Abstract:
The Extractives Industries Transparency Initiative (EITI) seeks to improve transparency and accountability in the oil, gas and mining sectors. In countries participating in EITI, oil, gas and mining companies must publish what they pay to governments, and governments must publish what they receive. Parliaments play an essential role in working to ensure that oil, gas and mining resources benefit the public interest. The EITI reporting scheme offers many benefits to members of parliament including providing essential information on revenues, licenses, and production data for oversight purposes. This briefing provides an introduction to the EITI standard, and suggests questions and strategies for successful parliamentary engagement with the EITI.

Abstract:
This briefing paper summarizes the findings of an ICTJ report (by the same name) on the judicial response to international crimes in the Democratic Republic of the Congo. It makes substantive recommendations to justice stakeholders in the DRC on how to advance prosecutions of international crimes in domestic courts, based on the finding that the number of open investigations related to serious crimes remains very low compared to the magnitude of atrocities committed in the DRC. It is based on ICTJ research and interviews with Congolese prosecutors, judges, lawyers, and investigators; members of national and international civil society groups; and MONUSCO and UN personnel.

Abstract:
This paper describes proceedings in Uganda’s national courts against Thomas Kwoyelo, a former mid-level commander of the Lord’s Resistance Army, for war crimes and crimes against humanity. It analyzes the opportunities and challenges for the prosecution of serious crimes in Uganda and concludes with recommendations to enhance accountability in the country. In particular, it recommends that Uganda’s Amnesty Act of 2000 be repealed or amended to exclude individuals who bear responsibility for international crimes.

204. Squaring Colombia’s Circle: The Objectives of Punishment and the Pursuit of Peace

Abstract:
This paper weighs the possible modes and competing policy objectives of punishing FARC members for serious crimes in the context of Colombia’s ongoing peace negotiations. It argues that punishment has to occur in a way that does not damage one of the underlying objectives of the peace process, transforming the FARC from an insurgent group into a political actor. According to the paper, to meet policy objectives: 1) trials must be public, accessible, transparent, and serious; 2) punishment should include the possibility of offenders meeting with victims so that they can express their suffering; and 3) measures of punishment should include disagreeable consequences, such as financial penalties, asset seizure, temporary exclusion from political office, and community service orders, as well as reformative measures.

Abstract:
Corruption in Southeast Europe has been in the news, in the focus of public debate, and on the policy agenda of national and international institutions so often and for so long that its scrutiny hardly needs to be justified. It is precisely because it has proven to be such an intractable issue that innovative approaches to its understanding – and hence its reduction – are warranted. The EU accession prospects for the countries in the region – though distant – provide an enabling framework for action but it is local stakeholders, and in particular civil society who can bring about sustained progress in anti-corruption. The Southeast Europe Leadership for Development and Integrity (SELDI) has made the in-depth diagnosing and understanding of corruption and governance gaps in the region one of its main priorities, as a requisite condition for its advocacy of knowledge-driven anticorruption policies. This SELDI report fits in the development and implementation framework of the emerging regional anticorruption policy and infrastructure as exemplified by the SEE2020 Strategy’s Governance Pillar run by the Regional Anti-Corruption Initiative.

Abstract:
Being the result of collaboration within SELDI, this report is innovative in both its method and its process. It is the result of the application of a system developed by SELDI in the early 2000s for the assessment of both corruption and anticorruption, tailored to the social and institutional environment of Southeast Europe. This executive summary reviews Turkey’s findings and provides a number of recommendations to achieve further progress in limiting corruption. Güneydoğu Avrupa’daki yolsuzluk sorunu, üzerine sıkça haber yapılan, toplumsal tartışmaların odağında yer etmiş olan, hem ulusal hem de uluslararası kurumların sürekli ve uzun süredir siyasa gündeminde bulunan, sorunsallığı kanıksanmış bir meseledir. Yolsuzluğun bu kadar yaygın ve kolay kontrol edilemeyen bir sorun olmasından dolayı, meseleyi anlamaya ve dolayısı ile de azaltmaya yönelik yenilikçi yaklaşımlara gerek duyulmaktadır. 208. Accountability or not? Managing of public funds in Kosovo Security Sector

Abstract:
This study aims to analyze financial accountability of Kosovo security sector and advocate for its continuous enhancement. It is focused mainly on the current state of affairs and the trends in this sector. Therefore, the period of 2010-2013 serves as reference point for chronological perspective of this study. Whereas, the scope of this study is restricted to financial management, procurement and auditing of the following institutions: Ministry of Internal Affairs, Kosovo Police, Kosovo Ministry of Kosovo Security Force and Kosovo Security Force. Due to the institutional modalities and the lack of transparency as provided by the law, the research team has intentionally excluded from this study the Kosovo Intelligence Agency, even though it considers that the absence of financial transparency of this institution is in contradiction with the principles of accountability of public funds. The analysis reveals that general legal framework on financial management is also applicable to the security sector. Regardless of the existence of such legal framework, several weaknesses, may be detrimental to public funds as result of loopholes. One of the key dimensions in financial control is internal auditing, which is considered to be in its infancy. Audit units of the security institutions employs very small number of staff compared to the number of staff and volume of work in the financial sector. Therefore, the number of audits remains relatively small targeting only some of the most important areas. One of the main weaknesses of these institutions is the lack of solid written plans. There is also lack of efficiency in executing the expenses as defined in the agenda. This makes the supervision of expenses and financial management in security sector more problematic. Following the same lines, public procurement management is at a concerning stage. Identified problems are mainly related to the evaluation process, lack of clarity of specifications during the application process, as well as many other shortcomings in the supervision of public procurement in the security sector. On the other hand, out of all complaints taken by the Public Procurement Review Body, it 50% of complaints filed by various economic operators have resulted to be grounded on evidence by returning the tendering process to either re-evaluation or re-tendering.

209. Measuring Goal 16

Abstract:
This short paper identifies existing indicators that can be applied to measuring progress in targets for goal 16 for the SDG/post-2015 development agenda. It uses existing sources of information from previous expert meetings and consultations which identified mostly current available data sources. It assesses these existing data sources based criteria of practicality, if they are input, output or outcome oriented, and whether they meet statistical and normative criteria. This is intended to provide input into broader efforts to prioritize indicators and targets for goal 16 and to identify data gaps and overlaps. It is a draft paper that can be further developed in consultation with other key stakeholders providing input into the SDG/ Post-2015 development agenda. Goal 16 aims to ‘promote peaceful and inclusive societies for sustainable development, provide access to justice for all and build effective, accountable and inclusive institutions at all levels’. There are twelve key targets ranging from measures to reduce violence, strengthen institutions and increase the inclusiveness and accountability of institutions. The inclusion of goal 16 in the SDG/Post-2015 framework is a large step forward in recognizing the importance of peace, conflict and violence to the traditional development agenda of poverty alleviation. By analyzing each target and indicator area of goal 16 against a set of basic criteria including; practicality, orientation to preventative aims, objectivity and accountability, and on basic technical and normative principles, it may be possible to better prioritize particular indicators in the agenda.

Abstract:
Since its incipient stages in the early 2000s, the field of natural resource governance (NRG) has greatly evolved and expanded, with new actors, approaches and target issues proliferating in recent years. Focusing on a core group of organizations working on NRG, this brief maps and analyzes their work with an eye to identifying and detailing areas of overlap and potential synergy to inform programming, strategy and priorities moving forward. At the organizational level, it examines how and why organizations focus their work in particular ways, the tools and strategies they deploy, and their self-perceived comparative advantages. At field level, this brief investigates the perceived collective impacts of NRG efforts thus far, emerging priority areas, and gaps across work that has been done to date. Throughout, particular attention is given to how the Revenue Watch Institute carries out its work and is situated in the field.
