Blockchain technology can autonomously perform transactions across various industries and sectors without human involvement, revolutionizing how people do business. These transactions are performed through smart contracts, which consist of coded commands on the blockchain. This paper looks at how to enforce these autonomous agreements using blockchain online terms of use, focusing on common law jurisdictions, specifically Canada. Some of the advantages of buying and selling on the blockchain include reduced business-to-business transaction costs, automated business-to-consumer transactions and the ability to perform traditional services in new ways.

Abstract:
Democracy thrives on the vibrant exchange of ideas, transparency, and confidence in government institutions. Corruption can have disastrous effects on democracy, from derailing a government’s response to a public emergency to driving distrust in democratic institutions and damaging the credibility of governments, both at home and abroad. Holding governments accountable and limiting opportunities for abuse is instrumental to maintaining public trust and to helping countries weather shocks to democracy. Independent governmental institutions – including Supreme Audit Institutions, National Human Rights Institutions, Anti-Corruption Authorities, Ombuds Institutions, and Election Management Bodies — are an essential part of the democratic fabric. These institutions should serve as guardrails to keep democracy on track, but, absent safeguards, can become ineffective, irrelevant, or even tools for state capture. This Guide draws on IFES’ evidence-based Autonomy and Accountability Framework (AAF) to support an assessment of threats, risks, and weaknesses in the autonomy and accountability of independent institutions at any stage of establishment or development. An institution can use the assessment to help insulate itself from political interference and conflicts of interest, shore up its ability to execute its mandate effectively and efficiently, and build or preserve public trust. The AAF also provides a blueprint for legislatures seeking to enshrine effective protections for new institutions in the law. This Guide can be used by an institution on its own or in collaboration with partners to conduct a thorough, introspective review of its own autonomy and accountability mechanisms, or by a civil society organization seeking to advance the work of a specific institution or inform the design of advocacy campaigns. Constitutional or legal drafting committees might also find this resource useful to identify key elements for reform. The Guide includes a series of question sets to identify and understand strengths and threats to autonomy and accountability, and to assist in identifying the specific considerations that may apply given the institution’s unique mandate, structure, or legal context. The Guide also includes sample strategies to fill the gaps identified in the assessment and build institutional resilience.

3. Addressing the Continuing Phenomenon of Enforced Disappearances

Abstract:
An enforced disappearance is the “arrest, detention, abduction or any other form of deprivation of liberty” by state agents or their proxies, followed by a refusal to acknowledge or disclose the fate of a seized individual. Unlike arbitrary detention, which may also involve arrest and inhumane treatment, enforced disappearances frequently leave families with no information as to the victim’s whereabouts or status. In many cases, it is ultimately revealed that the victim was killed rather than detained. Enforced disappearances violate multiple human rights, including the right to security and dignity of person; the right not to be subjected to torture or other cruel, inhuman, or degrading treatment or punishment; the right to liberty; the right to humane conditions of detention; the right to a legal personality; the right to a fair trial; the right to a family life; and the right to life. The phenomenon of enforced disappearances first emerged as a state practice during the Nazi era but became widespread under the military regimes in Latin America during the 1960s. The Commission for Historical Clarification in Guatemala found that from the mid-1960s until the 1996 peace agreement, security forces and “death squads” carried out approximately 45,000 enforced disappearances against anti-government forces and suspected opponents, including members of Mayan communities. The governments of Argentina, Chile, Uruguay, Paraguay, Bolivia, Brazil, Ecuador, and Peru developed a transnational cooperation mechanism called “Operation Condor” to share intelligence about political dissidents for the purposes of carrying out transnational enforced disappearances. The practice of enforced disappearances was soon taken up by governments in other parts of the world, as well. In Sri Lanka, for example, Amnesty International estimates that there have been “at least 60,000 and as many as 100,000 cases of enforced disappearance” since the 1980s. The problem persists today, occurring at a large scale in many countries in the context of both armed conflicts and repressive, unaccountable regimes. The Syrian Network for Human Rights reported that from 2011 to 2021, the Syrian regime carried out 102,000 disappearances to suppress dissent during the civil war. Meanwhile, China’s Residential Surveillance at a Designated Location (RSDL) decree empowers authorities to detain foreign or Chinese nationals for a period of six months without disclosing their location. A Spain-based rights group, Safeguard Defenders, claims that between 27,000 and 57,000 people have gone through China’s RSDL system since 2013, citing data from the Supreme People’s Court and the testimony of survivors and lawyers. Altogether, the United Nations Working Group on Enforced or Involuntary Disappearances (UN Working Group) has recorded more than 59,000 cases of enforced disappearances across 110 countries since 1980, including 651 new cases originating in 30 countries in its most recent annual report. More than 46,000 cases remain unresolved. The international community was slow to respond to the growing problem of enforced disappearances, initially addressing the problem only as part of broader “ad hoc working groups” on human rights issues in countries like Chile and Cyprus. It was not until 1992 that the United Nations General Assembly adopted the Declaration on the Protection of All Persons from Enforced Disappearance, which condemned acts of enforced disappearance as violations of the Universal Declaration of Human Rights and called on states to prevent, eradicate, and punish acts of enforced disappearance under criminal law. The international legal regime has since expanded: in 1996, the Inter-American Convention on Forced Disappearance of Persons (Inter-American Convention) entered into force, and in December 2010, the International Convention for the Protection of All Persons from Enforced Disappearance (Enforced Disappearance Convention) came into force. Enforced disappearances can also now be prosecuted as a crime against humanity under the Rome Statute of the International Criminal Court.

The topic of the present article is the response of states to the first wave of the COVID-19 pandemic by using extraordinary legal measures provided for in their constitutions and legislation. By reference to the research project's findings, the authors characterise the legal solutions in selected jurisdictions and attempt to demonstrate the relationship between the application of emergency measures and the specific political system of states. By doing so, the authors consider such factors as the territory, population, or type of political regime.

Abstract:
Legal scholars have long been concerned with how to deter crime and limit its spread. For a long time, imprisonment has been used as a tool to serve these two purposes. On one hand, prisons function as a means to deprive inmates of their liberty and deter public and private crime. On the other hand, they also seek to reform convicts in a way that facilitates their reintegration into society by adopting appropriate rehabilitation programs for each prisoner.1 Despite the general deterrent impact of imprisonment, overreliance on such penalties can also have negative consequences – particularly when prisons fail to fulfil the rehabilitation component of their role. Prisons then risk turning into a hotbed that enables even more dangerous criminal behavior. As such, some legal scholars believe that penalties that deprive individuals of their liberties are no longer considered the best or only means to create more stable and secure societies, nor to reduce crime rates.

Abstract:
The purpose of this study is to investigate the factors such as access to finance, legal constraints, and entrepreneurial skill on women's participation in business activities. The mediating effects of self-leadership were also established as an influence on women's participation in business activities. Moreover, the study examined the moderating effect of education among self-leadership and participation of women in entrepreneurial activities. The study selected a quantitative method and structured questionnaire for the data collection. The study found a significant relationship of the effect of access to finance, legal constraints, and entrepreneurial skill with women's participation in entrepreneurial activities. Moreover, the study found a significant mediating effect of self-leadership between factors and women's participation in entrepreneurial activities as well as a significant moderating effect of education between self-leadership and participation of women in entrepreneurial activities. The study suggests that the government and other institutions should take the initiative in women's entrepreneurship that affects women's self-leadership skills. The policymakers should pay attention to the financial concerns of women in business activities.

Abstract:
Despite being endlessly debated, a unanimous impetus on the nature of just, justice, and distributive justice appears entirely untouched to the desirable scientific certainty so far. Aristotle asserts treating’ equals equally and un-equals unequally’ but in proportion to their relevant differences. John Rawls says 'justice as fairness.' To both Aristotle and John Rawls, justice meant for the good and a willingness to act by the laws to ensure the highest good of society. Antecedently, both agree that justice is a master imperative for good human relationships and coexistence. However, despite the universal agreement, they differ in many fundamental respects. Aristotle denies the outbound distribution of an individual's rights as only the head of the family has the right to free speech in the family. But, Rawls distributes each right to the individual level. The paper attempts to discuss the similarities and dissimilarities in Aristotle's and John Rawls'ideas of just, justice and distributive justice. It has been argued that the aim of both philosophers was the same, i.e., to find out a theory of justice through which unity, harmony, virtue, and happiness can be attained to the fullest in a nation.

8. Crime, inequality and subsidized housing: evidence from South Africa

Abstract:
We study the relationship between housing inequality and crime in South Africa. We create a novel panel dataset combining information on crimes at the police station level with census data. We find that housing inequality explains a significant share of the variation in both property and violent crimes, net of spillover effects, time and district fixed effects. An increase of one standard deviation in housing inequality explains between 9 and 13 percent of crime increases. Additionally, we suggest that a prominent post-apartheid housing program for low-income South Africans helped to reduce inequality and violent crimes. Together, these findings suggest the important role that equality in housing conditions can play in the reduction of crime in an emerging economy context.

Abstract:
The legal order is the legitimate foundation of liberal democracy. Its incomplete enforcement of the law can therefore appear dysfunctional, reflecting weak institutions, state capture, and corrupt practices. This paper casts doubt on such categorical assessments by systematically examining the reasons for and intentions behind incomplete enforcement. It argues that law enforcement is part of the political process that is deeply affected by the constellation of actors concerned. Choices over law enforcement produce social order that is analytically distinct from the production of legal norms and their formal implementation. By analyzing different types of partial enforcement, its rationales, and intended effects, we propose an approach that studies law enforcement as an integral part of public policy analysis and of the study of socioeconomic orders.

10. THE SPECIAL POLICE IN ETHIOPIA

Abstract:
Like many federal and devolved systems, Ethiopia has both federal and regional security forces. In the last fifteen years, however, Ethiopia’s regional states have established regional special police forces, in addition to the regular regional state police. Established first in Ethiopia’s Somali region in 2007 to conduct counter-insurgency operations and riot control, special police quickly spread to all other regions of Ethiopia. The role and status of special police forces in Ethiopia remain contested. Resembling paramilitary forces, the regional special police units are well armed and receive military training. They are rapidly growing in size and have successfully recruited senior (former) army officers into their ranks. Special police forces have become deeply involved in Ethiopia’s interregional conflicts and border disputes, most notably in the current conflict in Tigray. They have even been involved in international operations in Somalia and Sudan and internal coup attempts. They have also been linked to severe human rights abuses. While federal and regional governments are empowered to establish their respective police forces, no specific legal provision deals with the special police force. As trust in the federal government waned in many regional capitals, states have linked the mandate of their special police forces with self-government. Still, special police have overstepped that boundary and engaged in activities, such as international border security and settling interregional disputes, that fall within the exclusive mandate of the federal government and federal forces. This report explores the origins and growth of the special police and its roles in current Ethiopia. It investigates the force’s constitutional and legal ambiguity and places the special police within the broader debate over Ethiopian federalism. Finally, it suggests several models that Ethiopia could adopt to regulate its proliferating special police forces. A failure to do so may have dire consequences for the future of the country.
