791. Reconstructing Gaza – Lessons from Lebanon

Abstract:
Last week's international donor conference to address the question of humanitarian assistance to Gaza underscores the myriad challenges confronting the process. Namely, how should the international community respond to the complex issues surrounding assistance in post-conflict recovery and reconstruction, particularly when several key donors reject any contact with Hamas, the governing authority on the ground? By any estimation, the Gaza reconstruction process will face several perplexing issues: How can billions of US dollars be effectively, transparently and accountably dispersed in a coordinated way, when several key donors and the Government of Israel reject any moves that will bolster the fortunes of Hamas, who m they classify as a terrorist organisation? What impact will an emerging Palestinian National Unity Government have on the mechanisms for overcoming many donors' reluctance to deal directly with Hamas? What opportunities and challenges does the reconstruction of Gaza pose for a rapprochement between Hamas and Fatah? Who will lead the reconstruction process and how will meaningful activity take place in the face of severe restrictions on access and movement? With Hamas in power in Gaza and Israel ref using to consider opening their common borders until kidnapped Israeli Defence Forces Corporal Gilad Shalit is released by Hamas, how is meaningful recovery and reconstruction even possible? In the absence of a credible political process, what use is reconstruction anyway if it merely returns the population of Gaza to their pre-conflict socio-economic imperilment? Lebanon faced a similar situation following the 2006 war between Hezbollah and Israel.

Abstract:
The current political crisis over elections in Afghanistan stems, in part, from a fundamental gap in Afghanistan's legal and political system: lack of agreement on what entity(s) has the power to resolve constitutional disputes, and how that power is accessed. Without a clear path to settling constitutional disagreements, the system becomes deadlocked as disputes arise, exacerbating tensions between Afghanistan's fragile institutions and factionalized political elite.

793. Trading Life, Trading Death: The Flow of Small Arms from Mozambique to Malawi

In a region apparently awash with weapons and plagued with rising levels of armed crime, Malawi is a welcome exception to these characteristics. In early 2007 there were only 9,320 legally registered firearms in Malawi excluding those used by the security forces, compared to just under 87,000 in Zambia (Mtonga and Mthembu-Salter, 2004, p. 286) and nearly 4 million in South Africa (Gould et al., 2004, p. 133). Though a country of an estimated 13 million people, in the 5 years between 1996 and 2000 Malawi suffered just 2,161 reported cases of armed robbery (Mwakasungula and Nungu, 2004, p. 89). For 2005 the figure was 316 and for 2004 it was 263, according to figures provided by the Malawi Police Service (MPS). Even leaving aside South Africa, where there were 119,726 recorded cases of aggravated robbery in 2006 (SAPS, 2006), Malawi's armed crime statistics still compare favourably with the rest of the region. In neighbouring Zambia, for example, where there is a population of only 10 million people, there were 3,168 reported cases of armed robbery in the 5 years between 1998 and 2002 (Mtonga and Mthembu-Salter, 2004, p. 294).

794. Ending Colombia's FARC Conflict: Dealing the Right Card

Latin America's oldest guerrilla organisation, the Revolutionary Armed Forces of Colombia (FARC), is under severe stress. Close to seven years of the Uribe presidency have hurt the FARC's capability and morale. Several top commanders have been captured, killed in combat, murdered by their own men, or died of natural causes, as in the case of Manuel Marulanda, the FARC's historic leader. Thousands of foot soldiers have deserted, bringing the guerrillas' troop strength down by almost half, to perhaps 10,000 today. Still, under its new leader, Alfonso Cano, the FARC has shown renewed internal cohesion and continued capacity to adapt to changes in the security environment. The Uribe government remains wedded to its hardline military approach until the FARC has no option but to negotiate surrender, but this strategy is problematic. President Uribe should keep military pressure up but emphasise devising a political strategy capable of drawing a weakened but still largely intact FARC into peace talks. Priority should also be on strengthening rule of law, protecting human rights and increasing citizen security.

795. Intent: Ius In Bello Norms in Just War Theory The Case of the War in Gaza in 2009

Abstract:
“I am sure they (the IDF soldiers) committed this crime.” I read these words just after I had finished the first draft of this paper on 1 February 2009. Oakland Ross, the Toronto Star journalist, was quoting Dr. Ezzeldeen Abu al-Aish who had trained at the Soroka hospital in Beersheba and the Tel Hashomer hospital in Tel Aviv. The interview was held at the latter Israeli hospital where another daughter was being treated for her injuries after the IDF opened the Ezer crossing to Gaza in a rare exception and allowed a Palestinian ambulance to meet up with an Israeli ambulance so the injured child could be transferred by IDF helicopter to the hospital. Dr. Abu al-Aish, a gynaecologist at Gaza's main Shifa Hospital, was a peace activist; his children attended peace camps with Israeli children. During the war, he had been heard frequently on Israel's Channel 10 TV station reporting in fluent Hebrew by cell phone via his friend, the Israeli journalist, Shlomi Eldar, to Israelis on the health problems resulting from the war that he had been witnessing in Gaza from his top floor apartment of a five-storey apartment building on Salahadin Street at the corner of Zino Rd. in Jebaliya just north of Gaza City. On Friday, 16 January 2009 less than 36 hours before the ceasefire went into effect in Gaza on Sunday, 18 January 2009, he was on the air when two shells from an Israeli tank parked a block away ploughed through his apartment and killed three of his daughters. 22-year-old Bisan, 15-year-old Mayer, 14-year old Ayan, and his 14-year-old niece, Nour Abu al- Aish.

796. Democracy Promotion Under Obama: Finding a Way Forward

Abstract:
The Bush's administration's highly problematic legacy on democracy promotion and general pessimism about the global state of democracy create pressure on the Obama administration to pull the United States substantially back from supporting democracy abroad. Although dissociating U.S. democracy support from the errors of the Bush approach is crucial, a broad realist corrective of U.S. policy is not necessary. The way forward for Obama will be more about changing how the United States goes about supporting democracy abroad than about what emphasis to place on democracy relative to other interests. Cardinal values of Obama's political philosophy and style—non-confrontational, measured, persistent, bipartisan, cooperative, effective, and empowering—provide a natural basis for a new framework to help the United States regain its place as a respected, trusted, and influential ally of democracy around the world.

797. Palestine and Israel: Time for Plan B

Abstract:
The international effort to achieve a two-state solution to the Israeli–Palestinian conflict has come to a dead end, at least for the present. Things can—and might well—get worse unless the United States and other outside actors couple a realistic view of the present with a serious effort to push for a more promising future. The first step in a new diplomatic approach must be to establish a cease-fire that builds on the common interest of both Israel and Hamas to avoid fighting in the short term. A new cease-fire should be clear and perhaps even written; mediators (whether Arab or European) must be willing to make an agreement more attractive to both sides to sustain (Hamas can be enticed by some opening of the border with Egypt; Israel will demand serious efforts against the supply of arms to Hamas). The second step must be an armistice that would offer each side what they crave for the present—Israel would get quiet and a limit on arms to Hamas; Palestinians would get open borders, a freeze on settlements, and an opportunity to rebuild their shattered institutions. Such an armistice must go beyond a one-year cease-fire to become something sustainable for at least five to ten years. Finally, the calm provided by the armistice must be used to rebuild Palestinian institutions and force Palestinians and Israelis to confront rather than avoid the choices before them.

798. Dysfunction and Decline: Lessons Learned From Inside al-Qa'ida in Iraq

Al-Qa`ida in Iraq (AQI) is a shadow of its former self, primarily because broad sectors of Iraq's Sunni population rejected it after more than three years of active and tacit cooperation. Anger over AQI's brutal radicalism infused the Sunni backlash against jihadists, but AQI also made two fundamental strategic overreaches that exacerbated its alienation from Sunnis in Iraq. First, it incited a sectarian backlash from Iraqi Shi'a without the means to defend Iraq's Sunnis from the onslaught it provoked. Second, AQI created a formal political entity, the Islamic State of Iraq (ISI), to dominate Iraq after a U.S. withdrawal without adequate support from Iraq's Sunni population.

Abstract:
After a slow start, the U.S. military has made remarkable strides in adapting to irregular warfare in Afghanistan and Iraq, and is beginning to institutionalize those adaptations. Recent Department of Defense (DOD) directives and field manuals have elevated stability operations and counterinsurgency to the same level of importance as conventional military offensive and defensive operations. These changes are the outcome of deep reflection about the nature of current and likely future threats to U.S. national security and the military's role in addressing them. They represent important steps toward transforming a sclerotic organizational culture that long encouraged a ''we don't do windows'' posture on so-called ''military operations other than war,'' even as the nation's leaders called upon the armed forces to perform those types of missions with increasing frequency.

Abstract:
One of the major contributions of Barack Obama's presidential campaign during 2007—08 was his political success in shifting the focus of the U.S. foreign policy debate away from Iraq and toward Afghanistan. The reversal of fortunes in the two major wars that President George W. Bush had embarked upon during his tenure (a steady improvement in the military situation in Iraq during the last two years of the Bush administration and the rapidly deteriorating one in Afghanistan) helped Obama to effectively navigate the foreign policy doldrums that normally sink the campaigns of Democratic candidates in U.S. presidential elections. Throughout his campaign, Obama insisted that the war on terror that began in Afghanistan must also end there. He attacked Bush for taking his eyes off the United States' ''war of necessity,'' embarking on a disastrous ''war of choice'' in Iraq, and promised to devote the U.S. military and diplomatic energies to a region that now threatened U.S. interests and lives: the borderlands between Afghanistan and Pakistan.
