Abstract:
Beginning in February 2005, Chatham House, London and the Centre for Energy, Petroleum and Mineral Law Policy (CEPMLP) at Dundee University facilitated a dialogue between participants from government, national and international oil companies, NGOs and financial institutions from 23 developing and developed oil-and gas-producing countries. The conclusions of this dialogue have been supplemented with in-house research on international governance practices. The main conclusions of the project to March 2007, and the 40 general governance benchmarks for the petroleum sector comprised within this Report , are set out in Good Governance of the National Petroleum Sector: The Chatham House Document.

1552. Anti-Corruption Challenges in Post-Election Democratic Republic of Congo

Abstract:
Now that the Democratic Republic of Congo has held a series of elections that mark the end of the long transition period, new institutions are being put in place at the national and provincial levels. The paper retraces the enduring legacy of mismanagement, corruption and human rights violations which was left by Mobutu Sese Seko's regime (1965-97) and was deepened during the following six years of conflict and three years of the transition period. This paper shows that a culture of impunity compounded by an inversion of moral values persists and will be among the many challenges confronting the leaders of the new regime.

Abstract:
Is the state on the retreat? We examine this question through an analysis of changing patterns of government involvement in infrastructure provision, which is generally considered to be one of the primary functions of the modern state. Based on an analysis of the extent of privatization of infrastructure companies between 1970 and 2000 across twenty-six OECD countries, we find that there is indeed a general trend towards less public infrastructure provision visible in all of the countries and that the main factors associated with the extent of privatizations are EU membership and government ideology. We argue that the trend of privatizing infrastructure companies was triggered by a change of the prominent economic discourse in the 1970s and that a rightist party ideology and EU membership fostered the adoption and implementation of these ideas in domestic settings.

Abstract:
It is generally agreed that the humanity, fairness and effectiveness with which a governments manages its criminal justice system is a key index of the state of a democracy. But the constraints on realization of democratic values and aspirations in criminal justice are markedly variable. In the last two decades, in the wake of both increases in recorded crime and a cluster of cultural and economic changes, criminal justice policy in both Britain and the U.S. has become increasingly politicized: both the scale and intensity of criminalization, and the salience of criminal justice policy as an index of governments' competence, have developed in new and, to many commentators, worrying ways. These developments have been variously characterized as the birth of a "culture of control" and a tendency to "govern through crime"; as a turn towards the "exclusive society"; and in terms of the emergence of a managerial model which focuses on the risks to security presented by particular groups. In the U.S., we witness in particular the inexorable, and strikingly racially patterned, rise of the prison population, amid a ratcheting up of penal severity which seems unstoppable in the face of popular anxiety about crime. In the context of globalization, the general, and depressing, conclusion seems to be that, notwithstanding significant national differences, contemporary democracies are constrained to tread the same path of penal populism, albeit that their progress along it is variously advanced. A significant scaling down of levels of punishment and criminalization is regarded as politically impossible, the optimism of penal welfarism a thing, decisively, of the past.

Abstract:
Many in the world of developmental economics believe that corruption, the circumvention of the rule of law for private gain, leads to nothing but woe for any nation's economy, under any circumstances. Transparency International makes the elimination of corruption their mission, and many large multinational firms today echo that goal by building ethical codes that prohibit employees from engaging in practices deemed corrupt, regardless of local attitudes and customs toward the practices. The World Bank makes curbing corruption a linchpin in their campaign to improve governance. Reasons given for blanket condemnation of corrupt behavior are often utilitarian: Corruption is expected to increase the economic costs of doing business by undermining the laws of the land; this, in turn, reduces productive activities and investments, with negative consequences unfolding for human development and economic growth.

Abstract:
As readers of The Rhetorical Presidency might expect, the Framers\' remarks at the Constitutional Convention revealed a deep concern about popular political ignorance—and a desire to shield the new government from it. However, when it came to designing the presidency, the Founders seem to have been less intent on insulating sitting presidents from the mass public than on guarding the presidents\' selection itself against elite factions that might take advantage of the public\'s ignorance. The resulting constitutional structure left the actual relationship between the president and the public open-ended. In short order, even the most restrained, patrician presidents took advantage of the opportunity to invoke, and to shape, public opinion—setting the stage for Andrew Jackson\'s, and his Democratic successors\', more aggressive presidential populism.

Jeffrey Tulis's The Rhetorical Presidency should not be read as a tale of decline. It is not a call for an “un-rhetorical” presidency so much as an exploration of the fundamentally uneasy place that popular rhetoric occupies in constitutional governments. Popular rhetoric is one way that executives exercise their prerogative power, and the dilemmas about rhetoric that Tulis exposes arise from a fundamental fact about prerogative power that all presidents must confront: Strong constitutional governments seem almost necessarily to grant their chief executives more discretionary authority than is consistent with the idea of constitutional government. Whatever rhetorical style or strategy a president adopts, he must respond in one way or another to this fact.

Abstract:
The rise of a partisan Congress can aggravate some of the pathologies of the rhetorical presidency identified by Jeffrey Tulis: reckless policy production, and the resulting public disillusionment with an overpromising government. In some cases, such as the debate over the invasion of Iraq, the unified ranks of the president's party amplify the president's simplistic rhetoric, reducing policy deliberation and aggravating public disappointment when reality turns out to be more complex. When combined with divided government, however, partisanship can work to produce deliberative compromises that mitigate these pathologies, as exemplified by the welfare-reform legislation enacted by a Republican Congress under a Democratic president in 1996.

Abstract:
Jeffrey Tulis's The Rhetorical Presidency is deceptively titled. It is not about rhetoric or political symbolism or even about the American presidency as such, as were many postmodern studies produced in the Reagan era. Rather, Tulis re-situates rhetoric: a minor theme in a story about the presidency becomes an important avenue into profound questions of political order and republican governance. Like Tulis, I approach my thesis obliquely; I distinguish his from other, seemingly similar, works (and realign him with other rhetorical readers, such as Paul de Man and Jacques Derrida) to underscore what I see as the book's lasting legacy: its explication of the double binds and central paradoxes of republican governance (seen, for example, in presidential prerogative), and its articulation of the role of rhetoric in institutional transformation.

This book will examine whether leading liberal democracies have a responsibility to respond when democracy is under threat. The United States, the European Union and its Member States pride themselves on their commitment to liberal democracy. They cherish it at home and claim to support it internationally. Americans tend to accept the Kantian notion that the internal conditions of a country help shape its foreign policy. Immanuel Kant presented the idea that democracies do not go to war against each other. Americans have embedded the democratic peace theory in their foreign policy outlook. The fact that the United States and the United Kingdom made a historic shift into strategic alignment across the twentieth century reinforced the notion of a commonality of interests among liberal democracies. A basic premise of American foreign policy in the twentieth century is the notion that as a liberal democracy based on values, the United States should advance certain values in its international affairs. Having always cared about freedom of the seas and freer access for American exports, the republic began to care about freedom itself. Even before the U.S. was committed to international human rights, it supported democracy, albeit imperfectly and inconsistently. America's emergence to the top table of international affairs after the First World War was complemented by President Woodrow Wilson's Fourteen Points. The United States cloaked its military might in the finery of democracy. Yet, this was not mere rhetoric: the U.S. did advance a conception of democracy in the form of self-determination as part of the peace settlement. President Wilson, and his successors in both political parties, understood that grand strategic engagement needed to be underpinned by a philosophical objective.
