1. Implications of the Incursions into U.S. and Canadian Airspace

Abstract:
In the first half of February, a series of serious incidents happened in the airspace of the U.S. and Canada involving shootdowns of four objects, with at least one confirmed as a Chinese balloon, likely used for intelligence. The U.S. administration is conducting an investigation to explain the various platforms, the equipment onboard, and their mission. Because further incidents cannot be excluded, some changes in the rhetoric of the Chinese government should be expected, as well as a higher readiness of air defence networks of the powers.

Abstract:
Satellite constellations have become core elements of the digital transition. Over the next decade, several thousand satellites will have to be launched, to build these constellations. For positioning satellites, preferably in Low Earth Orbit (LEO), reliable and affordable launch services are essential. At the end of 2020, the European Space Agency (ESA) awarded three German space start-ups competing contracts in order to support its small-launch system. One may identify a change in Germany’s space policy, since the ESA Ministerial Council (MC) in Seville in late 2019. Besides supporting programs in its traditional fields of interest, Germany showed a special interest in supporting the Commercial Space Transportation Service acceleration program for the above-mentioned German space start-ups. This report is focused on a technical analysis of the market demands and the special commercial market conditions in LEO. It describes the competitive situation and, especially, the limiting conditions, which may hinder private investors from continuing to support a sound technical solution. These are: the size of the accessible market share, the natural risks of operating complex systems in a hostile environment, and the regulatory hurdles in acquiring formal approval by the authorities. A major factor for the expected business success is and will be the governmental support that the consortia can acquire.

3. The Hellenic air – space violations by Turkish aircraft: A statistical assessment and a forecast

Abstract:
This paper aims to assess the extent to which repeated attacks against sovereign Hellenic air space by Turkey along with the inevitably ensuing engagements between aircraft of the two sides follow a certain predetermined pattern of behaviour that can be detected based on a given statistical model, and if so, to what extent this pattern is predictable in terms of its intensity and the frequency of incidents. To this end, we use the Weibull statistical distribution as an appropriate tool for interpreting and quantifying the pattern of aggressive Turkish behaviour and calculating probabilities of occurrences. Based on this choice, we then proceed with a forecast of this behaviour in the near future. We provide specific mathematical formulae that can be readily used to calculate probabilities and forecast air space violations and engagements. Our models, based on historical data, assume that both Hellenic air space violations and engagement incidents will keep increasing but will inevitably reach a monthly maximum, constrained by the availability of property and human resources on the Turkish side. The conclusions drawn point to the fact that Turkey will at some point in the near future reach its capacity limits in terms of property and human resources used in such offensive exercises, and that there is very little that can be done to enhance the margins of such activities given the room provided by the Turkish economy, which seem to be prohibitive

4. Limitations in the airspace sovereignty of states in connection with space activity

The launch of the Soviet Sputnik in 1957 resulted in the emergence of two legal concepts concerning spacefl ight. The first of them concerned harmless passage through airspace subjected to the sovereignty of states, the second - recognition that at the height of the trajectory of a passage, space is no longer subject to the sovereignty of states (res omnium communis). In both cases, we are dealing with limiting the sovereignty of states. These issues have not been resolved to this day. The practice of spacefl ight has confirmed the freedom of spaceflight, although it has not resolved the issue of the upper limit of airspace. It is worth emphasising, however, that the decisive factor for the development of space law was the customary law that arose in 1957, because states did not protest and tacitly accepted the principle of a harmless flight.
