241. What Role Could Digital Technologies Play in the New EU Pact on Migration and Asylum?

Abstract:
Pressure on EU migration and asylum systems has grown considerably in recent years, with rising arrivals of asylum seekers and migrants and the level of asylum applications approaching those that threw the European Union into disarray in 2015–16. The arrival of more than 4 million displaced Ukrainians, meanwhile, has challenged already strained reception and integration systems. And across Europe, migration has become a flashpoint for political tensions and dominated electoral debates. Many policymakers and other stakeholders have pinned their hopes on the New Pact on Migration and Asylum to help Europe address these challenges. The pact, which was announced by the European Commission in 2020 and has recently entered the final stages of negotiation, is a series of legislative proposals aimed at revamping EU migration and asylum systems. Yet even if the pact is finalized, it has to pass another test before policymakers can claim victory: translating a complex legal construct into something that works in practice and can withstand spikes in arrivals and other challenges. This policy brief explores how digital technologies—already increasingly being used in European migration and asylum systems—could be leveraged to support the implementation of the pact and where caution is merited. It examines the role new digital tools could play in three key areas: decision-making at the border, relocation of asylum seekers/refugees among Member States, and return and reintegration. It also discusses the broader implications of digitalization in migration and asylum systems and reflects on how policymakers can set appropriate governance models and safeguards to ensure responsible use of new technologies.

242. Betting on Legality: Latin American and Caribbean Responses to the Venezuelan Displacement Crisis

Abstract:
More than half, and as many as two-thirds, of the estimated 6.4 million displaced Venezuelans who have settled in Latin America and the Caribbean since 2016 have been granted legal status in their host country. Most of the receiving countries in the region have responded with pragmatic measures that offer some form of legal status as well as the right to access the labor market, basic education, and emergency health care. The measures implemented are uneven and often not fully institutionalized, but they have been surprisingly generalized for a region with limited experience with large-scale immigration. This report explores the response to Venezuelan displacement in the 15 principal host countries in Latin America and the Caribbean between 2016 and 2022. It examines the reach of different mechanisms for providing legal status and humanitarian protection—asylum systems, mobility and residence agreements, regular visas, and regularization campaigns that offer temporary status—and offers estimates of the share of Venezuelans in each country who have obtained legal status. The report also considers the trend of governments coupling measures to provide legal status with new visa requirements that have made it increasingly difficult for more Venezuelans to arrive, pushing some into irregular migration channels. Finally, the report looks at variations in Venezuelans’ access to education and health care across the 15 countries.

243. Fostering a New Global Conversation: A View from Mexico on Diversifying Inter-Regional Engagement

Abstract:
This essay highlights the importance of fostering a more inclusive global conversation by encouraging both intra- and inter-regional relations. Although one focus will be on fostering more communication between Mexico and the Latin America and the Caribbean (LAC) region with Azerbaijan and the other countries that make up the core Silk Road region, various other regions and mechanisms operating within the contemporary global context will also be discussed. The dimensions of future governance may be examined from the perspective of different world regions’ capacity to communicate, collaborate, and generate a new conversation. A more inclusive approach can result in a more holistic review of different angles and thus bring out more original approaches for prospective geopolitical analysis efforts, policy design, and decisionmaking in their local, regional, and global expressions. Communication, knowledge, and culture strengthen their capacity to influence the conversation if key elements of the global governance agenda are taken as a common ground for analysis when de cisionmak ing depends on the incorporation of broader views. While distant, the location and geographical presence of LAC and the Silk Road regions allow for the possibility to analyze commonalities between these two large and complex communities whilst exploring new pathways for dialogue and international policymaking.

244. The Future of Standardized Sustainability Reporting

Abstract:
Regulators and stakeholders demand reliable, valid and comparable information about a company’s operations — and increasingly, not only its financial performance, but its non-financial impacts on society and the natural environment. Accordingly, regulators and reporting entities have developed sustainability reporting standards, but these are grounded in different reporting goals and sometimes in conflict. In this paper, Tia Rebecca Driver, Amr ElAlfy and Olaf Weber contribute to the current discussion of standardized sustainability reporting by analyzing the landscape of reporting frameworks and their governance bodies, which oversee and work on the standardization of sustainability reporting. They provide contextual background on the governance of sustainability reporting by comparing the prominent reporting frameworks to understand how they complement or conflict with one another. They then investigate the impact of mandatory reporting and materiality to understand how these concepts could influence the application and extensiveness of a composite reporting standard. Finally, the authors provide policy makers with recommendations that facilitate a standardized reporting approach that centres on sustainable development.

245. Weaponizing Privacy and Copyright Law for Censorship

Abstract:
Freedom of the press is facing growing restrictions from technology policies that censor the media under the guise of protecting privacy. US and European copyright and privacy laws transcend borders and affect how news media can operate globally. Fundamental journalistic practices such as the ability to claim fair use and conduct investigative reporting in the public interest are under threat. This paper examines the global impact of techno-legal regimes such as the US Digital Millennium Copyright Act and the EU Directive on Copyright in the Digital Single Market (Copyright Directive), and the “right to be forgotten” and the EU General Data Protection Regulation. The misuse of regulations developed in the Global North is particularly detrimental to media outlets in the Global South, which regularly face censorship. This paper offers solutions to protect news media from the silencing efforts of powerful government and business actors.

246. Supporting Safer Digital Spaces

Abstract:
Various forms of digital technology are being used to inflict significant harms online. This is a pervasive issue in online interactions, in particular with regard to technology-facilitated gender-based violence (TFGBV) and technology-facilitated violence (TFV) against LGBTQ+ people. This modern form of violence perpetuates gender inequality and discrimination against LGBTQ+ people and has significant impacts on its targets. As part of a multi-year research project Supporting a Safer Internet (in partnership with the International Development Research Centre) exploring the prevalence and impacts of TFGBV experienced by women, transgender, gender non-conforming and gender-diverse people, as well as TFV against LGBTQ+ individuals, an international survey was conducted by Ipsos on behalf of the Centre for International Governance Innovation (CIGI). The survey examined the influence of gender and sexual orientation on people’s experiences with online harms, with a focus on countries in the Global South. Data was collected from 18,149 people of all genders in 18 countries. The special report provides background information on TFGBV and TFV against LGBTQ+ people by summarizing some of the existing research on the topic. It then presents the quantitative data collected on people’s experiences with, and opinions on, online harms. A list of recommendations is provided for governments, technology companies, academics, researchers and civil society organizations on how they can contribute to addressing and ending TFV.

Abstract:
As a growing number of countries adopt digital payments and currencies, the Centre for International Governance Innovation and Bennett Jones LLP hosted a virtual workshop on March 7, 2023, to discuss the implications for Canada. Building on their previous work in related fields, participants including Canadian and international experts from the public and private sectors as well as from academia explored four topics: payments system modernization, open banking, stablecoins and central bank digital currencies. Creating a trustworthy digital financial system in which Canadians can conduct personal and business transactions in a reliable way is key to Canada’s successful adoption of digital payments and currencies.

Abstract:
The internet has spread to most parts of the world and is now making the leap into space. An interplanetary or solar-system internet will require a governance system that can manage the economic, political and social issues that may arise. To address these issues, internet governance will need multi-stakeholder participation from traditional governments, international organizations and the private sector. This paper looks at the challenges facing the development of a space-based internet architecture and how existing UN space governance treaties and terrestrial internet governance could help mitigate these risks.

249. Online Gender-Based Violence in Brazil: New Data Insights

Abstract:
This paper focuses on the Brazilian results from the Supporting a Safer Internet survey, undertaken by CIGI and the International Development Research Centre and carried out by Ipsos. The survey looked at the prevalence of online gender-based violence in 18 countries worldwide, with a special focus on the Global South. Other studies and literature referring to gender, sexuality and race are used to complement, contextualize and interpret the country-based data for Brazil. Brazilian respondents, particularly women and LGBTQ+ individuals, reported heightened negative effects on mental health, and low trust in or resort to law enforcement and other institutions. The experiences of high-profile individuals — 83 percent reported experiencing some type of online harm (connected to the very pressing issue of political violence in Brazil) — and the issue of image-based abuse are also discussed. The paper concludes with recommendations addressing some of the gaps concerning the public sector, the private sector, and the cultural or public debate in the response to tackling technology-facilitated gender-based violence in Brazil and globally.

250. Canada Needs Its “New Approach” to Streamline Digital Rulemaking

Abstract:
Canada’s current approach to rulemaking is not keeping pace with the deployment of new digital technologies. This paper proposes to modernize the Statutory Instruments Act to bridge that gap, suggesting that mandatory standards, technical specifications and conformity assessment programs should be recognized as statutory instruments alongside regulations. This borrows from the European Union’s “New Approach” established in 1985, whereby regulators can request that EU standards bodies develop mandatory standards as a compliance mechanism to laws, even while legislation is being drafted. Streamlining rulemaking is essential to help manage the harms associated with digital technologies as soon as possible after they are commercialized.
