241. The Verdict Is In: The Impact of Crime on Public Trust in Central American Justice Systems

Abstract:
Over the past two decades, the countries of Central America have confronted soaring crime rates. Justice systems of dubious quality provide thin shields against this crime crisis, despite substantial international and domestic investment in justice reform. Indeed, there is growing concern that crime will undermine justice reform efforts. Scholars and practitioners have pointed out that public frustration with crime, coupled with dissatisfaction with justice institutions, can lead citizens to reject reform efforts. Still, the micro-level relationships between crime and public support of the justice system have been understudied. Using public opinion data from the Latin American Public Opinion Project (LAPOP), this study aims to add to the literature by examining the effects of victimization and fear of crime on public trust in the justice system. The results indicate that crime can erode public support for the justice system, but the mechanics of this relationship vary according to national context.

The trade in illegal timber and timber products leads to massive economic losses and environmental damage for the countries that are exploited. The World Bank has estimated that up to US$23 billion worth of timber is illegally felled or produced from suspicious origins each year, leading to revenue losses from uncollected logging licenses or taxes.

Ten years have passed since the adoption of the Convention Against Transnational Organized Crime (the Palermo Convention) by the UN General Assembly on November 15, 2000. At the signing of the convention in Palermo, Sicily, in December 2000, many government delegations welcomed the Palermo Convention as an important step in the fight against organized crime. Some warned against viewing it as a final measure and stressed that the convention and its protocols should be considered as a starting point rather than an end in itself.

Abstract:
In his seminal work on the history of scientific development, Thomas Kuhn described the structure of that development as revolutionary in nature, occurring at that point in time “in which an older paradigm is replaced in whole or in part by an incompatible one.” The impetus for this paradigm shift is malfunction—“scientific revolutions are inaugurated by a growing sense … that an existing paradigm has ceased to function adequately in the exploration of an aspect of nature to which that paradigm itself had previously led the way…. [T]he sense of malfunction that can lead to crisis is prerequisite to revolution.” Kuhn himself analogized his conception of the theory and operation of scientific revolutions to political revolutions, drawing out parallels in genesis, form and function between the two. The notion of revolutionary change, or paradigm shifts, itself provides a useful framework to judge the evolution, current state, and potential future of international human rights and criminal law. Although the analogy must necessarily be incomplete, as is the analogy between scientific and political revolutions, it does go a long way in explaining how the current system of international justice has reached its present state, and what may need to occur before that system can develop further.

245. Imperfect Justice at Nuremberg and Tokyo

When the international criminal tribunals were convened in Nuremberg and Tokyo in the mid-1940s, the response from lawyers was mixed. Some believed that the Second World War was an exceptional event requiring special legal remedies, and commended the tribunals for advancing international law. Others condemned them for their legal shortcomings and maintained that some of the charges were retroactive and selectively applied. Since then, successive generations of commentators have interpreted the tribunals in their own ways, shaped by the conflicts and political concerns of their own times. The past two decades have seen the establishment of new international courts, and an accompanying revival of interest in their predecessors at Nuremberg and Tokyo. Recent commentaries have analysed the founding documents, the choice of defendants, the handling of the charges, the conduct of the cases – and also the legal and political legacies of the tribunals. They demonstrate that long-standing disagreements over antecedents, aims and outcomes have still not been settled, and that the problems inherent in some of the original charges have still not been solved, despite the appearance of similar charges within the remit of the International Criminal Court today.

Cyberspace and the National Security of the United Kingdom provides a general overview of the problem of cybersecurity. The aim of the report is to inform debate and to make the case for a more coherent, comprehensive and anticipatory policy response, both nationally and internationally. In every area, society is becoming increasingly dependent upon information and communications technology (ICT). With dependency come exposure and vulnerability to misuse, criminality and even attack. Criminals and extremists are able to take advantage of the same 'global technological commons' upon which society is becoming so dependent. Cybersecurity has become a fast-moving and complex security challenge, one which requires a coordinated, agile and mutually reinforcing response from all those who benefit from the global ICT infrastructure.

Abstract:
Transnational organized crime (TOC) is no longer the sole preserve of specialist criminal organizations. It is now an essential strategy for armed groups around the world, and a source of funding for terrorists, corrupt politicians, warlords, and rogue governments. But states and international organizations have largely failed to anticipate the evolution of TOC into a strategic threat to governments, societies, and economies. At the international level, an outdated understanding of TOC does not adequately contemplate the strategic impact of TOC and fails to ensure that peace efforts and crime fighting are not working at cross-purposes.

248. Contested Cornerstones of Nonviolent National Self-Perception in Costa Rica: A Historical Approach

Abstract:
Crime, violence, and insecurity are perceived as society's biggest problems in contemporary Costa Rica. This degree of priority is especially remarkable because the country has always been considered the peaceful exception in the violent Central American region. In this paper I analyze four cornerstones of the nonviolent national self-perception in the 1940s and 1980s as the fundamental basis for the current talk of crime: the civil war, the abolition of the military, the proclamation of neutrality, and the peace plan for Central America and the subsequent granting of the Nobel Peace Prize. The result of the analysis is the determination that these historical cornerstones were not publicly discussed as expressions of the nonviolent identity for which they are today cited as evidence.

The Costa Rican talk of crime is fundamentally based on the assumption that crime rates have increased significantly in recent years and that there is today a vast and alarming amount of crime. On the basis of this assumption, fear of crime, the call for the “iron fist,” and drastic law enforcement actions are continually increasing. While crime statistics are the logical basis for the hypothesis on the far- reaching extent of delinquency, they are used in a problematic way in the talk of crime. In this paper I discuss Costa Rican crime statistics, their development, and their utilization in the talk of crime against the background of criminological theory. The theses of the paper are that a) the informative value of crime statistics regarding Costa Rican reality is far more questionable than the common utilization of them implies and b) when they are used as argumentation, these crime statistics do not provide evidence of the oft- proclaimed rising crime wave.
