Emphasising the integral role of community legal instruments in mitigating potential conflicts, the discussion extends to the challenges that hinder comprehensive adherence to international water conventions. Abstract:
China’s economy underwent regulatory, structural as well as spatial makeovers since the increase of opening up and reforms in 1978. Intermittent policy interventions have been implemented by the Chinese state to ensure that the economy plays a vital role. Relatedly, the Communist leadership’s economic perspective was shaped by two key attributes: ideology and functionality (pp. 8, 11, 42, 119, 148, 313, 314). From an ideological perspective, the legacy of reforms was as crucial as the equitable principle of Communist rule in China, as both ensured the party’s survival and its control over the state. From a functional perspective, the state’s performance remained an essential indicator for China to achieve economic growth and improve the living conditions of its people. In his book, Between State Capitalism and Economic State Craft: China INC, China expert Aravind Yelery captures the systemic reflections of these transitions, mapping how the state fused growth and encouraged further opening to help China manifest its rise. The book delves into China’s growth models examining how these contradictions are ‘chosen ones’ and how China aims to rally its economic statecraft globally. The central crux is the Communist Party of China’s (CPC) authority retention over the economy by preventing the state from giving up control over important sectors and industries. State-Owned Enterprises (SOEs) played a vital part in achieving this goal in China’s economy, allowing the CPC to control governance. Thus, the chapters are significantly interconnected enlightening on the ascendancy of capitalist approaches in the CPC, exploring how China managed to defy the decline experienced by previous communist regimes. The explanation of SOEs is presented as a key factor in establishing effective domestic economic controls, ultimately enabling China to exert its dominance in global economic affairs.

24. Uganda’s Oil Refinery: Gauging the Government’s Stake

Abstract:
Uganda’s planned oil refinery will have several benefits for the country, including for its security of fuel supply and balance of payments. The refinery could be reasonably profitable, generating an internal rate of return of 13 percent in a baseline scenario. The government is planning to take a 40 percent stake but may ultimately pay a higher price for this equity than it expects. Even if it borrows to cover its upfront contribution to costs, it will need to divert around $330 million in present value terms from the national budget for loan repayments in the 2030s. This price will increase if downside risks, such as cost overruns or lower global oil prices, materialize. The government can take several steps to increase interest from other investors, including by reducing the risk of cost overruns, ensuring deregulated product prices continue, and providing less risky forms of state support such as tax incentives. These should reduce the need for the government to take a large stake.

Abstract:
2023 saw a boom in generative Artificial Intelligence (AI). However, such a rapid expansion revealed the unpreparedness of governments to handle the unprecedented impact AI systems have on the core values of democratic societies. The European Commission’s AI Act has emerged as the first binding legislation of its kind. It is already clear, however, that simply ratifying the Act will not solve the next challenges. Among those, the immediate one is to ensure that the new AI rulebook is enforced on the national level and that Member States have the resources necessary. Then, the Act, and any future AI legislation, will need to constantly adapt to the ever-changing developments in technology, which now seem to move at a faster pace than ever before. Interdisciplinary approaches and new research disciplines will be needed to analyse the correctness and safety of AI systems, as well as to evaluate their impact on society. Last but not least, the private sector — already employing or only exploring the possibility of introducing AI systems — will need strong support to remain compliant. This brief outlines the state of the EU’s AI Act, discusses concerns within Europe, examines the position taken by the Estonian technology sector and government, and explores the future direction the regulation might take.

As ASEAN’s digital economy continues to expand, the region faces escalating cybersecurity risks with significant potential costs. This policy brief examines ASEAN’s current cybersecurity landscape, underscoring the need for enhanced cooperation and comprehensive strategies to address the rising threat of cyberattacks. The economic impact of cyberattacks in ASEAN is already substantial, affecting both public and private sectors. This brief reviews existing efforts such as the ASEAN Cybersecurity Cooperation Strategy 2021–2025 and the ASEAN Regional Computer Emergency Response Team (ASEAN CERT), recommending the establishment of a shared cybersecurity taxonomy, capacity-building initiatives, and legal framework updates to bolster cybersecurity. Key policy recommendations encourage robust multi-stakeholder collaboration at national and regional levels.

Abstract:
This policy brief discusses the implementation and impact of the Online Single Submission (OSS) system in Indonesia, developed under the auspices of the Indonesian Investment Coordinating Board or Ministry of Investment (BKPM), which has streamlined the business licensing process and improved regulatory quality. The OSS system serves as a centralised platform for businesses to register and acquire licenses, particularly benefiting micro, small, and medium-sized enterprises (MSMEs). The digital economy in Indonesia, especially the e-commerce sector, is experiencing significant growth, with projections indicating substantial increases in gross merchandise value (GMV). The OSS system has positively impacted Indonesia's regulatory quality and improved the perception of the government's competence in supporting the private sector's growth. This policy brief recommends enhancing the implementation of the OSS system, promoting public participation, facilitating interagency coordination, and conducting regular monitoring and evaluation to assess the impact of Good Regulatory Practices (GRP) as implemented within OSS system on e-commerce sector.

Global cybersecurity regulation is fragmented, inefficient, and often ineffective. More than 60 countries are implementing an array of legal frameworks, making it difficult to regulate cyber practices across borders. Costly on many levels, inconsistent regulations and varying compliance standards allow bad actors to seek out gaps in the system and facilitate attacks that span geographies. With the current amplification and intensity of cyber threats, government and industry need to share tactics, techniques, and procedures with each other as well as with partner nations. If the field doesn’t achieve a higher degree of harmony in the global regulatory landscape, multiple dimensions will remain inefficient and costly: operations, risk management, research and development, and more. In A Security Symphony, Aspen Digital’s Global Cybersecurity Group calls for establishing regulatory harmonization principles, with a focus on collaboration and standardization. The principles span the core categories of interoperability and transparency, market competition, and mutual recognition frameworks. 29. The Growth of Private Financial Markets

Abstract:
Over the past decade, “private” financial markets, which face little oversight by regulators, have grown to the point where they dominate financial activity. Private funds have approximately tripled in size in the last decade to $26 trillion in gross assets (compared to the $23 trillion in the U.S. commercial banking industry). Private markets raise more in equity than public markets: in 2021, new stock issuances resulted in $434.7 billion, while private markets raised $1.73 trillion in committed funds that same year–almost four times as much. Private markets are structured differently–organized into funds by asset managers as limited partnerships, which shields general managers from liability. The primary dealers in these private markets are venture capital, private equity, private credit funds, and private real asset managers. In this working paper, we examine four institutional shareholder types: public and private pension funders, endowment plans, and foundations. Institutional shareholders now allocate 28-35% of their assets under management to the “alternative” assets of private markets. Pension funds alone currently account for $2.7 trillion in committed funds to private financial markets, the latter of which has ballooned to $26 trillion in gross assets. This development potentially represents new systemic risks to the economy at large and for the institutional shareholders participating in these markets.

Abstract:
A spirited debate is taking place over the regulation of open foundation models—artificial intelligence models whose underlying architectures and parameters are made public and can be inspected, modified, and run by end users. Proposed limits on releasing open foundation models may have significant defense industrial impacts. If model training is a form of defense production, these impacts deserve further scrutiny. Preliminary evidence suggests that an open foundation model ecosystem could benefit the U.S. Department of Defense’s supplier diversity, sustainment, cybersecurity, and innovation priorities. Follow-on analyses should quantify impacts on acquisition cost and supply chain security.
