271. Valuation of World Heritage

Abstract:
World Heritage sites are classified in two categories—cultural heritage, and natural heritage. Outstanding Universal Value—the basis for identification of a World Heritage site implies that valuation, from a global perspective, might be sufficiently greater than the valuation of that site in its immediate location for the World Heritage tag to provide a significant incentive for the preservation of it. The rise in tourist traffic consequent upon recognition, statistically validated in several contexts, seemingly justifies that prior. The common cliché of the historical structure allowed to fall into ruin, its stones prised out for constructing nearby dwellings, or the area within what remains of the structure put to base uses, conforms to that conception. Likewise, there are natural biodiversity reserves threatened by unregulated cutting of trees, where recognition as a World Heritage site may well be the statement of superior valuation needed to put a stop to such practices and preserve what remains. This paper does not therefore argue that the World Heritage convention should be abandoned, and its sites de-recognised. What it does argue is that the basis of indigenous valuation should be investigated for its constituents, so as to bring about a better alignment between global and local valuation.

Abstract:
This study briefly discusses three case studies of regional integration, namely the Indonesia-Malaysia-Singapore Growth Triangle (IMS-GT), the South African Development Community (SADC) and the Asia Pacific Economic Cooperation (APEC), to critically examine contemporary integration project as a phenomenon in which sovereignty, identity and boundary/territory are constructed and confirmed. Poststructuralist approaches reconsider regional communities as pre-given institutes, practices and actors, and inspire to focus on how these categories are constructed and implemented. I am concerned with two important questions: what are the central theoretical dilemmas concerning the concept of regional integration; and how can critical geopolitics employ the integration project and constructive discourses to form a broader view of regional integration?

Abstract:
In South Asia the notion of intrastate wars are prevalent and prolonged. Most of the countries in the region have faced or are still struggling with such wars. Liberation Tigers of Tamil Eelam (LTTE) rebellion movement in Sri Lanka, till very recently, violent Nexal movement and Maoist insurgency in India and sectarian violence in Pakistan, Taliban and Al-Qaida in Afghanistan have all been the part of intra-state wars. These wars challenge the authority and the integrity of the state. The state’s monopoly over the means of violence seems eroded in South Asia due to certain developments in the international system. The issue of intra-state war has become major problem for the states in South Asia to deal with. This paper argues that these intra-state wars challenge and influence the power of the state particularly in South Asia. It further analyses the state capacity and tries to look that how state finds itself constrained to in dealing with such intrastate wars. In a precise manner this paper also attempts to understand the changing conceptions of security due to the changed nature of modern warfare.

274. Between Evolution and Stagnation – Immunities in a Globalized World

Abstract:
Immunities here have, on the one hand, been calls for the limitation or even the abolition of immunities, in particular based on the argument of a lack of responsibility for grave violations of human rights. Contrarily, opposed tendencies can be observed which raise ideas such as the extension of the scope of persons to be protected by immunities, resting upon the pluralization of actors in the globalized world. This article examines these two contradictory aspects of development of immunities in public international law and how they might interrelate with each other. It analyses how the simultaneous evolution and stagnation of immunities can be explained. For that purpose the contribution evaluates at first the current state of the legal development. Further, it takes a look at a certain stagnation of legal development and clarifies the structural parameters within public international law which have led to such a stagnation. In this context, it is critically dealt with the question, whether immunities meet the demands of a globalized world. Lastly, this article addresses the development regarding a denial of immunity in cases of grave human rights violations and asks how it could be more cautiously brought forward.

275. When the Hong Kong Dream Meets the Anti-Mainlandisation Discourse: Mainland Chinese Students in Hong Kon

Abstract:
This article looks at identity constructions of mainland Chinese undergraduate students in a Hong Kong university. These students shared a “Hong Kong Dream” characterised by a desire for change in individual outlooks, a yearning for international exposure, and rich imaginations about Hong Kong and beyond. However, when their Hong Kong Dream met Hong Kong’s “anti-mainlandisa- tion discourse,” as was partially, yet acutely, reflected in the recent Occupy Central movement, most students constructed the simultan- eous identities of a “free” self that was spatially mobile and ideologi- cally unconfined and an “elite” self that was among the winners of global competition. This article argues that the identity constructions of these mainland Chinese students shed light on global student mo- bilisation and provide a unique, insider’s perspective into the integra- tion process between Hong Kong and the rest of the People’s Re- public of China.

276. The Temporal Experience of Chinese Students Abroad and the Present Human Condition

Abstract:
This article examines the experiences of Chinese elite uni- versity students abroad through the lens of temporality. In the strug- gle to get ahead, elite students are expected to carefully deploy their time. Studying abroad, it is argued, has become one more step in a culturally idealised temporal arrangement of how one is expected to go about advancing. The downside to this ethics of striving is shown to be a pervasive sense of restlessness (, fuzao). The article shows how relocating to a different life environment allowed a group of elite students to respond to their temporal predicament in existentially creative ways that registered socially as personal maturation. It is argued that these responses were set in motion by the students’ in- habiting an expanse of not-yet-purposeful time. Treating the tem- poral experience of Chinese elite students as a pronounced inflection of an increasingly global temporal mode of striving, the article en- quires into the temporality of the present human condition.

Abstract:
This article uses Mahler and Pessar’s (2001, 2006) model of “geography of power” to interrogate how the general dynamic of Chinese student migration generates a variety of experiences at the individual level. Each Chinese student-migrant embarks on their journey from a different position vis-à-vis the flows and interconnec- tions of the international education market. Some of them set out to achieve concrete goals, while others are motivated by a more intan- gible mission to become cosmopolitan subjects. As they move around, their shifting position in the hierarchies of nationality, class, gender, and generation influences their decision-making and their experiences. These power systems function simultaneously on mul- tiple geographical scales, exemplified by the contradictory ways gen- der operates in the family, education, work, and marriage. To further develop the connection this model makes between personal charac- teristics, cognitive processes, and various power systems, I draw at- tention to the politics of ordinary affects.

As an editor Bekemans presents to academic readers a rich collection of essays initially presented at the international workshop 'Cultural and Value Roots for Intercultural Dialogue in a European Context' held in October 2011 at the University of Padua under the auspices of the Jean Monet Centre. The essays presented at the conference and published a year latter provide to the reader an excellent overview of the topic and capture the engaging academic discourse that took place at the conference. The book aims to define the set of values that in turn define European identity. It also poses very important questions, such as what is the common set of 'core values', how to maintain and enrich those values in the face of globalization, multiculturalism and economic crises and how to work across institutions to promote and preserve those values.

Abstract:
Globalization is a growing phenomenon in the contemporary times when man has become modern in its thinking, actions and evaluation. Growing awareness regarding human rights is not only bringing human into mainstream affairs being major stakeholders indirectly but also greater expectations. This reality of preservation of human rights has brought the issue into legislation to make it law as a written part of the constitution at national, regional and global level in almost all spheres. Consequently, assurance of human fundamental rights is ground reality and written part of all the constitutions of the world. Globalization has transformed the world into a global village where there are commonalities of the cultures, exchange of ideas and free economic approaches are struggling to bring consensus among the world society to protect and preserve the human rights against any violation. World has divided into two blocks global north and global south based on their economic and political capacities. Globalization phenomenon was started by global north so it augurs well for the advancement of their interests while South is less benefited because of having underdeveloped status and weaker rule of law, social, economic and political condition. There are disparities of resources between both the blocks that are why south is suffering and north is maintaining status quo. State like Pakistan being the part and parcel of global south is facing economic and political hurdles where there is no provision of basic human requirements like food, health, education, employment and socio-economic stability. Globalization is north-centered phenomenon and more beneficial for them as compare to south. Globalization has positives and negatives. On one side it is providing awareness about the human rights violations while on other side it seems unable to protect human rights violations. Human rights violation scale is growing in Pakistan where there is nationalistic economy that is anti-thesis of the globalization and free market economy of north. Moreover, weak socio-economic and political conditions in Pakistan causing deprivations and grievance are growing where a specific chunk of society is violating all norms and rules of human rights by using their economic power and social status. In comparison to internationalization of economies under the umbrella of globalization, limited weightage is given to Pakistani exports in international market as compare to exports that proves very costly with the emergence of issue balance of payment that causes severe economic implications on Pakistan economy where social and political sector already going downwards and lacking to provide basic needs of life and fundamental rights. Labor issues and forced labor menace is growing in Pakistan where there are less facilities and larger number of labor and phenomenon of brain drain is growing. Globalization is impacting Pakistan more in a negative way and less in positive way. In this phase of initial years of second decade of twenty first century, human rights violation has decreased due to constitutional protection, media campaigns, role of NGO’s but still long way to go ahead to curb the menace.
