21. Responsible Exit Principles for Oil and Gas Companies

Asset transfers in the oil and gas industry are not new. Yet, as the energy transition accelerates, there is a growing risk that oil and gas companies sell assets in response to pressures to decarbonize. However, transferring assets to operators with lower standards can lead to higher emissions and increased risks. This briefing offers a framework to guide these transactions and ensure that environmental and operational integrity is upheld. Designed for use by a range of stakeholders, these principles set out best practices to help companies manage financial, legal, environmental and reputational risks during asset transfers. They were developed with input from representatives of the oil and gas industry; investors, the financial, legal and accounting professions; the insurance industry; standard-setting bodies; academia; and civil society. All stakeholders can adopt and refine these standards to support a responsible, low-emissions future and harmonize regulatory practices across the industry.

Mongolia’s state-owned mining enterprises are crucial to the economy but face transparency and governance issues. This scoping study examines the need for improved disclosures and stronger accountability in the sector. This report presents the scoping study on the disclosures of Mongolia’s state-owned mining enterprises, conducted by the Natural Resource Governance Institute (NRGI). The study was supported and funded by the Extractive Industries Transparency Initiative (EITI) International Secretariat and the European Bank for Reconstruction and Development (EBRD).

23. Behind the Schemes: Anticorruption Gaps in Mining Sector Certifications

Abstract:
Decisionmakers are increasingly looking to certification schemes to provide information on the sustainability of mining operations, yet these schemes have significant room for improvement regarding how they address corruption in their standards. The report assesses the content of the performance standards used by the Aluminium Stewardship Initiative (ASI), the International Council on Mining and Metals (ICMM), the Initiative for Responsible Mining Assurance (IRMA), The Copper Mark, and Towards Sustainable Mining (TSM). Schemes address some topics, such as revenue and payments and anticorruption procedures, relatively well; this may reflect the extent to which legislation and regulations address these topics. Schemes’ standards less frequently covered other issues, such as beneficial ownership and allegations of corruption. Many schemes, and the mining companies that use them, are missing an opportunity to assess the implementation of corporate-level anticorruption policies in mine-site assessments. The quality of certification schemes’ governance and assurance processes is essential to their effectiveness, yet many fall short of best practice. This undermines their credibility. Key governance challenges include the unbalanced representation of different interests within schemes and the risk of conflicts of interest in the auditing process. Decisionmakers risk becoming overreliant on certification schemes as indicators of responsible business conduct, which may be facilitated in part by industry influence over policymaking processes. Certification schemes are not a replacement for ongoing, robust due diligence into the environmental, social, and governance impacts of mining operations, including corruption, and the design and enforcement of robust regulatory frameworks. In a shifting standards landscape where there are efforts to both consolidate and review existing certification schemes, and a moment where the risk of corruption is heightened by growing demand for transition minerals, governments, mining companies, and certification schemes themselves must do more to address the topic of corruption. To do so effectively, they should focus their attention on solutions that will have the most impact in addressing this issue.

Abstract:
This policy brief outlines a set of recommendations aimed at empowering local authorities in Yemen to effectively provide services and lead local economic development. The aim is to analyze and draw lessons from three ongoing tracks that seek to empower local authorities in Yemen, while also addressing the challenges and opportunities associated with these efforts. The analysis concludes that building consensus between the central government and local authorities is of paramount importance for the successful empowerment of local authorities. It is imperative to address political concerns and achieve a minimum level of political consensus in order for these efforts to move forward. Furthermore, it is crucial to overcome challenges related to financing, enhance transparency and accountability, and build local capacity. The Development Champions Forum therefore recommends the importance of establishing clear and precise guiding principles for the distribution of powers and authorities between the center and local authorities. It also emphasizes leveraging the potential of the private sector to drive economic growth, create job opportunities, provide services, and invest in local communities. Lastly, it encourages partnerships between international organizations, donors, and local authorities towards empowering local authorities in providing services and local economic development.

Abstract:
The Georgetown Institute for Women, Peace and Security released a new report on the widespread use of conflict-related sexual violence (CRSV) and its devastating impacts on individuals and communities, which can last generations and undermine peace and security efforts. Sexual violence is used as a weapon of war by combatants in conflict situations worldwide, decimating societies and fueling displacement. It remains a silent crime, with an estimated 80 percent of cases in conflict settings going unreported. This fall, GIWPS convened leaders from Ukraine, Bosnia-Herzegovina, Kosovo, and Colombia to share lessons learned for responding to the global scourge of CRSV. Drawing on their insights, this report presents actionable policy recommendations for key stakeholders to hold perpetrators accountable, meet survivor needs, and follow through on their commitments to deliver justice. The report, authored by Jess Keller, was made possible with support from the Embassy of Germany in Washington, D.C.

26. Collective Protection for Communities and Rights Defenders at Risk: Lessons from Grassroots Advocacy in Colombia

Abstract:
Rights defenders around the world face unrelenting violent reprisals for their work protecting marginalized communities and their territories. Some governments respond by committing to protect these citizens at risk—mainly with individualized, police-style safeguards. Colombia’s government has Latin America’s largest protection agency by far and has gone beyond its many individual measures to also promise collective protection to communities at risk. In Colombia, the Community Council of the San Juan River region (ACADESAN), defends the rights of its 72 Afro-Colombian communities in areas affected by armed conflict. It has worked to hold the government accountable for delivering on its legal and policy commitments to protect communities at risk by providing comprehensive, collective measures. This Accountability Note describes ACADESAN’s breakthrough advocacy campaign for collective protection. It shares insights relevant for efforts to protect rights defenders and communities that go beyond conventional measures. It is based on the story told in Spanish by Mauricio Parra Bayona, ACADESAN human rights advisor, in his Accountability Working Paper, and the prefaces to that paper by former ACADESAN representative Elizabeth Moreno Barco and Jonathan Fox of ARC. Parra reflects on how collective protection must further be adjusted to better serve other at-risk communities and organizations in Colombia.

27. After the Agreement: Implementing Remedy for Displacement in Northern Haiti

Abstract:
In January 2011, more than 400 families in northeast Haiti were evicted from their agricultural land to make way for the Caracol Industrial Park (CIP), a large industrial textile facility principally financed by the Inter-American Development Bank (IDB) and the US government. This Accountability Note chronicles the Haitian families’ remarkable path to pursuing remedy for their displacement. Against all odds, they organized, sought international support for their case, and, using the independent accountability mechanism (IAM) of the IDB, ultimately negotiated an agreement with the IDB and the Haitian government to restore their livelihoods. But their struggle did not end there. Much of the fight for remedy occurred after signing the agreement—a reality often under-acknowledged by accountability advocates. Support from local and international advocates has been critical to getting even partial implementation of the agreement. From the outset, the Haitian families’ chances of success were slim: few IAMs have the capacity or mandate to facilitate any remedy. Moreover, the Caracol case represents an extremely rare instance where a displaced community has successfully used an IAM to negotiate for replacement land. Still, for many families, delays in receiving remedy lasted for years, increasing suffering and exacerbating the economic and social losses that come with losing land. Monitoring and advocacy have been necessary for the six years following the signing of the agreement. Because of that, many of the families eventually received some compensation—including (for some) land. Although reaching an agreement to address harm is often the goal of an accountability mechanism process, this Note highlights the struggle that unfolds after the agreement is signed. Ensuring that remedy is actually delivered requires continual vigilance and advocacy. The Note provides key lessons for communities and advocates hoping to secure remedy through dispute resolution at IAMs: Lesson 1: A signed agreement for remedy is not the end of the process, but the beginning of another struggle. Lesson 2: Monitoring and continued advocacy are critical to getting remedy agreements implemented. Lesson 3: Remedy agreements must account for the possibility of challenges to implementation Even though Haiti presents a challenging political and economic environment in which to implement a remedy agreement, the lessons of this case are not unique to Haiti. As development banks increasingly operate in contexts of fragility and crisis, similar hurdles to remediation are likely to occur elsewhere.

The Bangsamoro peace process is an interesting case study to analyse potential entry-points for stronger integration of anti-corruption measures into peace processes. In 2022, together with U4 Anti-Corruption Resource Centre, we published a mapping study that, starting from the assumption that corruption and violent conflict are interlinked, explored how corruption, as an element of conflict systems, could be addressed during peace processes. The mapping identified potential entry-points for stronger integration of anti-corruption measures into peace processes across mediation efforts at different “tracks”. It also highlighted the need for more case study evidence of past efforts to integrate such measures in order to operationalise the identified entry points and to move towards actionable recommendations. The Bangsamoro peace process was identified as a significant case study, in which the integration of thinking about corruption within peace processes has (or has not) contributed to durable peace. This paper presents a first case study exploring the concrete consequences of making use of specific entry points.

Abstract:
Popular demands for social justice in Africa, as in the rest of the world, are often embedded in calls for better governance (Gray & Khan, 2010), which often include transparency and accountability. Przeworski, Stokes, and Manin (1999) define political accountability as the capacity of citizens to exert control over their leaders through institutional sanctions, especially through elections. Lindberg’s (2009) attempt to simplify the concept of political accountability resonates with Ohamadike (2022), who defines political accountability as the link between citizens (the principal) and government or public officials (the agents) tasked with safeguarding the rights and aspirations of the populace. This link forms a social contract upon which the agents (government or public officials) can be held accountable for their actions, with the principal having the privilege to impose sanctions on the agents, which can include removing them from their positions of power. Political transparency and accountability complement one another, but popular support for these ideals varies widely at the country level in Africa. Both ideals can be considered “matching parts” in governance (Hood, 2010). Transparency entails making government information accessible to the public, which gives citizens the knowledge needed to hold officials accountable. Accountability, on the other hand, requires that public officials justify their actions and decisions, which can be done by adhering to the citizens’ demands (Armah-Attoh, Ampratwum, & Paller, 2014). Addressing citizens’ demands is important for government to remain popular and relevant to the people. Although experts have long connected transparency and accountability with strong government performance, citizens vary in how much they prioritise or even support these concepts. One factor that might impact how citizens form these attitudes is economic well being. This question – the impact of economic performance on attitudes about accountability and transparency – is underexplored. We argue that lower levels of economic development are associated with higher citizen support for accountability and transparency. Due to the pervasive poor economic outlook in most African societies, much of the citizenry is gruelingly aware of deep-seated government corruption and poor government responsiveness to citizen needs, which they often feel powerless to tackle (Franz, 2012). Citizens of less-prosperous economies might perceive transparent and accountable governance as a means to address urgent economic issues, allowing them to get more from their government. Conversely, economic prosperity can incentivise individuals to back a government that seems to be achieving results independently, diminishing citizens’ insistence on changes, such as government transparency and accountability. This perspective emerges from trust in the government’s competence, which could cultivate complacency regarding the necessity of transparency and accountability. To test this hypothesis, we conduct a multilevel logistic regression analysis using data from the Afrobarometer Round 8 survey. We find that economic factors significantly influence attitudes. Citizenship in a prosperous African country is associated with lower support for transparent and accountable governance, whereas living in a less affluent country is associated with heightened prioritisation. This paper is structured as follows: Part 2 discusses the research methodology, covering the data, data sources, and analytical techniques. In the results section, findings from a sample of 48,084 Africans are presented. Concluding discussions follow in Part 4.

A successful offensive by Syrian rebels in December this year led to the fall of one of the most brutal modern regimes. Most Syrians have welcomed the end of Bashar al-Assad’s rule, although divisions within the opposition forces pose a risk to Syria’s potential stability after 13 years of civil war. To reduce them, international assistance is needed to rebuild Syrian institutions and to help hold accountable those regime members responsible for war crimes and crimes against humanity.
