461. EU-Ukraine DCFTA: the Model for Eastern Partnership Regional Trade Cooperation

Abstract:
The EU has been one of the largest trade partners for so called Eastern Partnership (EaP) countries, namely Armenia, Azerbaijan, Belarus, Georgia, Moldova and Ukraine. Commodity turnover of these countries with the EU vary between 30% and 50% of total, but their access to the EU market is less preferential than for many other neighboring countries. They trade with the EU on the basis of MFN regime, and five EaP countries, with exemption of Belarus, use privileges provided by Generalized System of Preferences (GSP) or the GSP+ or autonomous trade preferences (Moldova). With the launch of EaP initiative in 2009, relations between the EU and the Eastern European countries (Armenia, Azerbaijan, Belarus, Georgia, Moldova and Ukraine) have received new impetus for development. The EaP offers upgrade of relations within three major dimensions, namely (a) the Association Agreement (AA), (b) Agreement on a Deep and Comprehensive Free Trade Area (DCFTA), and (c) Visa Facilitation and Readmission agreements. The AA talks have been launched with all EaP countries expect for Belarus, and four of them have been involved in the DCFTA talks. Ukraine has progressed the most, as after five years of negotiations the EU-Ukraine Association Agreement with embedded DCFTA has been initialed in 2012.The aim of this study is to assess gains and losses that could arise from the DCFTA with the EU for the EaP countries, using information about EU-Ukraine DCFTA as model case for EaP regional trade cooperation.The focus of the paper is on non-tariff (regulatory) component of the EU DCFTA and potential implications of regulatory approximation. Also, current level of harmonization of EaP countries’regulatory framework with the EU acquis in the areas related to the DCFTA is analyzed.

Abstract:
The Eastern and Southern Mediterranean region has many advantages. Its proximity to European markets and its strategic location along the Mediterranean Sea help facilitate the trade of goods among Europe, Asia and Africa. The region has great historical and civilizational importance. It also has plentiful supplies of oil and natural gas resources and great demographic potential. Yet despite these many advantages, the Eastern and Southern Mediterranean region remains relatively backward in economic and social terms and is rightly considered a potential source of social and political instability. In this brief the authors analyze the key challenges facing the MED11 countries and propose policy measures that could improve the region’s economic and social performance.

Abstract:
This paper argues that globalization and interdependence has contributed to the “contingent maneuvering” of states with sovereignty from an economic perspective, whilst nuclear non-proliferation, security, survival, and rising nationalism established states as prominent actors on the global stage from a political perspective. The paper proceeds with an Introduction and Background Information of the State in part one. Part two gives a literature review of the state on the global political stage. In part three, the paper theorizes globalization and economic interdependence as the border- less source responsible for the decreasing power of states. Part four ponders how the contentious issues of nuclear proliferation, residual nationalism and non state actors contributed to the erosion of sovereignty for reasons of security and survival. And in part five, I ponder the theoretical implications and give concluding remarks.

Abstract:
Since becoming a member of the World Trade Organization, China embarked on sever- al commitments to become a key player on the international economic stage. This pa- per is a case study of China’s membership of the World Trade Organization (WTO) and the implications on Chinese sovereignty. Theorizing China’s historical evolution amid concerns of sovereignty, the paper looks at China’s Regime Commitment and Compli- ance in the WTO, major Compliance and Commitment Concerns with China in the Or- ganization. China may have complied with some of its commitments particularly in the service area. The paper distinctively concludes that China’s membership of the organi- zation has forced it to share power with other actor whilst protecting the interest of its citizens on the global stage.

Abstract:
The negotiations on the Association Agreement (AA) between the European Union (EU) and Ukraine, including its trade component, i.e., the Deep and Comprehensive Free Trade Agreement (DCFTA), were completed in December 2011. The agreement is practically ready to be signed, if the EU’s concerns related to the deteriorating political freedoms in Ukraine are addressed. The ball is now in Ukraine’s court and the correct and rapid response is crucial for the country’s future. Both the AA and the DCFTA offer Ukraine an opportunity to deepen its political and economic relations with the EU and modernize its own economy and state institutions. However, if fundamental economic, political, and institutional reforms are not accelerated and conducted in a more comprehensive and consistent way, the prospect of implementing the DCFTA (and its potential benefits) will come under question.

In 2011, the Belarusian ruble lost nearly 2/3 of its value. In December, the inflation rate approached 110% yoy. At the same time, the economy grew by 5.3% that year and continued with 3.6% yoy growth in January 2012. Is this a sign of economic recovery? Will it turn into sustainable growth? Or has the country exited from the crisis at all? To address these questions, CASE Fellow and Director of the IPM Research Centre in Minsk Alexander Chubrik looks at the roots of the 2011 crisis and compares them with the features of the long-lasting period of economic growth in Belarus.

469. Should Brazil be “Special” for Canada?

Abstract:
After years of mutual neglect and sometimes outright tension, Canada’s relations with Brazil are smoother than ever. As Brazil emerges as a relatively powerful and influential global player, shouldn’t Canada try to build that increasingly fluid relationship into a strategic partnership, making Brasilia a key prong of its global policy? Looking at Brazil’s place in the world, and at the ways in which its foreign policy meshes – or not – with Canada’s, this paper argues that such an option has little appeal and in fact few chances of success. Brazil’s rise has its limits, and the country’s global reach and power remain heavily constrained. Beyond the Americas, and even within, Brazil’s power is very soft and could hardly be harnessed effectively by Canada. Moreover, the two country’s international agendas do not overlap much. In global governance circles, Brazil’s global star is on the rise just as Canada’s is in decline. On democracy and human rights, Canada is much more willing to put sovereignty between brackets, and in the face of nuclear proliferation, Brazil is much more critical of the asymmetry of the global regime and the advantage this gives to established powers. Crucially, Canada largely embraces globalization and sees Asia’s rise primarily as an opportunity, whereas Brazilians feel more threatened by it. In that context keeping things running smoothly, without dreams of “grandeur,” is the most that should be sought: normal is great, special would be too much.

470. Two TRIPs to Innovation: Pharmaceutical Innovation Systems in India and Brazil

Abstract:
So far, the implementation of the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPs) and the dynamics of innovation systems have been discussed fairly separately from each other. Research on TRIPs implementation has tended to focus on the (non-) adoption of certain TRIPs flexibilities while the literature on National Systems of Innovation (NSI) widely neglects the impact of global norms on innovation systems. This paper aims to reconcile these two approaches. My analysis of the post-TRIPs pharmaceutical innovation systems (PIS) in India and Brazil reveals major differences in the regulatory outcomes that go far beyond the mere (non-)adoption of certain flexibilities. Driven by unequal state roles, India and Brazil have evolved into having two different types of innovation systems in the post-TRIPs era. The paper asks how innovation systems are developing under the conditions of globalization and, through this, it contributes to the discussion on innovation systems in emerging economies.
