Abstract:
Nearly two years have passed since the end of Colonel Qaddafi's dictatorship, but all is not well in Libya. What began as a popular uprising - that later gained international support through UN Security Council Resolution 1973 - has now turned into a potentially toxic security vacuum, culminating in the resignation of Chief of Staff Youssef al-Mangoush on 10 June and repeated clashes between civilians and a legalised militia in Benghazi which have left at least 35 people dead.

132. Fighting piracy in the Gulf of Guinea - offshore and onshore

Abstract:
Following a spectacular decline in the Gulf of Aden, incidents of armed robbery at sea and piracy (which legally refer to attacks beyond territorial waters) are now on the rise in the Gulf of Guinea. In 2012, the International Maritime Bureau's (IMB) Piracy Reporting Centre recorded 58 attacks, including 10 hijackings. Nigeria is the most affected country, with 27 attacks in 2012 (almost three times more than in 2011), and 11 already reported for the first quarter of 2013. Most of the attacks target vessels connected to the oil industry, but they also disrupt trade and transport in the region as a whole, thereby posing a security threat to the international community as well as African states.

Abstract:
Handbook is based on a workshop on the ratification and implementation of the Kampala amendments on the Crime of Aggression that took place at New York University on 25 June 2012. The workshop was co-hosted by the Permanent Mission of the Principality of Liechtenstein to the United Nations and the Global Institute for the Prevention of Aggression (recently affiliated with Middlesex University School of Law, London), with the support of the Liechtenstein Institute on Self-Determination at Princeton University (LISD). The handbook benefited further from the Colloquium «From Rome to Kampala – the first two amendments to the Rome Statute,» organized by the Belgian Interministerial Commission for Humanitarian Law on 5 June 2012 in Brussels. Part II of the handbook was drafted with the kind assistance of the International Committee of the Red Cross (ICRC).

Abstract:
In the media, news commentators continue to refer to Srebrenica as a lesson that should never be repeated again. Indeed, such “never again” statements have re-emerged in light of current events unfolding in Syria, as the international community debates what type of intervention should be used to stop further violence. The media have gone so far as to call the Syrian regime's possible use of chemical weapons against its population a “Srebrenica moment” — that is, a moment when moral outrage of civilian deaths leads to a push for military intervention (Lerman and Lakshmanan 2013). While little action has materialized in the case of Syria, the Srebrenican “never again” lesson is also far from being either agreed upon or learned from in Bosnia itself.

Abstract:
The police are one of the most critical institutions of the state. This is particularly true in nations emerging from conflict, which are characterized by insecurity and high levels of crime. Without security, governments cannot begin rebuilding their economies and improving the lives of their citizens. As a result, they will continue to struggle for legitimacy, and a return to conflict will remain an ever-present risk. A nation's military has an important role to play in dealing with external threats and establishing basic security in the immediate aftermath of conflict, but the police are the institution best suited for dealing with internal security and addressing the safety needs of the public. For citizens, a police officer is the symbolic representation of state authority. Their view of the state and their acceptance of its authority are partially shaped by their interactions with the police.

In post-Qadhafi Libya, the authorities are in search of a new art of governing. Despite the legitimacy accorded them by elections, they remain very weak. Without any means of coercion, they are constantly obliged to negotiate for their survival, threatened by those who were not chosen by voters but who instead draw their legitimacy from their participation in the revolution – the militias. The challenge facing the Libyan authorities is not so much to combat these forces but to harness them. Libya has not undertaken a process of “de-Qadhafication.” But for the militias, in particular the Islamists, the presence of former officials and leaders in the state apparatus is intolerable. Thus, on May 5, 2013 they pressured the parliament into passing a law excluding from politics persons who occupied positions of responsibility under the old regime. If the revolutionary brigades continue to impose their will on the government, the fall of Qadhafi’s regime will have not brought about political change in Libya but rather the continuation of former political practices under a new guise.

137. The Other Side of the Ergenekon: Extrajudicial Killings and Forced Disappearances

The Ergenekon Trial has been one of the most important political developments in recent Turkish history. The trial helped uncover the ways in which some groups in the military establishment and their political and economic collaborators in civilian circles were intervening illegally in democratic politics. When the trial revealed that the suspects had ties to the Susurluk scandal and to organizations that had committed extrajudicial killings of Kurdish civilians in the 1990s —the Yüksekova Gang, the Gendarmerie Intelligence and Counter Terrorism organization, and the Special Forces Command—there were heightened expectations among the public that grave violations of human rights committed during the 1990s, particularly against the country’s Kurdish citizens, would be brought to light. Yet the prosecutors and panel of judges in charge of conducting the investigation phase of the trial ignored these expectations as they prepared the criminal complaint, instead focusing solely on the charge of “attempting to overthrow the government.” A report published by the TESEV Democratization Program in November 2013, presented the public with an analysis of information found in the Ergenekon case files regarding the grave violations of human rights during the 1990s. The present work, an abridged version of this report, uses the most noteworthy information on murders by unknown assailants from the case files. We seek to present a general analysis of the Ergenekon Trial’s importance in Turkey’s confrontation with its past, to highlight its unprecedented nature in Turkish criminal-justice history, and finally to present our own recommendations.

Abstract:
The United States has unique experience fighting violent hate crime and discrimination, and the protection of the rights of lesbian, gay, bisexual, transgender and intersex (LGBTI) people has become a signature human rights initiative of the Obama Administration. In 2009, Congress passed the Matthew Shepherd and James Byrd Hate Crime Prevention Act, with bipartisan support and the endorsement of a wide range of constituencies with differing views on LGBTI equality. The law--and the coalition that supported it--is a model of how to marshal the range of U.S. resources to improve responses to all hate crime, including acts of violence based on sexual orientation and gender identity bias.

This policy brief proposes the concept of “chronic violence” to characterise the crisis of escalating social violence that currently affects about one-quarter of the world’s population. Based on an extensive analysis of literature on Latin America, the it advances six propositions to aid policymakers and other key stakeholders to recognise this significant – but largely ignored – phenomenon and to shift to a more productive approach that takes into account both its diverse drivers and its complex social consequences.

140. From impunity to prosecution? Sexual violence in Sudan beyond Darfur

Abstract:
Serious shortcomings in Sudanese laws and practices contribute to the lack of protection of victims of rape in Sudan. There is need for comprehensive legal reform, particularly of Sudan's Criminal Law of 1991. The categorisation of rape as a form of adultery does not result only in the virtual impossibility of convicting a rapist, but may even lead to the incrimination of the female victim of rape instead. This is particularly problematic considering the widespread use of sexual violence in the Darfur conflict. One of the encouraging consequences of the international attention on war rapes in Darfur is that women activists are increasingly positioning sexual violence against women as a concern on the national political agenda. Several legal reform initiatives are under way within the country among both state and non-state actors alike. The comprehensiveness of the reforms suggested differs in substance, but there is a consensus among both government and civil society actors that there is a need to differentiate between rape and adultery in current law. This consensus is extremely important, especially considering the sensitive and increasingly politicised and polarised debate on the topic. Although women face serious challenges in the Sudanese legal system, it is important to highlight how women activists are launching reform initiatives in order to bring justice to rape victims and to end the system of impunity for rapists. International donors can contribute a great deal in terms of supporting these reform initiatives and facilitating dialogue forums.
