331. Whistleblowing: an effective tool in the fight against corruption

Abstract:
Whistleblowing is increasingly recognised as an important tool in the prevention and detection of corruption and other malpractice. By disclosing wrongdoing in an organisation, whistleblowers can avert harm, protect human rights, help to save lives and safeguard the rule of law. The clandestine nature of corrupt behaviour means that it may never come to light unless cases are reported by people who discover them in the course of their work. But reporting can come at a high price: whistleblowers often expose themselves to great personal risks in order to protect the public interest. As a result of speaking out, they may lose their jobs, dampen their career prospects, and even put their own lives at risk. To provide a safe alternative to silence, TI recommends policy and legal measures to provide: Effective legal protection of whistleblowers against retaliation with full compensation in case of reprisals; Adequate mechanisms in public, private and not-for-profit organisations to ensure that disclosures are properly handled and thoroughly investigated; Public research, data collection, information and training to inform about the public benefit of whistleblowing.

Abstract:
Civil society organizations, epistemic communities, and lobby groups—what we call transnational norm-building networks—are influencing the global economy and global politics more than ever before. We argue that such transnational norm-building networks, in contrast to the dominating executive intergovernmental elites and democratically deficient supranational bodies, hold the scope and potential for a more civilized world order. They are—together with states and international governmental organizations—creating new norms; they are setting standards. They associate the voice of stakeholders with decision-making processes, thus leading to an increase in legitimate world governance.

The last 15 years have seen a remarkable change in the perception of corruption at both national and international levels, driven in large part by civil society organizations and watchdog groups. In the many countries where corruption is endemic, but where public discussion had been most limited, it has become the focal point of increasingly open campaigns by civil society and political parties. In the international arena, a series of conventions at both the global and regional levels have influenced corporate codes of conduct and the agendas of development finance agencies. This increased awareness has achieved a notable toughening of anti-corruption legislation in many countries and spurred changes in corporate behavior. But these achievements remain quite modest in relation to the overall scale of the problem. There remains woefully inadequate recognition of the ways corruption is intertwined with the larger necessities of eliminating poverty, halting climate change, and rebuilding failed states. What anti-corruption measures are now in place need to be vastly extended.

Counterterrorism has, in the last ten years, come to the fore of international relations, and remains in the news almost daily. This is due in large part to the ongoing conflicts in Afghanistan, Iraq, and Pakistan, which in turn have also prompted something of a backlash against such military or “hard” approaches to countering terrorism. Partly in response, states and civil society have sought out softer, often preventive, measures to deal with violent extremism, many of which have been deemed more successful than military approaches and less likely to foment a new generation of violent extremists. However, problems remain.

336. Bolivia's New Constitution: Towards Participatory Democracy and Political Pluralism?

In Bolivia, rights to increased political participation and the recognition of indigenous political systems are interrelated. The new constitution of 2009, a prime example of the “new Andean constitutionalism,” defines Bolivia as a representative, participatory and communitarian democracy. It incorporates enhanced mechanisms and institutions for participatory democracy. Moreover, new social rights have been anchored in the constitution and a plurinational state is supposed to be constructed. The article raises the question of whether the new constitution will change the relations between state and civil society considerably and whether a new democratic model is being established in Bolivia. I argue that there are many limiting factors when it comes to putting the emancipatory elements of the constitution into practice. These include the increased strength of the executive branch, the intent of the government to co‐opt civil society organizations and to exclude dissident views, the resistance of the conservative opposition to loosing some of its privileges, the deep‐rooted social inequality, the social conflicts and polarization, the resource dependence of the current economic model, and the authoritarian characteristics of indigenous self‐governance structures. The article demonstrates that the new Bolivian constitution cannot create a new society but that the processes around the elaboration of a new basic law have contributed to considerable changes in the social, political and symbolic order.

337. The DISCLOSE Act, Deliberation, and the First Amendment

The United States Supreme Court decided in Citizens United v. Federal Election Commission that Congress may not prohibit spending on political speech by corporations. President Obama and several members of Congress have sharply criticized Citizens United, and Sen. Charles Schumer and Rep. Chris Van Hollen have proposed the DISCLOSE Act in response to the ruling. DISCLOSE mandates disclosure of corporate sources of independent spending on speech, putatively in the interest of shareholders and voters. However, it is unlikely that either shareholders or voters would be made better off by this legislation. Shareholders could demand and receive such disclosure without government mandates, given the efficiency of capital markets. The benefits of such disclosure for voters are likely less than assumed, while the costs are paid in chilled speech and in less rational public deliberation. DISCLOSE also prohibits speech by government contractors, TARP recipients, and companies managed by foreign nationals. The case for prohibiting speech by each of these groups seems flawed. In general, DISCLOSE exploits loopholes in Citizens United limits on government control of speech to contravene the spirit of that decision and the letter of the First Amendment.

Good governance is key to improving peoples' lives; but the Arab world falls short on many governance indicators. Most Arab states remain highly authoritarian, although there is a growing dynamism in civil society and among opposition parties, both secular and Islamist. Problems in governance have impeded development in the Arab world and limited the achievement of the Millennium Development Goals.

339. Reforming the Inter-American Defense Board

Abstract:
The Western Hemisphere's delegations to the Inter-American Defense Board (IADB) should represent and be responsible to ministers of defense or their equivalents, rather than to the armed forces, as is the case in most countries in the Americas today. This breakthrough reform would bring the Board in line with democratic constitutional practices, strengthen Organization of American States (OAS) support for democracy, and help implement the 2003 Mexico City “Declaration on Security in the Americas,” which adopted a broadened multidimensional view of security. The reform could be accomplished without change to the March 2006 statutes and would bring the Board into the OAS General Secretariat associated with the Secretariat on Multidimensional Security.

All over the world, studies that rank countries by media freedom figure prominently in civil liberties debates, aid programming, foreign policy decisions, and academic research. The three most widely cited indexes—compiled by Freedom House, the International Research Exchanges Board (IREX), and Reporters Without Borders (RSF in its French initials)—often become media events in their own right on release day, written about by local newspapers and Web sites and analyzed on television and radio. In view of the breadth and depth of their impact, academics have been studying the quality of the social science that underlies these and other studies. Some academics claim deficiencies in such issues as methodology, cultural neutrality, and focus on “old media.” Yet many go on to conclude that whatever the shortcomings, the studies produce basically consistent findings over time and are credible, useful tools for tracking the evolution of media freedom in the countries of the world. They serve to highlight the crucial role of a free press in democracy and good governance.
