1. Resistance and Change in Form and Content of International Law: A Third World Perspective on Commodity Form Theory of International Law

Abstract:
Can Marxists, especially in the Third World, use international law for progressive social change? Responding to the Soviet Union's context and its jurisprudential challenges in constructing socialism, Pashukanis's seminal work on commodity form theory is nihilistic, assuming the very nature of form of international law as bourgeois with limited possibilities of radical change as its new content. European Marxism, on the other hand, in its context of revolutionary defeat and consequent postmodernist pessimism of cultural Marxism, either relies on Pashukanis's nihilistic position or a pragmatist and realist posture, insisting on staying within the law's bourgeois form and being content with social democracy. As opposed to this, Third World Approaches to International Law (TWAIL) scholars, while exploring the imperialist nature of international law and representing one variant of Third World Marxism, have been more optimistic, wanting to use international law to restrain and shield against powerful Western states, i.e., they believe that the content of Third World resistance can change the form of international law. This article deconstructs this class “content” of international law in the understanding of TWAIL and shows the postcolonial Third World states, and even in the yet to be independent states, were dominated by their dependent local elite, which had compromised by the ex-colonizers and had started blocking radical structural changes in Third World. Soon, the target of imperialism and the Third World elite became radical movements in the Third World, and this struggle of the marginalized shaped international law. Therefore, relying on the radical tradition of Third World Marxism and taking the right of self-determination as an example, this article argues that both the content and form of international law were simultaneously used, subverted, and changed in a dialectical and dynamic way by the resistance of the people of the Third World.

Abstract:
“All wars are fought twice, the first time on the battlefield, the second time in memory,” writes Pulitzer Prize-winning author Viet Thanh Nguyen.1 In the landscape of memory, language is the theater of war. Through language, we frame the narratives of our experiences and transmit those narratives for the historical record as individuals and collectives. The chronology and processes so profoundly articulated by Nguyen have merged in the recent decade such that combat on the physical battlefield does not necessarily precede the curation of narratives about the war. They now take place synchronously. Due to advances in digital media and communication technologies, the landscape, strategies, and potential combatants have outgrown geographic, physical, and temporal limitations. Civilians can now participate in military conflicts through digital and participatory warfare enabled by the hyperconnected battlefield of social media platforms. In parallel with actual fighting in combat zones and the official narratives of the states involved in war, new participatory modalities within a global digital battlefield are impacting the representation, perception, participa- tion, and memorialization of conflict. The mobilization of transnational human resources by diasporas can enlarge the scope of civilian participation in warfare, impacting war’s narration, cura- tion, and framing. In this current environment, language becomes the theater of war, not just within the post-combat landscape of memory, but also during combat—in the parallel digital battlefields of modern-day participatory warfare. It is, therefore, important to consider how language is viewed and used during war, particularly the heritage language of diasporan civilians. More specifically, we must assess the extent to which the heritage language is employed as both a symbolic and strategic tool in wartime transnational activism in processes through which diasporic identities are fashioned. In this essay, I examine the role of the Armenian language in the unprecedented transnational mobilization of Armenian communities across the globe during and after the 2020 Nagorno- Karabakh War.2 I argue that transnational actors (re)claimed the Armenian language as an act of resistance in the context of participatory warfare, which not only intensified the existing symbolic range of the Armenian language as a central identity marker, but also introduced a novel instrumental element for many Armenians.

Abstract:
Though economic sanctions are designed to weaken and isolate their target for the stated purpose of policy change, in the case of Iran they have often invigorated its desire to defy Western coercion and domination. Since the Islamic revolution this has led to multiple political standoffs, including notably during the Mahmoud Ahmadinejad administration and the post-nuclear deal standoff with the United States (US). Through sanctions, the West has often been unwilling to accept little less than a grand bargain on Iranian foreign policy, which has informed and contributed to a postcolonial narrative of resistance in the Iranian state. This narrative has served as an integral tool of Iranian statecraft in an effort to bolster the leadership’s legitimacy. By looking at elite discourse and Iranian government responses to the Iran Libya Sanctions Act during Ahmadinejad’s government and the Trump Administration’s Maximum Pressure campaign, this article highlights narratives of postcolonial resistance in Iran’s response to US sanctions, in an effort to explain why sanctions often push them further away from acquiescence to international norms.

Abstract:
Ukraine has received tens of billions of dollars worth of military aid since the Russian invasion began one year ago. The international consensus seems to be that supporting Ukraine means financing its war effort. But a few dissenting voices have emerged of late, more ambivalent about the prudence—and ethics—of the current policy. Colonel Douglas MacGregor, a former advisor to the US Secretary of Defence, has warned that the choice of cure could turn out to be worse than the disease. At least 7,000 Ukrainian civilians have already perished in the war. Thousands more have been injured, and millions have been displaced. MacGregor’s primary concern is that the bleeding will continue for as long as the fighting does. Russian forces advance, Ukrainian forces resist with violence, Russia responds with counter-violence, and the bodies continue to pile up. The Ukrainian state retains its sovereignty, but eventually we get to a point where, to quote MacGregor, “There are no longer any Ukrainians left!” This is hyperbole, of course, but that should not distract from the valid point MacGregor is making. States exist for the sake of their citizens, not the other way around. Therefore, if a given method of defending the state is causing its citizens to be killed or to flee en masse, that is a compelling reason to explore alternatives.

In this publication, we are setting out to recover histories, struggles, and resistance in Latin America and place ourselves in moments of the history of Nuestra América 1– ‘Our America’ – when women have been on the front lines of the battle to build a more just world. This history encompasses an enormous diversity of sectors, geographies, climates, flavours, and sounds, an entire universe of people, of dissidents, who, step by step, have walked the path of history. We are setting out on a path to recover the history of struggles, resistance, insurrections, and revolutionary dreams that have been led by women and LGBTQ+ people throughout the region at different times in order to find the seeds of the popular Latin American feminisms that exist today. These feminisms emerge from popular, collective struggles that are born as vital means of self-defence on the fringes of the peripheries. To speak of popular feminisms in Latin America and the Caribbean means thinking about all that women and LGBTQ+ people do every day as they fight for the common good in places where precariousness prevails. It is to speak of that intersection where the communal becomes a fundamental space to guarantee life, always in tension with the pedagogy of cruelty that governs our societies. Popular feminism raises the banner of the collective over the individual; it transforms everything that must be transformed for the decent life that the ‘nobodies’ deserve. In addition to being organisers and leaders of national processes in various social sectors, popular feminists have set to work vigorously alongside hundreds of comrades to create and sustain a continental platform of social movements as part of the Bolivarian Alliance for the Peoples of Our America, or ALBA (which translates as ‘dawn’). Founded one dawn on Venezuela’s Margarita Island by Hugo Chávez and Fidel Castro, ALBA is a polysemic concept that is dear to our region. The continent’s platform of popular organisations, known as ALBA Movimientos, seeks to understand the continent’s current context through the eyes of struggle and mobilisation. Of course, in order to do this, it is essential to have material that reclaims the history of the struggles of the women and dissidents of Nuestra América who preceded what today is a struggle for the transformative power of history in every corner of our region.

The twentieth century was marked by national liberation struggles that emerged in Africa and Asia, as well as in Latin America, where neocolonial structures had subordinated the formally independent countries. The achievements of the Russian Revolution in 1917 inspired the peasantry and the working class across the Global South. The fight for equality and liberation under the leadership of working people is ongoing in the anti-imperialist struggles of our time. Women, in a myriad of ways, have powerfully shaped and continue to shape all of these struggles. In the Women of Struggle, Women in Struggle series of Tricontinental: Institute for Social Research, we present the stories of women in struggle who contributed not only to the wider arena of politics, but who also pioneered the establishment of women’s organisations, opening up paths of feminist resistance and struggle throughout the twentieth century. Praxis, as a knowledge of theory and organisational methods of struggle as they change and respond to history, gives sustenance to ongoing struggles against oppression. As militants, we study the diverse lives, contexts, and organisational methods of these women not only to better understand their political contributions, but also to inspire us as we build the organisations necessary to win the fight against oppression and exploitation today. In the fourth study of this series, we discuss the life and political struggles of Josie Mpama (1903–1979), a leader in the resistance against colonial oppression and the apartheid system in South Africa. Josie was a key figure in the history of women organisers in South Africa and a leader in the Communist Party of South Africa. Her life teaches us about the importance of grassroots and mass organising, as well as the challenges that come with that work. Like so many women involved in radical politics, particularly in the Global South, Josie’s extraordinary political contributions and theoretical acumen have been overlooked and largely excluded from the mainstream historical record.

Abstract:
Urban politics has received growing attention in the anthropology, sociology, and political science of the MENA region. In line with global trends, questions of scale, territory, flows and connectivities and materialities have come to the fore, with a wide range of creative and novel lines of inquiry connecting the global to the hyper-local and every scale in between. In February 2023, POMEPS partnered with the Beirut Urban Lab at the American University of Beirut and The Policy Initiative think tank for a workshop in Beirut to bring together an interdisciplinary group of young scholars from across the region to explore questions of urban life, politics, and culture. The papers moved beyond more traditional political science topics such as municipal government, decentralization, clientelistic voting, protests, and clientelism. While those themes certainly operated in the background, the authors assembled in Beirut pushed to shift the lens towards multi-scalar ethnographic modes of inquiry, highlighting the materialities and relationalities of the hyper-local, examining sites and places which concentrate power dynamics.
