Abstract:
The Euromaidan revolution totally reoriented Ukraine’s policy in both internal and external dimensions. The new Ukrainian authorities facing Russian aggression and domestic instability started to build a new national identity in order to consolidate social cohesion. Due to the fact that Kiev’s new historical narrative glorifies the Ukrainian nation- alists from the Organisation of Ukrainian Nationalists (OUN) and the Ukrainian Insurgent Army (UPA) who contributed to the Holocaust of Jews and committed mass murders on the representatives of other nationalities, such a policy may be a serious obstacle in the context of Ukraine’s external relations. The present article investigates particularly Israeli- Ukrainian relations after the Euromaidan revolution. The article analyses the impact of the new Ukrainian identity on bilateral relations as well as attempting to answer whether or not it may influence Kiev’s cooperation with the European Union. The article contains a brief de- scription of the new identity building process in the post-Euromaidan Ukraine with special consideration of those elements of it, which are related to “Ukrainian Nationalism”.

In recent years, historical witnessing has emerged as a category of "museum object." Audiovisual recordings of interviews with individuals remembering events of historical importance are now integral to the collections and research activities of museums. They have also become important components in narrative and exhibition design strategies. With a focus on Holocaust museums, this study scrutinizes for the first time the new global phenomenon of the "musealization" of the witness to history, exploring the processes, prerequisites, and consequences of the transformation of video testimonies into exhibits.

Abstract:
The Nazis’ persecution of the Jews during the Holocaust included the creation of prisoner hierarchies that forced victims to cooperate with their persecutors. Many in the camps and ghettos came to hold so-called “privileged” positions, and their behavior has often been judged as self-serving and harmful to fellow inmates. Such controversial figures constitute an intrinsically important, frequently misunderstood, and often taboo aspect of the Holocaust. Drawing on Primo Levi’s concept of the “grey zone,” this study analyzes the passing of moral judgment on “privileged” Jews as represented by writers, such as Raul Hilberg, and in films, including Claude Lanzmann’s Shoah and Steven Spielberg’s Schindler’s List. Negotiating the problems and potentialities of “representing the unrepresentable,” this book engages with issues that are fundamental to present-day attempts to understand the Holocaust and deeply relevant to reflections on human nature.

15. The Return of Cultural Genocide?

Abstract:
Cultural genocide, despite contemporary thinking, is not a new problem in need of normative solution, rather it is as old as the concept of genocide itself. The lens of law and history allows us to see that the original conceptualization of the crime of genocide – as presented by Raphael Lemkin – gave cultural genocide centre stage. As Nazi crime was a methodical attempt to destroy a group and as what makes up a group’s identity is its culture, for Lemkin, the essence of genocide was cultural. Yet the final text of the Convention on the Prevention and Punishment of the Crime of Genocide (Genocide Convention) does not prohibit cultural genocide as such, and it is limited to its physical and biological aspects. What led to this exclusion? In this article, we examine the various junctures of law, politics and history in which the concept was shaped: the original conceptualization by Lemkin; litigation in national and international criminal courts and the drafting process of the Genocide Convention. In the last part, we return to the mostly forgotten struggle for cultural restitution (books, archives and works of art) fought by Jewish organizations after the Holocaust as a countermeasure to cultural genocide. Read together, these various struggles uncover a robust understanding of cultural genocide, which was once repressed by international law and now returns to haunt us by the demands of groups for recognition and protection.

In this groundbreaking book, leading Arab and Jewish intellectuals examine how and why the Holocaust and the Nakba are interlinked without blurring fundamental differences between them. While these two foundational tragedies are often discussed separately and in abstraction from the constitutive historical global contexts of nationalism and colonialism, The Holocaust and the Nakba explores the historical, political, and cultural intersections between them. The majority of the contributors argue that these intersections are embedded in cultural imaginations, colonial and asymmetrical power relations, realities, and structures. Focusing on them paves the way for a new political, historical, and moral grammar that enables a joint Arab-Jewish dwelling and supports historical reconciliation in Israel/Palestine. This book does not seek to draw a parallel or comparison between the Holocaust and Nakba or to merely inaugurate a “dialogue” between them. Instead, it searches for a new historical and political grammar for relating and narrating their complicated intersections. The book features prominent international contributors, including a foreword by Lebanese novelist Elias Khoury on the centrality of the Holocaust and Nakba in the essential struggle of humanity against racism, and an afterword by literary scholar Jacqueline Rose on the challenges and contributions of the linkage between the Holocaust and Nakba for power to shift and a world of justice and equality to be created between the two peoples. The Holocaust and the Nakba is the first extended and collective scholarly treatment in English of these two constitutive traumas together.

17. The Train Journey: Transit, Captivity, and Witnessing in the Holocaust

Deportations by train were critical in the Nazis’ genocidal vision of the “Final Solution of the Jewish Question.” Historians have estimated that between 1941 and 1944 up to three million Jews were transported to their deaths in concentration and extermination camps. In his writings on the “Final Solution,” Raul Hilberg pondered the role of trains: “How can railways be regarded as anything more than physical equipment that was used, when the time came, to transport the Jews from various cities to shooting grounds and gas chambers in Eastern Europe?” This book explores the question by analyzing the victims’ experiences at each stage of forced relocation: the round-ups and departures from the ghettos, the captivity in trains, and finally, the arrival at the camps. Utilizing a variety of published memoirs and unpublished testimonies, the book argues that victims experienced the train journeys as mobile chambers, comparable in importance to the more studied, fixed locations of persecution, such as ghettos and camps.

18. Anti-Discrimination Exceptionalism: Racist Violence before the ECtHR and the Holocaust Prism

Abstract:
Over the past years, the European Court of Human Rights has significantly developed and strengthened its Article 14 non-discrimination jurisprudence, including in a number of ground-breaking international law cases establishing increased state responsibility with regard to ethnic segregation in education and gender violence. However, in the type of cases that constitute a large part of its non-discrimination case load, namely physical violence against racial minorities, the Court has so far failed to adequately address Article 14 discrimination claims raised by the victims. We posit that this could be caused in part by what we call the ‘Holocaust Prism’. Put briefly, the experience of the Holocaust has shaped the manner in which continental European courts understand racism and race discrimination, at least (or especially) when it is combined with violence. Paradoxically, this entails that in the most heinous cases of race discrimination, the discrimination threshold is raised to the level of criminal conduct. Moreover, to the extent that it is, only the ethnic dimension of such discrimination is foregrounded even in cases that present obvious intersectional (for example, ethnicity plus gender) dimensions. We exemplify this phenomenon by discussing recent case law on forced sterilization of Roma women and argue that the Court should become aware of this issue, recognize intersectional discrimination and align its case law on racist violence with the discrimination doctrine emerging in its gender violence and educational race segregation cases, both for the sake of internal consistency and to better capture the structural nature of racial discrimination in Europe.
