1. The Impact of Stereotyping on International Cyber Norm‑making: Navigating Misperceptions and Building Trust

Abstract:
Over the past three decades, cyberspace – a digital realm shaped by both technological and social dynamics – has evolved into a domain where a wide range of human activities now take place. These activities are marked by their anonymity, which complicates attribution, and their instantaneity, which challenges timely regulation. To address these challenges, states focus on two approaches: applying existing laws and creating new ones. While there is a general consensus that cyberspace should be governed by the rule of law, including international law, the application of existing legal frameworks to cyberspace remains an evolving challenge both in terms of state practice and academic discourse. At the same time, the international community has consistently sought to develop new norms to promote good governance in cyberspace. Against this backdrop, states – especially those with advanced cyber capabilities – are engaging in a competitive game of norm-making, striving to exert influence in shaping international rules to govern cyberspace. As part of this process, states often categorise each other by trying to highlight their counterparts’ most distinct characteristics. While such labelling is common in diplomatic interactions, it is particularly problematic in the context of international cyber norm-making. Labels reflect and reinforce stereotypes, which often oversimplify the complexities of states’ behavioural patterns in cyberspace and their underlying logic. States are thus roughly grouped by opposing indicators, such as those viewing cyberspace as a global commons versus sovereign territory, those advocating for an interconnected free Internet versus a fragmented “splinternet”, or those favouring multistakeholderism versus multilateralism as the dominant approach to the governance of cyberspace. Once established, these stereotypes are difficult to dismantle and can lead to distorted perceptions that obstruct constructive dialogue. This GCSP Policy Brief aims to identify the potential security challenges posed by stereotyping in international cyber norm-making processes. It then illustrates the policy implications of this problem and offers policy recommendations.

2. US-South Korea Cyber Cooperation: Towards the Higher-Hanging Fruits

Abstract:
In the past decade, the US and South Korea faced a relatively narrow set of challenges in cyberspace, notably North Korea’s cyber crime facilitating sanctions evasion. In the next decade, however, the two countries will face a more diversified set of challenges with growing North Korean ties with Russia, its involvement in the war in Ukraine, and intensifying US-China competition. The US and South Korea must develop a joint playbook for responding to scenarios of disruptive cyber operations targeting South Korean public and private sectors and prepare for an even more difficult environment for curbing North Korea’s cyber crime as Russia provides a way out. Over the past two years, the US and South Korea have significantly deepened and broadened cooperation on cyber issues and have expanded cooperation further to trilateral and multilateral settings. The two countries established several regular high-level and working-level dialogues, have issued joint sanctions and threat advisories, and deepened mil-to-mil cooperation. However, 2024 has been a watershed in terms of shifting geopolitical dynamics on and around the Korean peninsula. Cyber threats will become more diversified, and the bilateral relationship will be tested at the seams without a clear joint strategic concept and operational plan.

Even a cursory glance at headlines in Foreign Affairs – “How AI Makes Dictators More Dangerous”, “The Insidious Cyberthreat” and “The Autocrat in Your iPhone” - suggests that 2022 was not the best year for cyber optimists who profess a belief in technology’s democratising power (González 2022). Digital authoritarian systems and “spin dictatorships” continue relying just as much on information manipulation as coercion to consolidate their power (Guriev 2022). Meanwhile, concerns over the use of sophisticated mercenary surveillance systems and invasive AI technology in democracies are also mounting (Deibert 2022).

4. Decentralized Autonomous Organizations and Policy Considerations in the United States

Abstract:
Decentralized Autonomous Organizations (DAOs) can be defined as global, digitally-native organizations which enable people to coordinate and govern shared resources and activities through the use of smart contracts on blockchains. The explosive growth of DAOs since 2020 has led to experimentation, speculation, and investment in this emerging organizational framework. There are an estimated 6,000 DAOs as of June 2022, with participation from contributors around the world and an aggregate treasury value of an estimated $25 billion. While the web3 space has been marred by scams and bad actors, there are legitimate use cases for DAOs. Early applications include focuses on fractionalized ownership and control, incentive alignment, resilient operations, and collective action. DAOs demonstrate innovative potential and are producing new forms of tax revenue and employment for the U.S. States have taken various approaches towards legislation, including establishing a DAO LLC. The U.S. government needs a comprehensive strategy for addressing DAOs as novel organizational structures to retain domestic innovation and protect consumers. Future policy solutions should consider the following: DAOs have technical and operational uniqueness that should be taken into account by legislators and regulators. The United States must provide legal clarity to retain domestic innovation. The friction of existing organizational formation should be reduced and adapted. A multi-pronged approach is needed across the federal-level, state-level, and industry self-governance practices. This report aims to serve as an accessible primer for United States policymakers to understand the unique opportunities and challenges DAOs present, and how these organizations may be addressed in the regulatory landscape of the U.S. The first section of this report establishes the societal context in which DAOs have emerged, with an emphasis on the trends in organizational frameworks and working conditions to which DAOs respond. The second section describes the underlying technical and structural components that DAOs are built upon. The third section outlines the key purposes and applications of DAOs and shares findings from case studies and semi-structured interviews with 12 DAOs and 20 DAO contributors. The final section provides an overview of existing legislation and concludes by outlining directional considerations for policymakers.

Abstract:
Societal resilience is seen as a key answer to the deteriorating security situation, especially in the Baltic Sea region. States often employ new laws in an attempt to strengthen resilience, but is legislation the best way to build stronger societies? There is an underlying mismatch between the dynamism of resilience and the static nature of laws. Resilience entails the capacity to bounce back flexibly from crises. Laws should be formulated so as to nurture such flexibility. Democratic accountability might be at risk when laws are used in the quest for strengthened resilience.

Abstract:
The United States is susceptible to cyberattacks. The Cyberspace Solarium Commission Report provides several recommendations to prevent and respond to such attacks. However, many of these recommendations attempt to nationalize cybersecurity. This article presents a historical overview involving the Department of Homeland Security, the Cybersecurity and Infrastructure Security Agency, and the Commerce Clause, which outlines nationalization and its effects. It will note a similar trend for cybersecurity. Finally, the positive and negative consequences of nationalization are presented.

Abstract:
The cyber domain emerged as a perfect platform for international struggle over power and influence. International powers are actively engaged in cyber proxy warfare due to the relatively low risk of escalation, various enforcement challenges, and the vagueness of international law within this realm. These indirect conflicts might lead some global powers to close or restrict their virtual borders to avoid or reduce the plausibility of cyber proxy warfare or unwanted foreign influence in general. The formation of such restricted networks, articulated in this article as “internet bubbles,” is already shaping within the realm of actors like Russia, China, North Korea, and Iran. The authors argue that liberal democracies like the United States might be at a severe disadvantage to fight against cyber proxy warfare due to legal and constitutional barriers. But at the same time, the emergence of platform governance and self-regulation might be proven as a new force within these proxy wars and reshape its boundaries.

Abstract:
This paper analyzes the rise of VK Company and the creation of its super app to increase state surveillance and the dissemination of propaganda in Russia. The app is on its way to combining social networking and services related to healthcare, education, and e-government under one roof. Western policymakers need to be aware of why and how the Russian state is pushing its citizens to use such domestic services. Only then can they counter the use of data generated by such services in facilitating the state supervision and control of society.

Abstract:
Cyber incidents that—whether due to human error, system malfunction or intentional targeting—impact satellite and missile systems extend beyond the ongoing war in Ukraine. These systems are essential to civilian and military operations and disrupting them has the potential to elicit conventional or even nuclear retaliation. Due to the centrality of satellite and missile-related infrastructure, cyber incidents impacting the functionality of such infrastructure have served as a catalyst for previous confidence-building measures (CBMs) that may provide a template for future ones. This paper builds on SIPRI work to map cyber-related missile and satellite incidents, as well as unilateral, bilateral and multilateral CBMs to provide takeaways meant to foster greater predictability and stability in cyberspace.

Abstract:
The second brief in the “Russia’s War in Ukraine” series concerns the war in cyberspace. Dmytro Dubov, Head of the Information Security and Cyber Security Department of the National Institute for Strategic Studies in Kyiv, examines Russia’s methods of cyber attack against Ukraine’s critical infrastructure facilities, and their impact. He discusses the close coordination between Russia’s cyber and propaganda activities and highlights future challenges for Russia in the IT realm that, if left unaddressed, will degrade its competitiveness in cyberspace. He concludes that Russia has so far failed—at least in part due to Ukraine’s progress in cyber security and defence—to deliver the effects it desired in its cyber attacks against Ukraine.
