tomb of the Patriarchs (known as al-Ibrahimi Mosque to Palestinians) in the center of Hebron and Rachel's Tomb just inside Bethlehem, to Israel's national heritage sites, allocating $1 m. for their maintenance and repair as part of a $100 m. project to refurbish and link 150 national heritage sites, creating a “historical biblical trail [to] educate the next generation about Jewish and Zionist history.” The PA condemns the action. IDF troops conduct late-night arrest raids, house searches in al-Fara`a r.c. s. of Tubas and nr. Hebron, Jenin, Nablus, Ramallah. In Gaza, the IDF makes a day-long incursion to level land along the n. Gaza border nr. Bayt Lahiya to clear lines of sight. Jewish settlers fr. Yitzhar settlement nr. Hebron; 1 Palestinian died of electrocution in a smuggling tunnel nr. the Rafah border. 252. Scaling Up the Fight Against Rural Poverty

Abstract:
The International Fund for Agricultural Development (IFAD) has for many years stressed innovation, knowledge and scaling up as essential ingredients of its strategy to combat rural poverty in developing countries. This institutional review of IFAD's approach to scaling up is the first of its kind: A team of development experts were funded by a small grant from IFAD to assess IFAD's track record in scaling up successful interventions, its operational policies and processes, instruments, resources and incentives, and to provide recommendations to management for how to turn IFAD into a scaling-up institution. Beyond IFAD, this institutional scaling up review is a pilot exercise that can serve as an example for other development institutions.

253. When Is International Peacemaking Illegal? Implications of the 2010 Supreme Court Decision in Holder v. Humanitarian Law Project

Abstract:
The June 21st Supreme Court decision in Holder v. Humanitarian Law Project affirmed the constitutionality of the material support statue which makes it illegal for U.S. citizens and organizations to provide material support, including expert advice or assistance, service or personnel, to designated terrorist organizations regardless of whether the support is intended to promote nonviolence and peace. The material support law and the process of listing terrorist groups provides the U.S. government with an enhanced legal structure to arrest alleged terrorists and prevent terrorist acts. However, it is unclear that the process is effective in practice or that enhancing the government's legal power to prevent acts of terrorism outweighs the unintentional consequences of prohibiting nongovernmental organizations (NGOs) from working on the front lines of conflict zones to promote conflict resolution. Looking to the future, NGOs can work with the State Department and Congress to find ways to allow peacebuilding and humanitarian organizations to continue their operations legally, while also not threatening national security.

254. MINURCAT Withdrawal: The Risks to Civilian Protection and Humanitarian Assistance in Eastern Chad

Abstract:
Chad hosts over 249,000 refugees from the Darfur conflict and 168,000 internally displaced persons who were relocated after instability caused by Chadian rebel groups. The U.N. Mission in the Central African Republic and Chad has been reduced to 1,900 as of October 15, 2010. It will withdraw completely by December 31, 2010. There are concerns about the capacity of the Chadian security forces to adequately protect the population.The government of Chad and the international community must work to ensure the security of the population and humanitarian workers.

255. Humanitarian Space Shrinking for Health Program Delivery in Afghanistan and Pakistan

In Afghanistan and Pakistan, humanitarian space has shrunk as the Taliban and other insurgent groups have stepped up attacks on civilians, especially international aid workers, contractors and local leaders. Health programs continue to operate, but the ability of nongovernmental organizations (NGOs) to recruit and retain staff and to travel outside Kabul has suffered. The United Nations, International Committee of the Red Cross (ICRC), and other groups have sought to persuade the Taliban and other armed groups not to impede or interfere with humanitarian aid activities. These efforts have had some success where the aid is administered by Afghans, but they have not limited attacks on international staff, who along with all foreigners, remain at high risk of attack. Many NGOs act as implementing partners in the government's strategy to implement a comprehensive primary care system in Afghanistan under the direction of the Ministry of Public Health. They have managed to maintain those services with local staff despite their association with the government of Afghanistan, so long as they operate with impartiality and community engagement. The vulnerability of their staff to attack appears to be a product of generalized insecurity or the presence of foreign aid workers, rather than a result of collaboration with the Ministry.NGOs report that military activities in Afghanistan and Pakistan, and military involvement in the medical sector, have contributed to the shrinkage of humanitarian space. The military's provision of health services through Provincial Reconstruction Teams and other mechanisms, though well-intended, sometimes sows confusion about the allegiances of U.S. and other Western aid workers and creates tensions with humanitarian principles the agencies rely on to operate in conflict environments. The conduct of the Afghanistan National Army and Police and the Pakistan military in entering facilities to gain access to arrest insurgents or gather information also leads to greater insecurity for NGO personnel.

256. Mental Health Services During and After Armed Conflict: The State of Knowledge and Practice

Abstract:
There is increasing recognition that the violence, displacement, disruption of communities and social networks, and deprivation stemming from war deeply impact the mental health of individuals and the social cohesion of communities. In response, donors and providers are creating programs for psychosocial or clinical services that seek to be culturally appropriate, attentive to the need to build local capacity, and sustainable. The quality and comprehensiveness of mental health programs offered in crises, however, generally remains mixed. Too often the programs do not sufficiently differentiate among widely varying individual needs or focus predominantly on either community-based interventions or the clinical needs of more severely affected people but not both. Services for people with more severe disabilities often replicate institutional models, and accompanying human rights violations, that existed in the pre-war period. The challenge of providing sound programs, moreover, is complicated by a relatively thin evidence base. In the face of these challenges, the “Guidelines on Mental Health and Psychosocial Support in Emergency Settings” adopted in 2007 by the Interagency Standing Committee (IASC) offer a promising approach. They stress understanding local context, programming that attends to psychosocial support needs of the entire community, meeting clinical needs of people with more severe conditions, and respecting human rights. Following the IASC and building the evidence base by assuring adequate evaluation of funded programs can help meet the tremendous mental health needs of suffering populations.

257. Turkey, Israel and the US in the Wake of the Gaza Flotilla Crisis

Abstract:
Palestinians in Gaza have suffered under an illegal siege—first imposed by Israel in 2005 and strictly enforced since early 2009—which Amnesty International has called “a flagrant violation of international law.” Hundreds of civilians, the representatives from dozens of countries, attempted to deliver much-needed material to the Gazan people by the Gaza flotilla. The passengers on board—including elected officials, diplomats, media professionals, and other human rights workers—joined the flotilla as an act of civil disobedience and because they believe there is no decent justification for preventing shipments of humanitarian aid from reaching people in crisis. Israeli military launched a nighttime assault with heavily armed soldiers who shot and killed nine civilians and seriously injured dozens more. What happened to the flotilla is happening to the people of Gaza on a daily basis. It will not stop until international law is applied to all countries, Israel included.

In 1986, when The Carter Center decided to take on the challenge of eradicating Guinea worm disease, outside observers probably believed success to be impossible. After all, there were 3.5 million cases of the disease spread across 20 countries in impoverished areas and no vaccine or medicine to stop the scourge. Not to mention that The Carter Center was a four-year-old organization with just a handful of staff.

260. Research Locally, Diffuse Globally? American Universities, Patents and Global Public Health

An important challenge in sustainable development is promoting the creation of new medical technologies and ensuring their diffusion in developing countries. There is growing concern that, with the implementation of the World Trade Organization's agreement on Trade Related Intellectual Property Rights (TRIPs), pharmaceutical patents will restrict access to medicines globally. Profit-oriented companies are now aggressively pursuing intellectual property protections in developing countries, many of which had previously not allowed product patents on drugs. The concern is that absent generic competition, patients will not be able to access life-saving medications. Recent attention has focused on a perhaps unlikely set of actors to help ameliorate the access to medicines problem: American research universities. A decade-old student movement has argued that universities own intellectual property rights on many important drugs, and has pushed for inclusion of “humanitarian licensing” clauses that would compel the pharmaceutical firms that license these technologies to allow generic access in developing countries. In this paper, I discuss the emergence and evolution of this student movement, and the set of patent policy changes that got us here. I also summarize data on the feasibility of these policies: for how many drugs would changes in university policies plausibly affect access? Next, I discuss the desirability of changing university licensing practices and the tradeoffs universities face when considering humanitarian licensing approaches. I conclude with a discussion of the limits of campus-level initiatives alone, and the potentially important role for research funding agencies, such as the National Institutes of Health, in promoting humanitarian licensing and access to medicines.
