81. Recommendations for Electoral Reform in the Democratic Republic of the Congo

Abstract:
The Democratic Republic of the Congo’s (DRC) 2018-19 elections were followed by the country’s first peaceful and democratic transfer of executive power. However, the elections – particularly their results management – were widely criticized. While voters appear to have ultimately accepted the results, lingering uncertainty could depress future voter turnout and undermine the current government’s authority. This post-electoral period offers an unprecedented opportunity to initiate broad electoral reforms to shore up the credibility of future elections. A white paper from the International Foundation for Electoral Systems (IFES) analyzes the DRC context and finds that the government or Parliament could initiate the reform process. IFES then highlights comparative examples of electoral reform from Kenya, Senegal, Nigeria and Côte d’Ivoire and presents considerations and recommendations for the DRC. Given that truly inclusive, sustainable and holistic electoral reform could take years to complete, the process should begin now to ensure more credible, transparent elections in 2023 and beyond.

Abstract:
After decades of power centralized in the executive, the Maldives’ 2008 Constitution introduced separation of powers and created “independent institutions to monitor the three branches of power and safeguard human rights.” The Election Commission, Anti-Corruption Commission and other independent institutions must have sufficient autonomy to operate effectively and carry out their mandates without susceptibility to undue influence. However, they are not immune from corruption, poor leadership or partisan behavior, and still require oversight to ensure accountability. Finding the correct balance between accountability and autonomy can be challenging, but it is essential to ensure that the institutions appropriately fulfill their mandates. In response to a request from Parliament, the International Foundation for Electoral Systems (IFES) conducted an extensive literature review, analyzed comparative practices and consulted stakeholders to develop a set of recommendations for effective parliamentary oversight of independent institutions. The resulting paper, Parliamentary Oversight of Constitutional Bodies in the Maldives, explores how parliamentary tools and mechanisms can be effectively tailored to provide the appropriate level of oversight. The paper has recommendations and lessons that are broadly applicable outside the Maldivian context, and helped inspire the development of IFES’ Autonomy and Accountability Framework. Because constitutional bodies have a unique role to play in bolstering good governance, any improvement to their performance will improve the quality of democracy as a whole and help prevent corruption, improve service delivery and increase transparency and rule of law. IFES’ Autonomy and Accountability Framework helps countries achieve this in practice.

83. From Transparent to Transparency: The Evolution of the Mekong River Commission's Prior Consultation Process

An Pich Hatda, CEO of the Mekong River Commission, explains that: “The mainstream hydrology is changing, affecting the timing and volume of reverse flows into the Tonle Sap Lake, and making any definition of the wet and dry seasons a moving target.” Chapter III of the 1995 Mekong Agreement outlines the objectives and principles that underpin transboundary governance in the Lower Mekong Basin (LMB). But the powers and functions outlined in the Agreement and the Rules of Procedures for the standing bodies, and the non-interventionist approach that underpins diplomacy in the region, dictate how this is done. While Chapter III of the Agreement outlines the intentions of transboundary governance, the more detailed processes that underpin water diplomacy were deferred to agreement on Rules for Water Utilisation and Inter-Basin Diversion, now the five MRC Procedures. These took another 20 years to finalize. The Procedures for Notification, Prior Consultation, and Agreement (PNPCA) may pose some of the biggest challenges for the Mekong River Commission (MRC). The Member Countries envisaged three forms of inter-State dialogue: Notification: applied to all uses on the tributaries and intra-basin use in the wet season; Prior Consultation (PC): applied to intra-basin use in the dry season, and inter-basin diversion of water in the wet season; and Agreement: applied to inter-basin use in the dry season.

84. Citizen Participation in Latin America’s Supreme Audit Institutions: Progress or Impasse?

The notion of citizen participation in external audit processes dates back to the end of the 20th century. A few declarations of the General Assembly of the Organization of Latin American and Caribbean Supreme Audit Institutions (OLACEFS) and the work of its Citizen Participation Commission (CPC) have contributed to its conceptualization and recognition, encouraging the work of Supreme Audit Institutions (SAI) around this theme. This has been reflected in the institutional strategic plans and annual reports of a set of SAIs in the region. Therefore, the current debate now goes beyond whether citizen participation in the audit process is necessary and why. After more than two decades since the first reference to citizen participation in external auditing in a statement from the OLACEFS General Assembly, the question is how much and in which way SAIs’ promotion of citizen participation has made progress, and what are the results to date. That is to say, the question currently centers around the scope and depth of such citizen participation. Based on in-depth interviews and desk-review, as well as submitting requests for information, the analysis shows that the incorporation of the term “citizen participation” as an ingredient for audit process has advanced at a faster rate than its implementation. The implementation of citizen participation varies significantly among SAIs in the region in terms of its scope and depth. In many cases, it is still limited to a bounded exercise—generally a particular type of practice and/or to promoting participation during a specific phase of the audit cycle. Nonetheless, there is no evidence of the existence of a meaningful strategy—with specific objectives, instruments and results indicators—for citizen participation linked to broader organizational and learning processes within SAIs, nor a profound transformation in the exercise of audits. For this reason, after 20 years, it is worth considering whether progress is really being made, or there is an impasse in addressing citizen participation by SAIs in the region. In terms of the scope of citizen participation in oversight in the audit cycle, with exceptions, there is a significant deficit of practices and experiences of participation in SAIs during the phase of executing audits and following up on the findings and recommendations issued by SAIs. Regarding the depth of citizen participation in audits, there is an emphasis on the use of citizen complaints or channels for denunciations [although evaluations of its effectiveness are lacking] as well as dissemination of audit reports, followed by public awareness or training. However, according to the maturity model on citizen participation proposed by the Declaration of the OLACEFS General Assembly of Punta Cana in 2016, the practice of citizen complaints is associated with its most basic level of citizen participation. Furthermore, SAIs tend to promote consultative practices rather than collaborative practices, unlike other innovative spaces for participation, such as the Open Government Partnership. Finally, the number of SAIs that use new information and communication technologies for participation and collaboration with citizens is limited—beyond the use of online complaint systems and social media for communicating SAI work. For this reason, the question arises as to how far SAIs are adapting to the latest innovations and changes in citizen participation. This working paper provides an overview of citizen participation in external auditing in Latin America. After the introduction, Chapter 2 presents a synthesis of the evolution on citizen participation within the OLACEFS, as well as the progress observed in SAIs in the region. Chapter 3 proposes an analytical framework on citizen participation in auditing based on two dimensions: its scope and depth. Chapter 4 examines a set of SAI citizen participation practices in the region according to the four-level classification (basic / low / intermediate and advanced) proposed in the OLACEFS Declaration of Punta Cana. Chapter 5 analyzes a couple of practices and experiences of citizen participation in auditing due to its degree of institutionalization: participatory planning in the annual audit program of Argentina’s General Audit Office and the articulated audit at the General Comptroller Office of Colombia. Chapter 6 delves into the citizen participation policy of the General Comptroller Office of Colombia. Finally, the conclusion highlights some findings and recommendations for the future. As a result of the analysis undertaken, this study recommends that the OLACEFS’ Citizen Participation Commission promote an evaluation of the extent of citizen participation in each SAI according to its proposed levels of maturity, and that each SAI publicly reports on the effectiveness of the practices implemented (including the SAI’s responsiveness) as well as the impact of such citizen participation on external auditing. Brendan Halloran of the International Budget Partnership contributes a preface that frames citizen engagement with Supreme Audit Institutions in the broader context of accountability ecosystems. 85. UN Reform and Mission Planning: Too Great Expectations?

Since 2017, the UN system has undergone a historic process of reform at several levels and across many entities. Several of these reforms have either directly aimed at improving the planning of UN missions or included elements that have a significant bearing on mission planning. As the focus shifts from designing to implementing these reforms, it is possible to begin reflecting on whether these aims have been met. This paper takes stock of the various strands of UN reform and explores their impact on the planning of UN missions, drawing on the experiences of four missions that have recently started or transitioned. In addition to the peace and security, management, and development system reforms, it looks at the impact of several other recent initiatives. These include the launch of a series of independent strategic reviews of peace operations, the reinvigorated use of the secretary-general’s transition planning directives, the rollout of the Comprehensive Performance Assessment System, and the establishment of the Executive Committee. The paper concludes by recommending that the UN consider: Tying together the strands of reform related to planning to prevent fragmentation; Making increased and better use of peace and security management mechanisms at the initial stages of planning to ensure that UN leaders have a unified tone and vision; More formally and transparently involving the Security Council in strategic reviews; Clarifying and strengthening the role of all relevant departments and the shared regional divisions in the mission budget process; Repositioning DPO’s planning cell in the Office of Shared Services to move toward a shared planning capacity; and Incentivizing lateral movement of personnel across departments and entities to broaden their perspectives.

Management by way of top-down controls and targets sometimes gets in the way of aid donors’ aims, undermining project success. These unhelpful controls often stem from a need to account for performance; legislatures or executive boards induce agencies to exercise tight process controls and orient projects towards what is measurable and reportable. My 2018 book, Navigation by Judgment, presents quantitative empirics from a database of 14,000 projects and qualitative evidence from eight case studies in support of this claim. I wrote the book in part because I imagined it would be useful to show aid agencies and authorizers empirics that demonstrated the problem—that the first step to change was recognition. But after talking about my book at aid agencies and authorizers, I am confident that while my 2018 diagnosis was right, my theory of change was all wrong.

In turn, the term glasnost’, that is transparency, referred to various areas of life, but above all to media policy. The top-down pressures as well as personnel changes in the leading editorial offices led to the disclosure of information that has been censored so far. However, as noted by Canadian historian David Roger Marples: “In general, more progres- sive reportages could be found in the central press rather than in individual republics, with a notable exception to the Baltic states”8. Although perestroika in the initial years contained processes with varying effects, it finally ended in defeat. The failure of perestroika cou- pled with the success of glasnost, therefore made it impossible to cover up the first one. Additionally, it all happened during a lack of political unity in the Kremlin9. What’s more, Gorbachev’s policy led to a situation in which: „A sense of national identity was growing significantly in each of the republics belonging to the USSR. It also had a huge impact on the mood of all groups of national minorities, reflected in the desire to revive and preserve their mother tongue and national traditions”10. Thus, an increase in the consciousness of belonging to a particular nation was, on one hand, a factor leading to the desire for independence by societies of individual republics, and on the other hand, had a decisive influence on the revival of the identity of national minorities in their territory.

Transparency by design: Transparency should be the norm for all government contracts, particularly regarding information on what is being exchanged and for what price. Contracting systems should be designed to support proactive publication of contracts as open data. Public contracting should be designed for transparency and efficiency. Full contract publication should be the norm. Information needed to judge value for money should be disclosed. Exceptions in the public interest: Redactions on the basis of commercial sensitivity should only be justified where the public interest in withholding information is greater than the public interest in having that information published. The assessment should take into account both any commercial harm to the contractor and the broader benefits of transparency to markets and public trust. Where exceptions to publication are considered: Information should only be redacted for reasons of commercial sensitivity when the public interest in withholding information is greater than the public interest in disclosure. The public interest test should take into account the wider economic benefits of the sharing of commercial information, as well as the case for accountability and the public’s right to know. All redactions should be clearly marked with the reason for redaction. A clear and robust process: Governments should issue detailed guidance on commercial sensitivity principles and exemptions, put in place systems to support publication, ensure that redaction is time-limited, and use other oversight mechanisms to compensate for information withheld from publication. Governments should issue clear guidance to public entities, agencies, and firms on contract publication and when information may be exempted from publication for commercial sensitivity reasons. Where redaction is potentially allowed, there should be a clear process for determining what is redacted, why, for how long, and with what appeals process. There should be a system for ensuring that contracts and contract information are in fact disclosed in practice. Where exemption to disclosure of information is granted for commercial sensitivity reasons, this should be grounds for increased scrutiny through other oversight mechanisms.

spending on pharmaceuticals and other healthcare commodities is high and makes up a large proportion of healthcare spending in rich and poorer markets alike. A popular response to the problem of escalating drugs budgets has been transparency of drug pricing within and across borders. In a rare alignment of policy priorities, the Trump administration, the US Senate, and the World Health Organisation are calling for more transparency of the prices paid for prescription drugs as a means of tackling the ever-growing pharmaceuticals bill. Recently Italy’s health minister joined in, calling for a World Health Assembly resolution which would mandate WHO to “provide governments with a forum for sharing information on drug prices, revenues, research and development costs, public sector investments and research and development subsidies, marketing costs and other related information.” But is price transparency really the answer to healthcare systems’ fiscal sustainability challenges as they strive to expand access to new technologies or even merely sustain provision within strained public budgets? Well, it depends!
