411. Interrogations of Consent: A Reply to Erika de Wet

Abstract:
This article presents a critical engagement with the issue of force and intervention undertaken with the consent of the state in whose territory it ultimately occurs and offers a critical assessment of Erika de Wet’s article ‘The Modern Practice of Intervention by Invitation in Africa and Its Implication for the Prohibition of the Use of Force’. It considers the different interpretative approaches suggested for consent and the Charter of the United Nations’ prohibition of force as well as the principle or principles that have come to govern the issuing of valid consent in international law. The contribution turns to some of the methodological positions taken in exploring the continuing validity of the so-called ‘effective control principle’ in modern African practice, and, as it does so, it probes the utility of questions for the jus ad bellum of ‘other’ international law (such as developments within the jus in bello and the law on self-determination).

Abstract:
Despite their burgeoning reputation in peacekeeping, the African Union (AU) and the United Nations (UN) are apparently finding the conflict in the Central African Repub- lic (CAR) difficult to resolve. The explanation involves, in part, the complex situation within the country, apathy on the part of national political elites, and a lack of local participation in peacemaking. Other factors are linked to poor field leadership, the composition of the peacekeeping contingent, and the nature of the mandate. The situation demands more analysis of peace operations and the political conditions under which such operations occur, with a view toward lessening human suffering, making peacekeepers accountable, and brightening the prospects for peace.

Abstract:
The global refugee regime encompasses the rules, norms, principles, and decision-making procedures that govern states' responses to refugees. It comprises a set of norms, primarily those entrenched in the 1951 Convention relating to the Status of Refugees, which defines who is a refugee and the rights to which such people are entitled. It also comprises an international organization, the Office of the United Nations High Commissioner for Refugees (UNHCR), which has supervisory responsibility for ensuring that states meet their obligations toward refugees.

414. Comparative Approaches to Reconciliation: Canada, United States of America, Australia and New Zealand

Abstract:
This paper examines the approaches taken by the Governments of Canada, Australia, New Zealand and the United States to address the issue of reconciliation with Indigenous peoples. A wide array of activities have been employed in these countries to improve relations with Indigenous communities. The paper notes that no single program or policy can address reconciliation, and that much remains to be done in order to achieve societies that are cognizant of the historical and contemporary contexts that have contributed to the current socio-economic reality of Indigenous peoples in the four countries examined. The definition of reconciliation is also complex and no single definition can be deemed to capture the dynamic of state and community relations. The review of policies and programs addressing reconciliation in the four countries examined is not exhaustive in nature. Programs and policies have been chosen based on government and community feedback indicating they were making a difference. From these experiences, key elements of programs and policies required to address reconciliation are compiled. The findings stress that reconciliation is a long-term process, based on truth, informed decision-making and accountability on the part of all partners involved. The United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) is used as a lens to observe whether it can be used to address reconciliation efforts in a constructive manner. Many experts argue that the spirit of the UNDRIP could act as a symbolic guide and framework to address reconciliation efforts. In conclusion, the paper notes that reconciliation efforts in each country will require support and long term commitment from all sectors of society. It will also require the renewal of a partnership based on mutual long-term goals and objectives. The partnership must be closely monitored, supported and be based on mutual respect and accountability if it is to flourish.

415. Estimating Illicit Flows of Capital via Trade Mispricing: A Forensic Analysis of Data on Switzerland

Abstract:
This paper assesses the role of Switzerland as the leading hub for global commodities trading, in terms of the patterns of prices received by original exporting countries and subsequently by Switzerland and other jurisdictions. We find support for the hypotheses that (i) the average prices for commodity exports from developing countries to Switzerland are lower than those to other jurisdictions; and that (ii) Switzerland declares higher (re-)export prices for those commodities than do other jurisdictions. This pattern implies a potential capital loss for commodity exporting developing countries and we provide a range of estimates of that loss – each of which suggests the scale is substantial (the most conservative is around $8 billion a year) and that the issue merits greater research and policy attention. An important first step would be a Swiss commitment to meet international norms of trade transparency.

This article analyzes cases of police reform aimed at eliminating corruption. It focuses on two cases sharing similar problems of corruption in the past but with different outcomes after undertaking police reform: Georgia and Armenia. It seeks to understand why police reform is more successful in Georgia than in Armenia and uses legal documents, external reports, and secondary literature in this cause. It concludes that the primary factor influencing the outcome is a change in the political elite. Other factors contributing to the outcome of the police reforms were the involvement of foreign actors, the content of the reform, and the magnitude of the corruption.

In July 1995, the Bosnian Serb army invaded the enclave of Srebrenica, a UN safe area guarded by Dutch blue helmets, and murdered about 8,000 Muslim Bosniak civilians under the eyes of the international community. Reports say that even as of today as many as 2,306 victims from the massacre are still missing. Abstract:
Recently The Economist (2013a), a prominent journalistic advocate of strong policies to control CO2 emissions, expressed their puzzlement on the absence of warming over the last 15 years. They observed that this flat period of global average temperature occurred despite that CO2 emissions from human sources continued at an increased rate. The total human-produced CO2 emissions in that period of flat temperatures represent a quarter of all such emissions ever produced. The standard climate models, such as those used by the United Nation's International Panel on Climate Change (UN IPCC), anticipated that such massive CO2 increases should have caused continuing increases in average global temperatures. The Economist noted that observed global average temperature is now at the lowest end of the predicted range, and that if the present trend continues, the actual temperatures will soon be below even the lowest forecasts. Most recently, Fyfe, Gillett, and Zwiers (2013) demonstrated that the current climate models have experienced a systematic failure—a finding very similar to Knappenberger and Michaels (2013).

Brazilian attitudes toward national sovereignty and non-intervention are in a state of flux. Leaders in Brasília are seeking to actively take part in the current global rethink about the future of humanitarian intervention, and are increasingly willing to deploy men in uniform to distant lands when the lives of civilians are at stake. The change is significant because Brazil has historically championed national sovereignty. Many in Washington DC and in European capitals, however, view this as problematic. The skeptics dismiss Brazil's newly professed commitment to humanitarian intervention as an effort to complicate the ability of the United States and its allies to intervene worldwide on behalf of democracy and human rights. As U.S. Ambassador to the United Nations Susan Rice said in reaction to the attitudes of Brazil and other developing countries to policy toward Libya, Sudan, Côte d'Ivoire, and Syria: “Let me just say, we've learned a lot and, frankly, not all of it encouraging.”

420. Peace, Women and Security: A Latin American Perspective

Abstract:
The United Nations Security Council has promoted a gender focus in peacekeeping operations, including the protection of civilians, since the adoption of Resolution 1325 (RES1325) in 2000. The logic is simple: involving women in peace negotiations and reconstruction efforts helps ensure a more equitable and stable society following conflict. Since December 2000, Latin American participation in peacekeeping operations has increased by nearly 1,000 percent.1 Of 7,140 military troops deployed in peacekeeping operations worldwide, female personnel participating in those missions total 238, or 3.3 percent. In the two missions with the most Latin American personnel, the region's female representation is higher than that of many other countries, but still lower than the target of 10 percent laid out in UN RES1325. For example, female personnel make up only 2 percent of the United Nations Stabilization Mission in Haiti (MINUSTAH), but they make up 2.5 percent of all troops deployed from Latin America.2 Likewise, in the United Nations Organization Stabilization Mission in the Democratic Republic of the Congo, overall female participation is 2.2 percent, but women make up 6.4 percent of Latin American personnel deployed.
