631. Tunisia's National Constituent Assembly: Current Politics and Next Steps

Abstract:
The paper is intended for all policy analysts interested in Tunisia, but it could be especially helpful for members of the NCA and the legal advisory committee, chaired by Yadh Ben Achour, that was recently established to advise the NCA on constitutional law and drafting procedure. The National Constituent Assembly of Tunisia (NCA) will act as the constitutional convention and transitional legislature of Tunisia and was elected on 23 October 2011.1 Decree No. 582, released on 20 May 2011, extends a one-year mandate to the NCA to write a new constitution for the republic. This commitment was also reflected in a September 18 agreement signed by Tunisia's largest political parties. Drawing from recent cases and academic literature, this paper explores key procedural questions that will confront the NCA in its first month in office.

As we began the process of drafting this review, citizens across the Middle East and North Africa took to the streets to demand an end to the abusive practices of the security services, more representative and responsive government institutions, the protection of their rights, greater access to economic opportunity, participation in decision-making, and access to justice. They began demanding, in short, the rule of law.

Abstract:
Since the 2003 Rose Revolution, Georgia has undertaken serious reforms, moving the country towards becoming a democracy anda market economy. Instead of proceeding at a steady pace, Georgia haschosen to take an accelerated path to reform. Since coming to office,the Saakashvili administration has underlined its ambition to bring Georgia into Euro-Atlantic structures. After an energetic start, Georgia ran into difficulties in late 2007 and 2008. During this period, the democratic credentials of the Saakashvili government were put to the test for the first time.The government was faced with massive public demonstrations, to which it responded in a heavy-handed fashion. The security forces attacked protesters, and the government declared a state of emergency, blaming the unrest on Russia. Many domestic and foreign observers feared that Georgia was abandoning the road to democracy. However, the state of emergency was soon lifted, and the government called an early presidential election. International observers judged the election to be largely democratic, despite some irregularities, but opposition forces claimed that the president's results had been boosted by fraud. Mr Saakashvili won an absolute majority in the first round of polling. The subsequent parliamentary elections in the spring of 2008 gave the ruling United National Movement party a landslide victory. With 119 out of 150 seats, theparty currently holds a two-thirds majority in parliament. The two major opposition parties (winning 17 and six seats respectively) refused to take their seatsin parliament.

Abstract:
In January and February 2011, populist uprisings toppled the authoritarian governments of Tunisia and Egypt, and similar revolts began to emerge in other Arab states, including Bahrain, Libya, Morocco, Syria, and Yemen. An article in the 18 March 2011 issue of the Chronicle Review by Ursula Lindsey, "The Suddenly New Study of Egypt," addressed how these events had turned the study of persistent authoritarianism in the Arab world on its head. No longer, for example, could scholars point to how Egyptians and other Arabs tend to engage in one of two extremes: political apathy or political violence. Lindsey also suggested that scholars shift their focus away from the power of elites to the strength of ordinary people and grass-roots movements, or retool their scholarship to allow for, in the case of Egypt, more emphasis on groups other than the Muslim Brotherhood as significant sources of opposition.

Abstract:
The financial plight of news media companies was alarmingly clear when the Knight Commission released its report in October 2009. Newspapers were closing or filing for bankruptcy. Print and broadcast news staffs were being cut and coverage reduced. There was growing concern that the loss of traditional media at the local level would lessen citizens' ability to have the information they need for their personal lives and for civic engagement, as well as their ability to hold government accountable.

Abstract:
Even as the magnitude of the digital revolution becomes more evident, its implications remain a matter of intense debate. Stewards of traditional media worry about the values that are being lost or threatened in the transition, while new media enthusiasts prefer to focus on the potential of digital technology not merely to inform citizens about their communities but to empower them to become directly involved in democratic processes. Policymakers often find themselves in the middle, attempting to negotiate between the impulse to let the marketplace freely determine winners and losers and the desire to protect the public interest by mitigating market failures and encouraging socially beneficial trends. All of these forces were represented at the 2010 Forum on Communications and Society (FOCAS) in Aspen.

Abstract:
The uprisings that unfolded in countries throughout the Middle East and North Africa during the first half of 2011 triggered a wave of electoral reforms and proposals for reform. In Egypt, one of the most pressing and controversial questions has been how to elect a new parliament that, as part of its charge, will select a body to draft a new constitution. How to elect representative assemblies is one of the fundamental questions of democracy. The resulting choice is greatly consequential in the transition from a despotic regime to a democratic system. The real challenge of election system design is producing an assembly that represents societal diversity, supports the important policy decisions made by legitimate governments, and provides a check on the exercise of executive authority.

639. Egypt's Imperiled Transition: Pakistan on the Nile?

As Egypt prepares to hold its first post-Tahrir elections, the transitional military government is trying to turn de facto influence into de jure powers written into the new constitution, such as freedom from civilian control over senior appointments and budgetary oversight. While most political parties have agreed not to challenge the extensive influence and economic perquisites of the military for now—understanding that full civilian oversight might take years to achieve—allowing the military to formalize such powers would create enormous new obstacles to eventual democratization. Egypt is now in danger of producing a post-revolutionary system similar to that of Pakistan, where elected civilian institutions are relatively powerless while unelected and unaccountable military and intelligence services actually run the country, fanning the flames of sectarianism and terrorism.

While ownership of the transition belongs to those who initiated and drove the uprisings in Egypt, Libya, and Tunisia, the West has a great stake in the outcome. A failure of these revolutions would likely lead to a rise in radicalism across the Arab world, increased threats to the security and stability of the Mediterranean region, potential disruption in energy flows to Europe and beyond, and enhanced pressures on migration to Europe, both legal and illegal.
