71. Public Policy: An Amorphous Concept in the Enforcement of Arbitral Awards

Abstract:
Public policy permeates the legal principles of a state and its ruling government. The justification of public policy is topical to the ethics and canons acknowledged by that state. These values are determined by the applicable political, social, economic, religious, and legal systems, which differ among states. As public policy usually best illuminates the broad area of government laws, regulations, provincial ordinances, and court decisions, the standards creating public policy alter as states develop. The motif of public policy is critical when the question of enforcement of arbitral awards suffice. There is no definite meaning of the term in the famous Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York Arbitration Convention) to enforce foreign arbitral awards. Hence, this paper explores and traces some contemporary trends in defense of public policy as an exception to the enforcement of arbitral awards worldwide.

Abstract:
As cities and urban settlements grow and are home to increasing numbers of people, the problems related to drug policies are becoming more visible and dire in cities around the world. Mayors and municipal councilors, the closest policymakers to their constituencies, increasingly have to respond to the presence of the illegal drug market and to the negative outcomes of national repressive drug policies. While they are not mandated with drug control policies, cities have been able to provide the most innovative and protective drug policies, policies that have inspired the adoption by the national institutions of policies such as harm reduction, effective prevention and peaceful law-enforcement. The members of the Global Commission on Drug Policy, many having been mayors and municipal councilors, provide their analysis and recommendations on drug policy at the municipal level, and how pragmatic reforms on the ground can effectively address a top-down policy such as drug control.

Abstract:
The publication aims to analyze public security and public order in conceptual and institutional terms as an analytical category of security sciences. The legislator defines neither public security nor public order. So far, they have been treated mainly as categories of administrative law. It is therefore important to assign them analytical content in the new scientific discipline. The research results allowed for the presentation of the thesis that public security and public order are mainly connected with protection against pathological phenomena occurring in the public space, which are minimized by institutions established to ensure it. These categories should constitute the research field (subject) of the security sciences. The research problem formulated in the form of the question: How are public security and public order treated in definitional and institutional terms? The problem was solved based on a critical analysis of the literature. The paper uses theoretical research methods, including analysis of literature and phenomena occurring in society and inference – as a cognitive factor of the subject of analysis. A critical analysis of the literature on this issue played a large role in the cognitive process.

74. Lockdown Fatigue: The Diminishing Effects of Quarantines on the Spread of COVID-19

Abstract:
Non-Pharmaceutical Interventions (NPIs) have been for most countries the key policy instrument utilized to contain the impact of the COVID-19 pandemic. In this article, we conduct an empirical analysis of the impact of these policies on the virus’ transmission and death toll, for a panel of 152 countries, from the start of the pandemic through December 31, 2020. We find that lockdowns tend to significantly reduce the spread of the virus and the number of related deaths. We also show that this benign impact declines over time: after four months of strict lockdown, NPIs have a significantly weaker contribution in terms of their effect in reducing COVID-19 related fatalities. Part of the fading effect of quarantines could be attributed to an increasing non-compliance with mobility restrictions, as reflected in our estimates of a declining effect of lockdowns on measures of actual mobility. However, we additionally find that a reduction in de facto mobility also exhibits a diminishing effect on health outcomes, which suggests that lockdown fatigues may have introduced broader hurdles to containment policies.

Abstract:
The enthusiasm for the potential of RCTs in development rests in part on the assumption that the use of the rigorous evidence that emerges from an RCT (or from a small set of studies identified as rigorous in a “systematic” review) leads to the adoption of more effective policies, programs or projects. However, the supposed benefits of using rigorous evidence for “evidence based” policy making depend critically on the extent to which there is external validity. If estimates of causal impact or treatment effects that have internal validity (are unbiased) in one context (where the relevant “context” could be country, region, implementing organization, complementary policies, initial conditions, etc.) cannot be applied to another context then applying evidence that is rigorous in one context may actually reduce predictive accuracy in other contexts relative to simple evidence from that context—even if that evidence is biased (Pritchett and Sandefur 2015). Using empirical estimates from a large number of developing countries of the difference in student learning in public and private schools (just as one potential policy application) I show that commonly made assumptions about external validity are, in the face of the actual observed heterogeneity across contexts, both logically incoherent and empirically unhelpful. Logically incoherent, in that it is impossible to reconcile general claims about external validity of rigorous estimates of causal impact and the heterogeneity of the raw facts about differentials. Empirically unhelpful in that using a single (or small set) of rigorous estimates to apply to all other actually leads to a larger root mean square error of prediction of the “true” causal impact across contexts than just using the estimates from non-experimental data from each country. In the data about private and public schools, under plausible assumptions, an exclusive reliance on the rigorous evidence has RMSE three times worse than using the biased OLS result from each context. In making policy decisions one needs to rely on an understanding of the relevant phenomena that encompasses all of the available evidence.

Abstract:
The educational system in Greece has always been at the center of public discourse, not only for the shortcomings of its design, but also for the quality of the education offered. In this context, during the last decades, the rise in wage inequalities had led the literature to investigate the existence of a possible causal relationship between the level of education and income inequality. The present paper by Pery Bazoti examines the relationship between tertiary education and economic inequality. Taking into consideration the fact that potential inequalities in access to education can hinder the redistributive role of education, the starting point of the study is the access to tertiary education. The design and flaws of the Greek education system prevent university candidates from equal opportunities since the entrance to tertiary education institutions relies heavily on the economic background of their families. The economic crisis highlighted these inequalities mainly through the decline of the disposable household income and exacerbated the already crippled abilities of the education system due to the extensive cuts that took place during this time. Nevertheless, the data reveals that private expenditure -typically related to students’ preparation for exams for entrance into university, despite its decrease, continues to have the larger share of the households’ education budget.

Abstract:
This report is based on findings from the BrExpats research project, funded by the Economic and Social Research Council through UK in a Changing Europe Initiative (Grant Number ES/R000875/1). This was a longitudinal study of Brexit and its implications for UK nationals living in other European Union member states. From May 2017 until January 2020, the project team tracked the Brexit negotiations and what they mean for the political rights, social and financial entitlements, identity, citizenship and belonging of Britons living in the EU-27. In particular, the project team documented how the protracted uncertainties about what Brexit means for citizens’ rights—the rights and entitlements derived from exercising Freedom of Movement—were experienced by UK nationals living across the EU-27, and with what consequences for their ongoing emotional and practical choices.
