Abstract:
“Because the legal advice was we could do what we wanted to them there” (22). This is how a top-level Pentagon official, in David Rose's Guantánamo: The War on Human Rights explains why detainees held by the United States have been detained at Guantanamo Bay. It is just one illustration of the important role that lawyers have played in the “War on Terror”—a role, along with factors that have or that may have influenced it, that forms the topic of this essay.

Abstract:
President Bush's request to increase the size of the Army and Marine Corps by 92,000 personnel follows on the heels of similar proposals by Congress members of both parties. Despite the bipartisan appeal of this idea, it is not at all clear what problem it is intended to solve or how it is supposed to solve it. Advocates may believe that America's troubles in Iraq provide reason enough to “grow” the Army and Marine Corps. But this view misconstrues both the lessons of that war and America's true security needs.

Abstract:
Enlargement of the European Union is an incremental process which begins before formal accession of a given state and continues thereafter. One can distinguish four main areas of studies of this subject. These are: 1) the policy of candidates for EU membership; 2) the policy of member states towards EU enlargement; 3) European Union's enlargement policy; 4) the consequences of this process. In this study it is the second of these areas that will be analysed, with the focus on the policy followed by German governments and presidents on the question of the accession of Turkey.

Abstract:
With its special character in relation to both institutional design and policy content, the EU is often classified as a 'post-modern' security actor. What does this actually mean? What kind of capabilities does a post-modern actor have? This article focuses on the development of political and administrative capabilities in the EU's Common Foreign and Security Policy. If it is true that the EU is becoming an increasingly important security actor, we should expect an increase in these kinds of capabilities as well. According to March Olsen (1995) little can be accomplished without capabilities such as rights and authorities, resources, competencies and organizational skills. This should also be true of a presumably 'post-modern' actor like the EU. This paper examines the extent to which the EU has established these kinds of capabilities in relation to its security policy, how they can be characterized and whether they have increased over time.

Abstract:
Globalisation is shorthand for changes in space, time and the relationship between them. This paper, which will be forthcoming as a chapter in a book edited by Andrew Cooper and published by the United Nations University Press, argues that changes in deterritorialisation will not have thoroughgoing effects for diplomacy. A change in time, notably the change to zero lag-time in information flows, is, on the other hand, of key importance. So is the increase in the sheer mass and density of communication. If transcending boundaries is the essence of globalisation, then it stands to reason that state diplomats must sooner or later take cognizance of the other kinds of polities that exist within the system.

1586. Civil-Military Cooperation in Multinational and Interagency Operations

Abstract:
This paper discusses obstacles to civil-military cooperation in the context of multinational and interagency operations, with a special focus on assessment functions and processes. As such, the paper seeks to contribute to the ongoing process of developing a framework for assessment of operations within the context of MNE5. The rationale behind this study is to strengthen the basis for and the effectiveness of Effects-Based Assessment (EBA) of performances, effects, and end-states in multinational and interagency operations. The first section starts by identifying a set of key overall challenges to such cooperation, namely civilian and military actors' often lack of knowledge of one another's organizational identities, security concerns, and working procedures. The paper then discusses one of these categories, namely working procedures, in more detail, identifying in the second section the challenge of divergent operational terminologies, and in the third section the challenge of overcoming the information sharing gap when in the presence of similar assessment practices. The main suggestion of this paper is that knowledge about civilian and military operational terminologies and assessment practices is an imperative for successful civilmilitary cooperation in multinational and interagency operations. Such knowledge, we argue, is best obtained if both military and civilian actors respectively open their communication channels with the purpose of sharing information and operational experiences. Furthermore, based on the discussion, the paper raises a number of points which the authors believe would be valuable topics for further developing civil-military cooperation within the context of multinational and interagency operations.

1587. International Engagement in Sudan after the CPA

Abstract:
The report analyses the international engagement in Sudan since the Comprehensive Peace Agreement (CPA) in relation to the Principles for Good International Engagement in Fragile States and Situations, which the OECD/DAC is currently developing. The report concludes that donor coordination has been quite advanced in Sudan, with a number of innovative mechanisms tried out. Furthermore, there has been a concerted effort towards contributing to the building of the South Sudan state. This effort, however, has focused on building institutions from the top down in Juba, without a complementary emphasis on building legitimacy and the relations between state apparatus and society. Moreover, strengthening the relationship between the Government of National Unity and the Government of South Sudan has been given relatively less attention. In terms of peacebuilding, there are also challenges for international engagement. More could have been done to contribute to a short-term peace dividend, and perhaps also to support the implementation of the CPA. On the basis of the experiences of the case of Sudan, the OECD/DAC Principles are found to be very relevant for guiding international engagement.

Abstract:
Budget consolidation is dominating the political agenda. The Hungarian government has embarked on an ambitious four-year consolidation programme following another election-year peak in the deficit in 2006 at 9.2% of GDP. The immediate revenue increases and spending cuts are temporarily damping growth. However, if all goes according to plan, the programme will bring dividends to the economy in the longer term. This payoff is crucially dependent on: Discipline in budgetary processes. Work needs to continue on strengthening budgetary mechanisms. A system of binding medium-term spending limits should be considered. Budgetary reform also needs to extend to the sub-national governments. Success in maintaining spending freezes. The re-scheduling that brought forward part of the 13th month payment to public-sector workers this year does not affect achievement of the 2007 fiscal target in accrual terms. Nevertheless, looking forward, strong resistance to spending pressures arising from revenue windfalls is of key importance. Implementation of the structural reform programme. The healthcare reforms that are expected to deliver a large share of fiscal savings are reasonably well advanced and a welcome cut in gas-price subsidies is already reducing government spending. The reforms in education are positive but the changes to the tuition–fee system in particular should go further. It is more uncertain, however, whether all the planned cuts in government administration will be realised. Successful reform of public spending requires the participation of the counties and municipal governments. There are potential savings in administrative overheads here too and sub-national governments are responsible for providing many government services. In-depth review of these issues in this Survey reveals a need to: Capture economies of scale. Political constraints preclude widespread mergers among the large number of small municipalities. However, the joint provision of services is widespread and should be encouraged further. Efforts to rationalise through replacement of county-level governments with regional assemblies should continue. Reform financing systems. The financing of sub-national government needs simplification and greater transparency and oversight in accounts. Also, the benchmarking of services via output and performance indicators needs to become more widespread. Reform of local taxation should include widening of property tax and removal of the local business tax. Hungary's low employment rate remains a key structural handicap to economic performance. There has been welcome reform of unemployment benefits and early-retirement pensions. Planned reforms to disability pensions look promising and a concrete proposal for old-age pension reform is in the pipeline. This Survey looks in depth at the issue of prolonged parental leave and other aspects of family policy: Current efforts to boost childcare services are welcome. Future reform needs to consider further strengthening of central-government provision requirements on municipalities regarding these services, matched by appropriate funding. A system of childcare vouchers for parents would be one way of increasing efficiency in the provision of services. Reform to the very long parental leaves should be considered, along with changes to the attendant system of additional cash benefits. Savings could be used to help fund increased childcare services.
