Abstract:
In the second issue of our 20th volume, the critical diplomatic roles from grassroots advocacy to international negotiations are explored. Nahla Valji and Pablo Castillo open this issue, arguing for the importance, and ultimate necessity, of gender parity for the success of the United Nations’ peace and security efforts. This article discusses the great need for gender parity both within the UN system as well as within its advocacy on the ground. Following, Tanya Ansahta Garnett and Kari Øygard offer a case study on women’s roles in peacebuilding and civic engagement in post-conflict Liberia. They discuss whether or not women’s participation and representation is an effective strategy towards meaningful long-term change. Lina Abirafeh then examines the widespread issue of genderbased violence in the Arab region by outlining several case studies. Abirafeh then considers how it continues to withhold women’s political and legal progress in the region. Changing gears, Catherine Tinker and Renata Koch Alvarenga then survey the successes and continued drawbacks to gender equality in climate finance, offering a call to action for quicker implementation of a genderresponsive approach to mitigating the effects of climate change. Rachel Clement and Lyric Thompson conclude this issue by discussing the theory behind a feminist foreign policy and what it will take to move beyond the definition to a comprehensively feminist approach to foreign policy that is engrained in all sectors of diplomacy while also elevating traditionally unheard voices.

92. State-led Responses to the Indian Energy Challenge: Infrastructure Expenditure, Central Public Sector Enterprises and Electrification

Abstract:
In the 21st century, economic growth, increasing urbanization, demographic expansion, and advances in electrification as important drivers of energy demand have put significant pressure on the Indian energy landscape. Indeed, energy infrastructure problems are a major hindrance to India’s economic growth. The central objective of this paper is to present and analyze some of the main State-led policy efforts that have been put in place to address India’s energy challenge. In particular, we examine three main types of state-led energy policy in India: a) infrastructure expenditure, b) Central Public Sector Enterprises (CPSEs) investments and Research and Development (R&D) strategies, and c) electrification. Firstly, we present and examine current data on the role of the state in the development of India’s energy sector. Secondly, we provide a nuanced examination of the role of public-private relations in India’s energy sector, especially in contrast to the widespread advancement of the neoliberal agenda in the country recent years. We conclude that the Indian State has fostered an increasing participation of the private sector in infrastructure, especially in renewable energies in which PPPs type of procurement have been more relevant. CPSEs’ expenditure in R&D has been of main importance in oil as well as in power. However, most of them tend to adapt foreign technologies instead of balancing foreign technologies with domestic technological efforts. Therefore, a main contemporary challenge for the Indian CPSEs performing in the energy sector is to deepen their connections and interaction with the other Indian NSI actors. Through the electrification process, the State has created markets for the private sector. Finally, we recommend further energy-related questions to be addressed in future research projects.

93. Prohibitions and Export Assessment: Tracking Implementation of the Arms Trade Treaty

Abstract:
This Geneva Paper shows that ATT states parties generally implement the ATT’s prohibitions set forth in Article 6 through national laws and policies. This paper also demonstrates that exporting states implement the ATT’s obligations regarding export assessment contained in Article 7 in many different ways. While the spectrum of how exporting states parties consider an arms exports’ potential effect on peace and security is very broad, their national frameworks contain similar or nearly identical export criteria on assessing the risk of arms being used for serious violations of international humanitarian law and international human rights law. Few states parties have national export criteria regarding terrorism, transnational organized crime and gender-based violence. States also consider national criteria other than those specified in Article 7 before authorizing arms exports, including positive consequences of arms exports. Finally, states parties’ national frameworks mostly do not define clear thresholds for denying arms exports. Given this divergence in states party implementation, in addition to a remaining lack of clarity on how states apply the ATT provisions in practice, this paper recommends reinforcing dialogue on ATT implementation. This could lead to better understanding and implementation guidance that strengthens the emergence of common standards and improves the quality of national export assessments. To increase states parties’ knowledge on risks to be avoided, institutionalizing cooperation with human rights bodies and establishing an ATT internal information exchange mechanism is also recommended.

94. A Spoiler in the Balkans? Russia and the Final Resolution of the Kosovo Conflict

Abstract:
The biggest point of contention in the Balkans is back on Europe’s front burner. For decades, Serbia was mired in a conflict with Kosovo, its breakaway province that unilaterally declared independence in 2008 after violent ethnic clashes and international intervention in the late 1990s. Last year, a protracted diplomatic effort to end the conflict was unexpectedly boosted when then U.S. national security adviser John Bolton announced that U.S. President Donald Trump’s administration was ready to consider changes to the Serbia-Kosovo border as part of a settlement. The Serbian government welcomed the idea, giving rise to hopes that a negotiated solution to the Balkan conflict is now potentially within reach. Still, any final settlement is very much an uphill battle. Many Kosovar leaders are not enthusiastic about the proposed border correction, which would entail swapping areas in northern Kosovo populated mainly by ethnic Serbs for Serbian municipalities dominated by ethnic Albanians. Germany and other members of the European Union (EU) have disapproved strongly, arguing that redrawing boundaries may open a Pandora’s box, with unpredictable ripple effects.2 On top of all that, it is increasingly clear that Russia, which has long held great sway over the region, may not actually want the conflict resolved at all. So long as Serbia does not formally recognize Kosovo’s independence, it must rely on Russia’s veto power in the United Nations (UN) Security Council to prevent full international recognition of what it regards as a breakaway province. That dependency gives Russia a nontrivial degree of influence, both in the region and within Serbia itself. The Kremlin fears that ending the conflict between Serbia and Kosovo will diminish Russia’s stature in Serbia and severely undermine its clout in the Balkans. Moscow is well-positioned to derail the resolution process. Russian President Vladimir Putin enjoys unchecked popularity across most of Serbian society, and the Russian political and national security establishment maintains close ties with its counterparts among Serbia’s political and security elites, who tend to strongly oppose any compromise with Kosovo. From all appearances, Moscow also hopes to use its influence over the Kosovo issue as leverage in its acrimonious relationship with the West.

95. The Global Refugee Regime and UN System-wide Reforms

This paper considers how responsibility for ensuring refugee protection and access to solutions can be shared more reliably across the United Nations’ system, by examining entry points beyond traditional humanitarian actors (including peace and security actors in the United Nations), as well as the role states can play in supporting a broader response from the UN system. It draws upon a range of literature and concepts, including the Responsibility to Protect doctrine, offering a mapping and analysis of the proposed UN reforms within the humanitarian, development, financial, and peace and security sectors. It then considers how these reforms might be relevant to responsibility sharing in displacement situations and lays out some of the broader challenges to greater responsibility sharing. Finally, the paper provides recommendations for how to more fully engage these other actors — within the United Nations and beyond — to improve the prevention of, response to and resolution of displacement.

Abstract:
For the millions of refugees fleeing conflict and persecution every year, access to information about their rights and control over their personal data are crucial for their ability to assess risk and navigate the asylum process. While asylum seekers are required to provide significant amounts of personal information on their journey to safety, they are rarely fully informed of their data rights by UN agencies or local border control and law enforcement staff tasked with obtaining and processing their personal information. Despite recent improvements in data protection mechanisms in the European Union, refugees’ informed consent for the collection and use of their personal data is rarely sought. Using examples drawn from interviews with refugees who have arrived in Europe since 2013, and an analysis of the impacts of the 2016 EU-Turkey deal on migration, this paper analyzes how the vast amount of data collected from refugees is gathered, stored and shared today, and considers the additional risks this collection process poses to an already vulnerable population navigating a perilous information-decision gap.

97. Not All that Glitters Is Gold: An Analysis of the Global Pact for the Environment Project

The Global Pact for the Environment (GPE) is a draft treaty prepared in 2017 by a French think tank, Le Club des Juristes, which aims at strengthening the effectiveness of international environmental law (IEL) by combining its most fundamental principles into a single overarching, legally binding instrument. In May 2018, the United Nations General Assembly (UNGA) adopted Towards a Global Pact for the Environment, a resolution that established an intergovernmental working group to discuss the necessity and feasibility of adopting an instrument such as the GPE, with a view to making recommendations to the UNGA. As the working group nears its final session, scheduled for May 20–22, 2019, this paper discusses the extent to which codifying the fundamental principles of IEL into a treaty could increase the problem-solving effectiveness of environmental governance. The analysis suggests that the added value of the proposed GPE (or any such instrument) may not be as evident as what its proponents argue. The paper also highlights the fact that the adoption of such an instrument could generate unintended consequences that would hinder the development of more effective environmental standards in the future.

98. Governance of Marine Geoengineering

After more than two decades of UN negotiations, global greenhouse gas emissions continue to rise, with current projections indicating the planet is on a pathway to a temperature increase of approximately 3.2°C by 2100, well beyond what is considered a safe level. This has spurred scientific and policy interest in the possible role of solar radiation management and carbon dioxide removal geoengineering activities to help avert passing critical climatic thresholds, or to help societies recover if global temperatures overshoot expectations of safe levels. Marine geoengineering proposals show significant diversity in terms of their purpose, scale of application, likely effectiveness, requisite levels of international cooperation and intensity of environmental risks. This diversity of marine geoengineering activities will likely place significant new demands upon the international law system to govern potential risks and opportunities. International ocean law governance is comprised of a patchwork of global framework agreements, sectoral agreements and customary international law rules that have developed over time in response to disparate issues. These include maritime access, fisheries management, shipping pollution, ocean dumping and marine scientific research. This patchwork of oceans governance contains several bodies of rules that might apply in governing marine geoengineering activities. However, these bodies of rules were negotiated for different purposes, and not specifically for the governance of marine geoengineering. The extent to which this patchwork of rules might contribute to marine geoengineering governance will vary, depending on the purpose of an activity, where it is conducted, which state is responsible for it and the types of impacts it is likely to have. The 2013 amendment to the London Protocol on ocean dumping provides the most developed and specific framework for marine geoengineering governance to date. But the capacity of this amendment to bolster the capacity of international law to govern marine geoengineering activities is limited by some significant shortcomings. Negotiations are under way to establish a new global treaty on conservation of marine biodiversity in areas beyond national jurisdiction, including new rules for area-based management, environmental impact assessments and capacity building/technology transfer. A new agreement has the potential to fill key gaps in the existing patchwork of international law for marine geoengineering activities in high-seas areas. However, it is also important that this new treaty be structured in a way that is not overly restrictive, which might hinder responsible research and development of marine geoengineering in high-seas areas.

99. Senior Leadership Training in UN Peace Operations

Abstract:
Due to their unique and complex nature, UN peacekeeping missions depend on effective leadership. Because few, if any, mission leaders have the requisite skills, knowledge, political judgment, and physical and mental stamina upon being selected, they require continuous, institutionalized, and sustained training and learning support. While the Secretariat has undertaken a number of training and learning initiatives, critical gaps remain. This paper identifies these gaps and analyzes obstacles that impede progress in addressing them. It looks at gaps in three broad areas: knowledge of peacekeeping doctrine, policy, and practice specific to UN peacekeeping; knowledge of UN policies and procedures on financial and human resources management; and leadership and team-building skills. To address these gaps, it recommends that the Secretariat prioritize action in several areas: Centralize responsibility for mission leadership training in a single unit; Integrate training into planning and recruitment processes; Provide more sustained support to training; and Employ new tools such as scenario-based exercises for in-mission training.

100. A Necessary Voice: Small States, International Law, and the UN Security Council

Abstract:
The international rule-based order has come under threat on multiple fronts. If it continues to deteriorate into an older model based on power politics, small states—by definition vulnerable in a world where only might makes right—are most at risk. This makes them natural defenders of the international order that protects them. How can small countries serve as effective champions of the rule-based order and international law? This paper explores this question by looking at the role of small states on the UN Security Council. The council, with its five veto-wielding permanent members, is perhaps not an obvious place to look at the role of small states. Nonetheless, it presents critical opportunities, as well as difficult challenges, for small states. This paper concludes that small states on the Security Council are well-placed to provide an important, credible voice with moral authority to remind all member states of their obligations under international law, reaffirm normative commitments to compliance, and advocate for a recommitment to a multilateral, rule-based international order. Perhaps not since the founding of the United Nations has that voice been more necessary for all to hear.
