861. Nagorno-Karabakh: Risking War

Abstract:
Armenia and Azerbaijan have failed to resolve the Nagorno-Karabakh conflict, even though the framework for a fair settlement has been on the table since 2005. A comprehensive peace agreement before presidential elections in both countries in 2008 is now unlikely but the two sides still can and should agree before the polls to a document on basic principles, which if necessary clearly indicates the points that are still in dispute. Without at least such an agreement and while they engage in a dangerous arms race and belligerent rhetoric, there is a risk of increasing ceasefire violations in the next few years. By about 2012, after which its oil revenue is expected to begin to decline, Azerbaijan may be tempted to seek a military solution. The international community needs to lose its complacency and do more to encourage the leaderships to prepare their societies for compromise and peace.

862. Ethiopia and Eritrea: Stopping the Slide to War

Abstract:
The risk that Ethiopia and Eritrea will resume their war in the next several weeks is very real. A military buildup along the common border over the past few months has reached alarming proportions. There will be no easy military solution if hostilities restart; more likely is a protracted conflict on Eritrean soil, progressive destabilisation of Ethiopia and a dramatic humanitarian crisis. To prevent this, the international community – in particular, the UN Security Council and the U.S., which is the single most influential outsider – must act immediately to give both sides the clearest possible message that no destabilising unilateral action will be tolerated. Once the immediate danger is past, efforts should be reinvigorated to ensure that the parties comply with their international law obligations, disengage on the ground and restore the Temporary Security Zone (TSZ) – in a longer time frame – to develop political and economic initiatives for resolving the fundamental problems between the old foes.

Abstract:
The inter-related conflicts and peace processes in Sudan present a monumental peacekeeping challenge. The protracted crisis in Darfur has put the African Union – and the broader international community -- to a severe test. Plans for a hybrid African Union-United Nations operation there continue, but Khartoum remains opposed. Meanwhile, implementation of the north-south peace agreement is faltering, with the UN mission struggling to keep it on track in the face of indifference from both parties and frequent hostility from the north.

Abstract:
North Korea's international transactions have grown since the 1990s famine period. Illicit transactions appear to account for a declining share of trade. Direct investment is rising, but the county remains significantly dependent on aid to finance imports. Interdependence with South Korea and China is rising, but the nature of integration with these two partners is very different: China's interaction with North Korea appears to be increasingly on market-oriented terms, while South Korea's involvement has a growing noncommercial or aid component. These patterns have implications for North Korea's development, the effectiveness of UN sanctions, and its bargaining behavior in nuclear negotiations.

Abstract:
On February 2, an AEI research project on climate-change policy that we have been organizing was the target of a journalistic hit piece in Britain's largest left-wing newspaper, the Guardian. The article's allegation—that we tried to bribe scientists to criticize the work of the United Nations Intergovernmental Panel on Climate Change (IPCC)—is easy to refute. More troubling than the article is the growing worldwide effort to silence anyone with doubts about the catastrophic warming scenario that Al Gore and other climate extremists are putting forth.

The State Department's International Narcotics Control Strategy Report, released on March 1, offers a little-noted reference to a dubious claim: an Iranian government statement (made to the UN) that Tehran has established a Financial Intelligence Unit (FIU). The report notes that Iran has provided no further details. Even if the Iranian claim were true, the creation of an FIU would do little to combat terrorism financing in the nation, given Tehran's official support for terrorist groups. In other countries, FIUs are an important element of effective counterterrorism policy -- though the record of key Middle Eastern nations is somewhat mixed in this regard.

In the coming weeks, Syria will participate in two important regional conferences. On March 10, it will join Iraq's other neighbors and the five permanent members of the UN Security Council in Baghdad. On March 28-29, it will participate in the Arab League summit in Riyadh. Syria's detractors continue to criticize Damascus for failing to seal the border with Iraq and for meddling in Lebanese internal affairs in violation of UN Security Resolution 1701. Of equal importance is the downturn in Syria's relations with Saudi Arabia and Iran. Last week's Saudi-Iranian summit has Damascus worried about its role in Lebanon and the possibility of an international tribunal on the assassination of former Lebanese prime minister Rafiq Hariri, a crime for which Syria is widely believed to be responsible. Will the upcoming conferences give Syria a chance to improve its regional standing, or will its isolation continue?

868. Legality of the Deployment of Conventional Weapons in Earth Orbit: Balancing Space Law and the Law of Armed Conflict

Abstract:
The Bush Administration of the United States recently released a revised National Space Policy. Although the revised National Space Policy can be interpreted as a step towards the weaponization of space, it does not necessarily weaponize space. It nonetheless brings to the forefront important legal issues concerning the basing of conventional weapons in space. The present international law matrix on the issue of space-based weapons is to be found in international space law, principally in the Outer Space Treaty, where certain prohibitions apply to nuclear weapons and to weapons of mass destruction. Space must also be used for the benefit and in the interests of all countries, irrespective of their degree of economic or scientific development. Space objects must be registered in accordance with the Registration Convention. The UN collective security system and the customary right of self-defence govern the use of force or jus ad bellum. The means and methods through which self-defence is exercised are in turn governed by international humanitarian law. Should space be weaponized the basing of these weapons and their use will be subject not only to international space law but also to the UN Charter and to international humanitarian law. The interface between these legal regimes consequently gains in importance, possibly forcing a reinterpretation of certain space treaties along with a correction in state practice.

869. Kosovo: What Can Go Wrong?

At the end of the NATO/Yugoslavia war almost eight years ago, the Albanian-majority Serbian province of Kosovo was removed from Serbia's governance and placed temporarily under a United Nations protectorate, administered by the UN Mission in Kosovo (UNMIK). Last summer, UN Special Envoy Martti Ahtisaari was tasked by the Security Council with resolving the question of Kosovo's future status, with support from U.S. and European Union envoys (Frank Wisner and Stefan Lehne respectively). Ahtisaari's effort is now drawing to a close. He has delivered to both Pristina and Belgrade a plan that explicitly allows a great deal of protection for Serbs and their religious monuments in Kosovo but implicitly ends Belgrade's sovereignty. His plan opens the prospect of a sovereign and independent Kosovo under continuing international supervision. It is anticipated that Ahtisaari will take his plan, with some revisions, to the UN Security Council this month. This USIPeace Briefing discusses potential drivers of conflict in Kosovo during the status decision and in the period thereafter. These drivers of conflict arise from the international community, the Kosovo Albanians, Serbia and the Kosovo Serbs. They have the potential not only to make Kosovo dysfunctional but also to destabilize the region.

870. Security Sector Reform in Liberia: Domestic Considerations and the Way Forward

Abstract:
Security Sector Reform (SSR) is one of the four major objectives pursued by the Liberian government as it rebuilds after the fifteen-year civil war. The innovative approaches and framework employed by the government of Liberia and the international community to reform the Liberian security sector after the civil war were discussed at a meeting of the Liberia Working Group, an initiative of the United States Institute of Peace. The meeting, which took place on February 21, 2007 featured Ambassador Jacques Paul Klein, former United Nations special representative of the secretary general in Liberia (UNSRSG), and Andy Michels and Sean McFate, co-founders of Interlocutor Group. The panelists provided an overview of the policy framework used for security reform in post-conflict Liberia and the challenges facing Liberia in rebuilding its security services. This USIPeace Briefing highlights the central points of the meeting and summarizes recommendations for the way forward. Most of the discussion during the working group meeting centered on the reform of the army, although key points on police reform are also noted.
