Big Tech is powerful and its profits are growing - by 105% over the last year. It dominates economies. This raises concerns about data protection and privacy, anti-trust, fintech and the specific role of intermediaries. India is leading the way on fintech, but is behind several countries and institutions on digital rules. It is important to establish laws and rules to govern technology – whether domestic or through multilateral bodies – with the aim to strike the right balance between innovation and regulation.

Abstract:
NRGI’s corruption diagnostic tool aims to support anticorruption actors as they tackle the complex and sensitive challenge of extractive sector corruption. Drawing on extensive sector-specific analysis, the tool enables its users to: Gather evidence and convene consultations to identify the forms of corruption most likely to negatively impact their country’s extractive industries; Diagnose the causes of these forms of corruption; Build an evidence-based anticorruption action plan, focused on preventing future corruption. The tool prioritizes multi-stakeholder participation, and its flexible approach allows users to adapt the content and process to meet their needs.

Abstract:
One of the priorities of Tanzania’s new president is negotiating a way forward for the country’s long-planned offshore gas project. A key issue in this negotiation is the amount of gas that the government will take in the form of a domestic supply obligation (DSO). To increase the country’s energy supply, it wants a larger DSO than the currently agreed amount of around 8.5 percent of reserves. This report analyzes the implications of a larger DSO for meeting Tanzania’s energy needs, for the offshore project and the government revenues it can generate. It builds on previous NRGI analyses by the authors.

Abstract:
The European Parliament and the Council of Ministers of the EU recently reached an agreement on COVID-19 certificates designed to facilitate travel and help revive tourism in Europe. Although the certificate is expected to greatly simplify travel within the EU, its large-scale deployment is not without scientific, legal, and ethical challenges. The current analysis sheds light on the main tenets of the agreed EU framework and highlights the positions and initiatives of the main stakeholders. It also examines the major ethical and legal questions associated with the release of the certificate and makes a series of recommendations that could contribute to the efficient handling of some of these challenges so as to ensure a socially-responsible and effective use of this new EU instrument.

Abstract:
Historically, Senegal has experienced significant “implementation gaps” between rules and implementation of these rules in its petroleum licensing process. Causes have included lack of legal clarity, duplicative and conflicting institutional roles, and lack of institutional capacity. However, Senegal has made good progress on closing this implementation gap. As of 2020, Senegal’s implementation gap in the petroleum licensing process as measured by the Resource Governance Index is very small and reflects recent government reforms, investments and disclosures. Despite major progress in closing the implementation gap in the licensing process, Senegal has significant room for improvement in the transparency of the oil and gas licensing process. Senegal’s government should work to improve laws on the disclosure of assets of public officials and the disclosure of the identities of the beneficial owners of companies applying for and obtaining licenses.

Abstract:
Supply chain regulation can be a formidable tool to protect a country’s resilience against unexpected disruptions of trade, investment and the supply of skilled labour. Its utility, however, may erode when geopolitics rather than economics becomes the primary objective. This paper examines the implementation problems and the unintended consequences of a new supply chain doctrine in the service of geopolitics, with a focus on US President Joe Biden’s Executive Order on America’s Supply Chains to protect US technological leadership and national security against China. With semiconductors as a primary target, America’s supply chain controls are designed to exploit China’s most glaring weaknesses as supply chain chokepoints that the US Commerce Department can block, thus impeding timely and cost-effective access to essential products, services and technologies. The paper also highlights a second defining characteristic of America’s supply chain doctrine — regulatory supply chain controls are combined with a big push in domestic semiconductor manufacturing. Three propositions are presented as guideposts for further research. The paper concludes with a brief discussion of the implications for future US supply chain control against China: Will the quest for improved supply chain resilience succeed in mobilizing enough forces to shift the focus of US policy away from supply chain regulation in the service of geopolitics?
