951. Turkish Domestic Politics in 2009: Towards Normalization

Abstract:
This article analyzes Turkey's domestic political developments in 2009, by situating them against the results and implications of the 2007 national elections. It examines major issues on Turkey's agenda: the redefinition of civilian-military relations, the Kurdish question, the issue of conservative social networks and the Ergenekon investigation. The article argues that while the governing Justice and Development Party previously pursued a survival strategy based on alliances with liberal reformists and the EU to curtail the power of the military, in the wake of the 2007 elections it opted to explore issues of common ground with the military. The developments in 2009, which was a year of harvesting the fruits of this new strategy, show that this strategy worked in regards to the Kurdish question, but it has failed on the issue of conservative social networks, as the military and the government remained embroiled in an undeclared confrontation on this issue.

Abstract:
This edited volume brings together 23 articles by various authors who examine different aspects of European democratisation under four headings: Concepts, Practices, Changes and Contexts. In the first section, “Concepts,” contributors tackle different definition of democracy, drawing on discussions in classical literature and examining contemporary challenges to democratization in the global age. In the opening article, “Representative Democracy: Rosanvallon on the French Experience,” Frank R. Ankersmit claims that representative democracy has advantages over direct democracy, as the laws governing the former provide foundational bases for a political order. In the following article, “Direct Democracy, Ancient and Modern,” Mogens H. Hansen looks at direct democracy more closely. The author points out that direct democracy existed only in Ancient Greece and that several centuries after the Hellenic era, scholars introduced the concept of representative democracy and institutions but no serious debate took place regarding the democratic character of these institutions. Hansen discusses the prospects of revitalizing the institution of direct democracy through the use of modern tools. In her article, entitled “Neither Ancient nor Modern: Rousseau's Theory of Democracy,” Gabriella Silvestrini discusses Rousseau's perception of democracy and concludes that it had very little relevance to majority rule. In “Representative Government or Republic? Sieyes on Good Government,” Christine Faure focuses on controversial thinker Abbe Sieyesm, and argues that, in his time, he suggested an elected king who would resemble the modern institution of the President of the Republic.

953. The EU in Bosnia and Herzegovina: Powers, Decisions and Legitimacy

Abstract:
This Occasional Paper analyses the issue of the Bonn Powers in Bosnia – whereby the Office of the High Representative (OHR) can enact laws and remove elected officials – by comprehensively assessing the legitimacy of past OHR decisions. Adopting an established theory of legitimacy developed by Harold Lasswell and Myres McDougal, it argues that empirical legitimacy is best conceived as serving common interests of effective actors within an authorised process, and normatively prescribes that such process should be shaped to maximise values of human dignity. Given this theoretical framework, it examines the process authorised under the Dayton Agreement, which created the political structure that currently exists in Bosnia. It discusses the origins of the Bonn Powers and surveys the various criticisms that have been levelled against them. It then develops an overall analysis of all OHR decisions to date and provides a critique of those categories of decisions that appear inconsistent with the Dayton order and its proclaimed organising principles. Moreover, it provides a focused assessment of a sample of the most problematic decisions, e.g. the removal of elected officials, to show how their empirical legitimacy can be analysed. Finally, the paper concludes with policy recommendations, focusing on the issue of whether the Bonn Powers should be renounced or retained in the future.

Abstract:
Can autocratic governments that incorporate elements of democracy provide good governance? The authors approach this question with an inductive study of Russia, which is widely regarded as a leading hybrid regime and an innovator in the field. They argue that for most of the past decade, and especially during Vladimir Putin's second term as president, Russia has been characterized by a hybrid regime that strongly resembles those in many other Eurasian states, as well as Venezuela and Iran. This type of regime combines a high degree of state centralization with the gutting of democratic institutions, and their sys-tematic replacement with substitutions that are intended to serve some of their positive functions without challenging the incumbent leaders' hold on power.

Recently, the Federal Reserve has significantly altered the procedures and goals that it had followed for decades. It has more than doubled its balance sheet, paid interest to banks on reserves held as deposits with the Fed, made decisions about which institutions to prop up and which should be allowed to fail, invested in assets that expose taxpayers to large losses, and raised questions about how it will avoid inflation despite an unprecedented increase in the monetary base.

957. The Myanmar Elections

Abstract:
Myanmar will shortly hold its first elections in twenty years. Given the restrictive provisions of the 2010 Political Parties Registration Law that bar anyone serving a prison term from membership in a political party, many imprisoned dissidents will be excluded from the process, unless they are released in the near future. Aung San Suu Kyi – whose suspended sentence and house arrest possibly exclude her also – has condemned the legislation, and her National League for Democracy (NLD) has decided not to participate and has, therefore, lost its status as a legally-registered party. There has rightly been much international criticism of the new constitution and of the fact that the elections will not be inclusive, but the political and generational shift that they will bring about may represent the best opportunity in a generation to influence the future direction of the country.

More than two years after declaring independence, Kosovo struggles with uneven rule of law and a weak justice system that is failing its citizens. The police, public prosecutors and courts are erratic performers, prone to political interference and abuse of office. Organised crime and corruption are widespread and growing. Realising that prosperity, relations with the European Union (EU) and affirmation as an independent state depend on the rule of law, the government has taken important steps, replacing key officials and passing long-delayed reforms. But critical weaknesses remain, notably in the courts, and the government, supported by the international community, must act swiftly to curtail them.

960. Medical Disasters and the Growth of the FDA

There is strong evidence that the spectacular growth in the size of the federal government is a result of its expansion following one crisis or another, either real or imagined. After the crisis it gains new powers that become the norm for the next stage of growth. The Food and Drug Administration provides a particularly apt example of this increase in powers as a response to a series of crises, each of which has increased the regulatory authority of the agency. The Food and Drug Administration, which did not even exist before the twentieth century, now possesses massive regulatory powers over products that account for no less than twenty-five cents of every dollar spent by the American consumer, totaling well over $1 trillion annually. Historical investigation shows that the agency has been able to take advantage of several perceived crises, the combined effect of which was to increase its authority to determine what Americans ingest to the point where today, at least in the case of drugs, it is the agency—and not the consumer—that determines when and what is available. A regulatory agency originally established to ensure that consumers would be provided with full and accurate information on the drugs available to them has become one that determines which drugs are available, when they might be administered, and who may ingest them. This essay traces this growth in terms of the legislative reaction to three crises, the diphtheria antitoxin crisis of 1901, the sulfanilamide crisis of 1937, and the thalidomide crisis of 1960.
