221. Assessment on Changes regarding the Specially Empowered Judicial System in Turkey

Abstract:
A number of amendments for criminal law have been instituted in Turkey in recent years within the framework of the judicial reform process that especially were geared towards the realization of the fair trial principle. Between 2011 and 2013, four groups of legal amendments named “Judicial Reform Packages” were passed. These brought about important improvements regarding fair trial, freedom of speech, personal liberty and security. The TESEV Democratization Program published a report evaluating the effect of these four judicial reform packages on rights and freedoms in September 2013. This brief report provides an evaluation of the amendment package instituted in March 2014 that included important changes vis-a-vis the specially empowered judicial system.

Abstract:
Contrary to what was previously thought, the Arab revolutions have not led to the democratization of the entire Southern Mediterranean region. In fact, the region is today more heterogeneous than before, with some countries heading towards democracy and others plunged into severe internal crisis. Old and new internal and external actors are also willing to gain influence and power amidst diverging conflicts of interests.

Abstract:
On the occasion of the Annual Summit of the Strategic Studies Network (Bangkok, 23-25 February 2014), several EuroMeSCo researchers participated in the kick off meeting of the Working Group “The Arab Spring in Comparative Perspective”. This group, lead by the European Institute of the Mediterranean (IEMed) will involve over 20 EuroMeSCo researchers, who will work throughout the year with the aim of publishing a joint volume on comparative perspectives of the transitions in the Arab world. The Working Group is structured around two main blocks: “Internal changes in transition processes: What priorities?” and “External actors and regional integration”. It consists of a total of 6 working packages, each of them lead by two EuroMeSCo researchers. The topics to be explored are: State building processes and reforms, security sector reform, the role of religion in transitional processes, socio-economic reforms, the role of the European Union in supporting democratic transitions in the Southern Mediterranean and regional integration.

The workshop "Democracies in the Making: Egypt at the Centre of Arab Transitions" focused on the analysis of the current phase of the democratic transition in Egypt, dominated by a high level of polarisation. It was organized by EuroMesco, the European Institute of the Meditereanan (IMed) and the Al Ahram Centre for Political and Strategic Studies (ACPSS), wit the support of the Spanish agency for International Development Cooperation (AECID). This was the last of a series of four workshops organised in the framework of a program to strengthen the capacities of think tanks and research institutes in Meditereanan countries, mainly in light of the current democratisation process and regional transformations.

Abstract:
This paper contributes to the debate on the role of democratic participation in complex systems of governance. It takes a process-oriented constructivist approach asking how transnational activism over time contributes to the construction of access and voice from below and uses the Asia-Europe Meetings (ASEM) to analyze how interactions between civil society and global governance institutions shape concrete forms of participation. The paper shows that transnational activism triggers both discursive and institutional changes within the official ASEM process leading to an informal, fragmented, and fragile institutionalization of civil society participation. However, the paper reveals a division between civil society organizations with some, such as business representatives, having preferential access and voice in comparison to more contentious organizations. The paper explains this fragmented form of democratization as the result of three interrelated processes: the particular history and economic origins of the ASEM; international developments particularly in the ongoing economic crisis; and domestic developments within individual countries (in particular China) which have begun to favor controlled access for civil society participation.

227. Thinking about Intelligence Within, Without, and Beyond the State

Abstract:
The reform or 'democratization' of intelligence has been studied in many countries essentially as a process of transition from authoritarian or 'counterintelligence' states to liberal democratic regimes in which security and intelligence agencies are subject to (more or less) democratic control and oversight. These studies have contributed to the growth in comparative studies of intelligence but have often ignored some key issues, including the conditions for the very existence of 'state' intelligence, the continuing significance of parallel non-state intelligence entities and the involvement of an increasing number of corporate actors in intelligence activities. This chapter examines intelligence as it works within and between different 'sectors' and the implications for democratization. Intelligence is a sub-set of 'surveillance', a ubiquitous social activity, and can be defined as: 'mainly secret activities – targeting, collection, analysis, dissemination and action – intended to enhance security and/or maintain power relative to competitors by forewarning of threats and opportunities.' A central element of this definition – as with surveillance more generally - is the link between information/knowledge and action/power (or, 'intelligence' and 'policy') where the objective of the process is security and it will be subject to resistance. Intelligence is exercised at various social 'levels' from the transnational to the personal: even individuals deploy information gathering in the face of uncertainty in order to assess threats etc.

228. The Politics of Polarization: Governance and Party System Change in Latin America, 1990–2010

What are the causes and implications of polarization in new democracies? During Latin America’s “Left Turn” period, highly polarized party systems emerged in some countries–Venezuela, Bolivia, Ecuador, Nicaragua, and El Salvador–but not the rest of the region. This paper proposes a theory to explain variation, centered on the presence of electorally relevant parties of the left in the pre-Left Turn period and, most critically, the quality of governance in that period. Poor governance created opportunities for partisan actors on the left to politicize a second dimension of political contestation, anti-systemic versus systemic positions on the design and operation of the state, and thus chart alternative paths to electoral viability that required little left-right programmatic moderation. This dynamic empowered radical party factions and drove polarizing dynamics in party systems. High quality governance, in contrast, gave left parties little choice but to moderate their programs in search of electoral viability. This dynamic empowered moderate party factions and drove centripetal dynamics in party systems. Empirically, the paper tests these arguments through a broad overview of the case universe and in-depth case studies of Venezuela and Brazil.

Even well-established democracies need reform, and any successful effort to reform democracies must look beyond conventional institutions--elections, political parties, special interests, legislatures and their relations with chief executives--to do so. Expanding a traditional vision of the institutions of representative democracy, Douglas A. Chalmers examines six aspects of political practice relating to the people being represented, the structure of those who make law and policy, and the links between those structures and the people. Chalmers concludes with a discussion of where successful reform needs to take place: we must pay attention to a democratic ordering of the constant reconfiguration of decision making patterns; we must recognize the crucial role of information in deliberation; and we must incorporate noncitizens and foreigners into the political system, even when they are not the principal beneficiaries.
