41. The State of Transitional Justice in Africa: Report on the Third African Transitional Justice Forum

Abstract:
The Third African Transitional Justice Forum, held on 24–26 September 2019 in Addis Ababa, Ethiopia, followed the February 2019 adoption of the African Union Transitional Justice Policy (AUTJP), a guiding framework for African Union member states emerging from violent conflicts or repression and establishing transitional justice processes to address past abuses and promote sustainable peace and inclusive development. The Forum focused on the AUTJP's eleven constitutive elements: Peace Processes; Transitional Justice Commissions; African Traditional Justice Mechanisms; Reconciliation and Social Cohesion; Reparations; Redistributive (Socio-economic) Justice; Memorialisation; Diversity Management; Justice and Accountability; Political and Institutional Reforms; and Human and Peoples' Rights. It aimed to popularise the AUTJP and deepen participants' understanding of the policy.

This policy paper draws from the discussions of the Fourth African Transitional Justice Forum, held on 26–28 October 2020 under the theme "Silencing the Guns in the Context of COVID-19: Progress, Problems and Prospects." Following an overview of the growing threat posed by violent extremism in Africa, the paper highlights limitations of militarised approaches. It further builds a case for mobilising transitional justices measures to address violent extremism, and proposes the tools enshrined in the African Union Transitional Justice Policy (AUTJP) as a viable option.

Abstract:
The African Union (AU) declared 2020 the year of "Silencing the Guns: Creating Conducive Conditions for Africa's Development." The motivation for this theme was to provide impetus for activities to advance the 2013 Solemn Declaration to realise a conflict-free Africa by 2020. This policy paper argues that the AU and its member states must maintain fidelity to the noble objectives of the Solemn Declaration and utilise the extended 10-year period for the AU Master Roadmap on Practical Steps to Silence the Guns by the Year 2020 to ensure that actionable programmes which further peace, security and justice are achieved. A lot of normative progress has been achieved in the last decade, as the 2019 adoption of the AU Transitional Justice Policy indicates, yet the persistent challenge lies in the effective implementation of these instruments at the regional, national and local levels.

In 2016, the Colombian government and the Revolutionary Armed Forces of Colombia (FARC) signed a peace agreement after three years of negotiations and at least four failed peace talks since 1982. The implementation of the peace agreement has been monitored and verified by international actors with technical, humanitarian and financial resources to promote peacebuilding and reconciliation. This Brief examines the challenges of implementing the peace agreement and explores how the European Union can support the implementation process and reconciliation efforts in Colombia. The Brief analyses first the state of play in the implementation of the peace agreement and its main challenges. Secondly, it presents an analysis of local-level violence. Thirdly, it highlights how peacebuilding and reconciliation efforts can mitigate local conflict dynamics. Finally, it concludes with policy implications and recommendations for supporting the implementation of the peace accord and shows how the EU can positively contribute to peacebuilding and reconciliation at the local level.

Abstract:
The prospect of achieving a bizonal, bicommunal federal solution to the Cyprus problem was dealt a blow in the summer of 2017 when the unification talks between the two sides were suspended. The deterioration of the climate since then and the concomitant danger of abandoning the UN framework for a solution amid Turkey’s and the T/C side’s apparent insistence on a two-state solution, underscores the necessity to sketch out the convergences that have reportedly been achieved as well as the most significant issues on which the divergences appear to be bridgeable. Ahead of the upcoming informal five-party meeting on the Cyprus issue and the challenge of “rebooting” Crans Montana, this paper briefly outlines these issues based on a recently released UN document, indicating that they form an integral part of the elusive signposts towards a final settlement. Moreover, it refers to a number of ongoing and new civil society initiatives in support of peace and reunification.

Abstract:
The southern city of Daraa was the birthplace of the peaceful Syrian uprising that started in March 2012. This genuine Syrian movement was met with accusations of conspiracy and vandalism by the Government of Syria (GoS), whose aggressive responses provoked similar reactions from local population. The Houranian people (Daraa city residents), who are known for their peacefulness and sensitivity towards strangers, detested the militarization of the uprising, and they resisted the increasing presence of foreign armed elements (Hezbollah, Nusra Front, ISIS). The feeling of loss of their identity and space to outsiders was acute. The reconciliation with the GoS came about through negotiations with the Russians in mid-2018. Houran people took it as an opportunity to avoid a costly military confrontation with the GoS, restore peacefulness, and expel the foreign militias. This author was part of the negotiations and involved in deliberations at many junctures, and this testimony was prepared in consultation with the principal members of the reconciliation negotiations with the Russians and the GoS.

Abstract:
Alternative Dispute Resolution (ADR) mechanisms have been the common practice to resolve various conflicts in general and blood feuds in particular in the Amhara national regional state. As such, the central objective of this study is to assess the interface between ADR and the formal criminal justice system when addressing blood feuds. To achieve this, an ethnographic research approach was used. As the finding reveals, shimglinaas the common indigenous resolution mechanism of blood feuds has been widely used. In this reconciliation process, we identified diagnosis, initiation, forgiveness and the oath as essential phases. Concerning the previous interfaces between shimglina and the formal adjudication system, the reconciliation decisions made by shimglina had been accepted and taken for granted by the formal adjudications. But now this trend has been changed due to interference by formal adjudication on the process and implementation of ADR decision-making.
