41. Understanding Differences in Attitudes to Immigration: A Meta-Analysis of Individuallevel Factors

Abstract:
Public attitudes toward immigration have attracted much scholarly interest and extensive empirical research in recent years. Despite a sizeable theoretical and empirical literature, no firm conclusions have been drawn regarding the factors affecting immigration opinion. We address this gap through a formal meta-analysis derived from the literature regarding immigration attitudes from the top journals of several social science disciplines in the years 2009-2019 and based on a population of 1185 estimates derived from 144 unique analyses on individual-level factors affecting attitudes to immigration. The meta-analytical findings show that two individual-level characteristics are most significantly associated with attitudes to immigration - education (positively) and age (negatively). Our results further reveal that the same individual characteristics do not necessarily explain immigration policy attitudes and attitudes towards immigrants' contribution. The findings challenge several conventional micro-level theories of attitudes to immigration. The meta-analysis can inform future research when planning the set of explanatory variables to avoid omitting key determinants.

Abstract:
This paper introduces a special collection of papers on access to justice, the rule of law, and due process in the US immigration system. The collection honors Juan Osuna, a devoted public servant and former director of the Executive Office for Immigration Review (EOIR), which is the agency in the US Department of Justice (DOJ) that administers the Immigration Courts, the Board of Immigration Appeals (BIA), and legal orientation, assistance, and representation programs. The collection consists of five articles published in the Journal on Migration and Human Security and six CMS essays, written by some of Osuna’s close colleagues and friends. Section I provides a brief biography of Juan Osuna’s life, recites his titles and professional accomplishments, and outlines his views on some of the topics covered in the papers. The section draws heavily from two events that book-ended Osuna’s tenure as EOIR Director, which were organized by the Center for Migration Studies of New York (CMS). The first took place on February 16, 20121 and the second on July 18, 2017,2 just before Osuna’s untimely death at the age of 54 on August 15, 2017. This section also includes remembrances and reflections from Osuna’s colleagues at a November 15, 2018 event in Washington, DC, devoted to honoring his legacy.3 Section II summarizes the 11 papers in this collection, which reflect Juan Osuna’s commitment to humanizing the law and its fair application to all. The papers examine and propose ways to strengthen: • The nation’s response to large-scale migration. • The US asylum system. • The removal adjudication system. • Immigration Court backlog reduction efforts. • The treatment of survivors of human trafficking and modern-day slavery. • Due process for immigrants through legal representation. Section III offers a concluding reflection on the rule of law, and Juan Osuna’s legacy in a time of political division and discord.

43. The US Immigration Courts, Dumping Ground for the Nation’s Systemic Immigration Failures: The Causes, Composition, and Politically Difficult Solutions to the Court Backlog

Abstract:
The US immigration court system seeks to “fairly, expeditiously, and uniformly administer and interpret US immigration laws” (DOJ 2022a). It represents the first exposure of many immigrants to due process and the rule of law in the United States, and occupies an integral role in the larger US immigration system. Yet it labors under a massive backlog of pending cases that undermines its core goals and objectives. The backlog reached 1.87 million cases in the first quarter of FY 2023 (Straut-Eppsteiner 2023, 6). This paper attributes the backlog to systemic failures in the broader immigration system that negatively affect the immigration courts, such as: • Visa backlogs, United States Citizen and Immigration Services (USCIS) application processing delays, and other bottlenecks in legal immigration processes. • The immense disparity in funding between the court system and the Department of Homeland Security (DHS) agencies that feed cases into the courts. • The failure of Congress to pass broad immigration reform legislation that could ease pressure on the enforcement and court systems. • The lack of standard judicial authorities vested in Immigration Judges (IJs), limiting their ability to close cases; pressure parties to “settle” cases; and manage their dockets. • The absence of a statute of limitations for civil immigration offenses. • Past DHS failures to establish and adhere to enforcement priorities and to exercise prosecutorial discretion (PD) throughout the removal adjudication process, including in initial decisions to prosecute. • The location of the Executive Office for Immigration Review (EOIR), which oversees US immigration courts, within the nation’s preeminent law enforcement agency, the Department of Justice (DOJ). • The misconception of many policymakers that the court system should primarily serve as an adjunct to DHS. • A past record of temporary judge reassignments and government shutdowns. The paper supports a well-resourced and independent immigration court system devoted to producing the right decisions under the law. Following a short introduction, a long section on “Causes and Solutions to the Backlog” examines the multi-faceted causes of the backlog, and offers an integrated, wide-ranging set of recommendations to reverse and ultimately eliminate the backlog. The “Conclusion” summarizes the paper’s topline findings and policy proposals.

Abstract:
This paper, by Emmanuel Comte, Senior Research Fellow, Ariane Condellis European Programme, analyses immigration restrictions by discussing major recent debates of historical political economy and proposing a new explanatory model. The conclusions in recent research on the subject of immigration restrictions converge in highlighting the natives’ fear of economic costs as a potent factor in immigration restrictions, despite evidence proving that actual costs are small and circumscribed, while the aggregate impact of immigration is generally positive. This paper develops existing scholarship to explain the magnitude of current immigration restrictions in Europe and North America by proposing a sequential path dependency model based on both historical insights and the insights of institutionalist theories of path dependence. In this model, the fears of adverse economic effects held by specific segments of the national workforce interact with a power structure dominated by the state and with the agency of union leaders and policymakers initiating a series of policy cycles that lead to complete restrictions on low-skilled immigration.

46. Bringing child immigration detention to an end: The case of EU return procedures

Abstract:
The harmful consequences of child immigration detention are, by now, increasingly well-documented. Evidence attests to the long-lasting and negative impact of the practice on children’s health, well-being and development, and has given rise to an international consensus firmly against its continued use. However, the European Union’s policies fail to reflect any such agreement, which is evident not least in the context of the Return Directive and member states’ continued use of the practice. As it stands, the detention of minors is permitted by the Directive and remains a plausible option both according to the European Commission’s proposal to recast it and the Council of the EU’s position on the matter. Furthermore, although the Directive mandates member states to explore all plausible alternatives and use child immigration detention only as a measure of last resort, evidence suggests that detention is prolific and other measures underused. In the recast proposal, little looks set to change on this front either, with the use of alternatives having fallen mostly by the wayside. In this context, this paper argues that, with negotiations on the file ongoing, the time for the EU to shift gears, ban the practice, and mandate member states to implement alternatives is now opportune.

Abstract:
Brexit is done, but what does it mean? Doing things differently? Policy after Brexit brings together a number experts in their respective fields to investigate how policy and policymaking have changed in a range of sectors. We asked them to consider how changes so far compare to what was promised before Brexit, and to analyse what changes lie ahead and what their impact might be. Their contributions are divided into three sections: first, those policy areas (trade, immigration, agriculture, fisheries and subsidies) where Brexit compelled the UK to put in place alternative policies. Second, those retaining significant amounts of EU law where the government could think seriously about divergence (financial services, procurement, taxation, consumer protection, environmental policy, energy policy and aviation). A final section considers new or emergent sectors in which both the UK and EU are looking to dip their regulatory toes (climate change and net zero, data and digital, autonomous vehicles and bioscience).

48. Economic Integration of Venezuelan Immigrants in Colombia: A Policy Roadmap

Abstract:
This paper studies the formal labor market integration and firm creation of Venezuelan immigrants and refugees in Colombia between late 2019 to late 2021. It applies a novel framework to identify segments of the Colombian economy where Venezuelan immigrants and refugees are lagging behind. When it comes to labor market dynamics, we identify professional services as one of the sectors where Venezuelan workers are not integrating fast enough consistently across different parts of the country, hinting that the recognition of professional credentials might be an important bottleneck to effective integration. As for entrepreneurship, we find that sectors where there are fewer firm creations by foreigners as compared to locals include commerce and service industries all across the nation. This paper is accompanied by a set of downloadable files which list sectors of the economy in each geographic department with poor integration of Venezuelan immigrants both for labor markets and firm creation. These lists are meant to be used by national and local policymakers for further investigation of possible market failures or distortions hindering immigrant integration, given our results.

The Global Compact for Safe, Orderly, and Regular Migration (GCM) calls on countries of destination to both expand regular migration pathways and take steps to increase the development impact of these pathways. Migration can have a positive impact on the economic development of migrants themselves, their families, their countries of origin, and their country of destination, if aspects such as integration, remittances, and skill transfers are prioritized. 50. The Short-Term Labor Market Impact of Venezuelan Immigration in Peru

Abstract:
Peru is the second-largest recipient of Venezuelans worldwide. We combine newly available data on Venezuelans living in Peru and the Peruvian Household Survey to assess the impact of Venezuelan migration on natives’ wages and employment. The initial regression analysis exploits the variation in supply shifts across education-experience groups over time. It indicates that immigration in Peru had no adverse impact on native wages. However, the paper highlights that in Peru immigrants and natives with similar education and experience are likely to work in different occupations. The subsequent analysis based on occupational clustering confirms the null effect on wages and indicates that a 20% increase in immigrants decreases formal employment by 6%. We do not find evidence for changes in employment composition toward informality so that migration operates through the extensive margin of employment. We report evidence in favor of immigrants being a close substitute to the least productive natives, suggesting that firms substitute native formal labor for low-cost immigrant informal labor.
