Abstract:
Failed states have made it to the top of the international agenda following 11 September 2001. This paper gives an overview of the debate on 'what to do'. Firstly, it suggests an explanation of where these so-called failed states are coming from: Why do some states self-destruct? Secondly, four different approaches to failed states are presented and discussed - with special emphasis on the dilemmas and predicaments they each hold. The paper concludes that the question of what to do with failed states requires a political answer. Not a technical one.

2172. Bans, Tests and Alchemy: Food Safety Standards and Ugandan Fish Export

Abstract:
Fish exports are the second largest foreign exchange earner in Uganda. When Uganda's fish export industry started to operate in the late 1980s and early 1990s, one may have thought that fish was being turned into gold. From an export value of just over one million US$ in 1990, the mighty Nile Perch had earned the country over 45 million US$ just six years later. But alchemy proved to be more than the quest of the philosophers' stone to change base metals into gold. From 1997 to 2000, the industry experienced a series of import bans, imposed by the EU on grounds of food safety. Despite claims to the contrary, the EU did not provide scientific proof that fish was actually 'unsafe'. Rather, the poor performance of Uganda's regulatory and monitoring system was used as a justification. The 'system', as the characters of an allegory, has no individual personality and is the embodiment of the moral qualities that 'the consumer' expects from 'responsible operators' in the fish sector. Only by fixing this system of regulations and inspections, and by performing the ritual of laboratory testing did the Ugandan industry regain its status as a 'safe' source of fish. Fish exports now earn almost 90 million US$ to the country. This apparent success story was achieved by a common front comprising government authorities and the processing industry, a high level of private-public collaboration not often seen in East Africa. Yet, important chunks of the regulatory and monitoring system exist only on paper. Furthermore, the system is supposed to achieve a series of contradictory objectives: to facilitate efficient logistics and ensure food safety; to match market demand and take care of sustainability; to implement a top-down food safety monitoring system and a bottom-up fisheries co-management system. This means that at least some food safety-related operations have to be carried out as 'rituals of verification'. Given the importance of microbiological tests and laboratories in the food safety compliance system, alchemic rituals are perhaps a more appropriate metaphor. While the white coats and advanced machinery of present-day alchemists reassure insecure European regulators and consumers, it leaves the Ugandan fish industry in a vulnerable position. In Uganda, fish can now be turned into gold again – but for how long?

2174. A Special Part of Europe: Nation, State and Religion among Orthodox Slavs

The paper studies how nation, state and religion – in particular: churches – are related among Orthodox South Slavs: Bulgarians, Serbs, Macedonians and Montenegrins. The close relations between (self-conceived) nations and churches go back to the Ottoman Empire, and seem to have been strengthened by the conflicts in Former Yugoslavia since 1990. The close relation between state and nation go back to how the Ottoman empire was dissolved and have also been strengthened by the same conflicts, even though all states proclaim themselves as non- discriminatory in this respect. The close relation between church and state also has long historical roots, but is more ambiguous today, with elements of competition as well as cooperation – and the latter is seen by many as having gone too far under communism. It is notable that where there are attempts to stabilise a separate identity – in Macedonia and Montenegro – establishing separate churches is a part of this on par with defining separate languages, rewriting history, etc. and the churches are seen as important national symbols even among quite secularised groups; and the same is true for the resistance against separation from the Serbian Orthodox Church.

Abstract:
Thank you for inviting me to testify today at this hearing on extension of the incentives for savings and investment that are scheduled to expire in the next few years. Major tax incentives enacted in 2001 and 2003 that are scheduled to expire and that the Congress may consider renewing include the special lower tax rates for capital gains and dividend income enacted in 2003, and the increase in the annual deduction amount for qualified section 179 property, the savers credit, and the above the line deduction for qualified post-secondary education expenses, all enacted in 2001. The education deduction and the increase in the section 179 deduction expire at the end of this year, the savers credit expires at the end of 2006, and the lower tax rates for capital gains and dividends expire at end of 2008.

Abstract:
The unique institutions that make up Germany's "unitary federal state," long considered part of the country's post-war success story, are now generally perceived as a "joint-decision trap" impeding effective policy responses to new economic and demographic challenges at both levels of government. Nevertheless, a high-powered bicameral Commission set up in the fall of 2003 failed to reach agreement on constitutional reforms. The paper analyzes the misguided procedural and substantive choices that led to this failure, and it discusses the possibility of asymmetric constitutional solutions that might enhance the capacity for autonomous action at both levels.

2178. Whose Oceania? Contending Visions of Community in Pacific Region-building

In the past year the 'war against terror' and perceptions of state failure within the post-colonial Pacific have sparked an Australian-led initiative to deepen and widen regional integration in Oceania. This paper argues that behind the seeming unanimity of the 2004 Auckland Declaration and agreement by Pacific Islands Forum leaders on a 'Pacific vision' and a 'Pacific plan' are several contending visions of regional community, and of community-building. The political and moral legitimacy of each vision depends significantly on how these visions answer the question of who is Oceania for, and who has the right to speak for it? The seemingly dominant vision (that of the Australian government) is problematic in this regard. Past practice of Pacific region-building suggests that it may therefore not receive the legitimacy it requires for sustainability. This therefore is in danger of producing an unintended consequence: the replication at a regional level of the legitimacy problem associated with the so-called failing state.

2179. Rentier Shifts, Legitimacy, and the Social Sources of International Financial Hegemonie

This paper provides an analysis of the domestic legitimation of 'financial reform nexuses' during two periods of English and US international financial hegemony. Following Max Weber's work on the state and finance, I argue that positive state intervention is required to legitimise a 'financial reform nexus' (the interrelation of credit, property, and tax politics) for people on below median income. I hypothesise that sufficient legitimation of a financial reform nexus provides the means to generate and sustain international financial hegemony, including the capacity to tailor the structure of the international financial order to suit the hegemon's interests. Conversely, if the hegemon is unable to sustain the legitimation of its domestic financial reform nexus-a choice that correlates with negative state intervention that supports a 'rentier shift'-its capacity to maintain international financial hegemony wanes. I draw from examples of the legitimation of financial reform nexuses in England (1900-15) and the US (1985-2000), linking domestic legitimation to consequent changes in the structure of the international financial order. Through this analysis of the social sources of English and US international financial hegemonies, I differentiate the English 'international rentier economy' from the US 'international creditor economy'. Finally, I stress the importance of positive state intervention for the legitimation of the US financial reform nexus.
