Abstract:
Misuse of personal information, manipulation of platforms to influence elections, and failure to extend broadband to underserved areas are a few of the problems facing governments at all levels. Increasingly, policymakers are taking up the challenge of shaping legal solutions to these problems, only to find they lack both the tools and technical expertise to regulate wisely, meaningfully and efficiently. Given the current technological environment, what goals are appropriate to assure that emerging technologies are used to benefit the populace and do not harm society? Participants of the 34th Aspen Institute Conference on Communications Policy, which took place in Aspen, Colorado in August 2019, examined regulatory frameworks that can provide a successful model for future problems as they inevitably appear. The report of the Conference explores approaches to impede harms from digital and network technologies that address user protection, promote consumer choice and competition, and foster access to essential services.

The European Union’s capital markets union (CMU) plan is in urgent need of a revamp. Because of Brexit, EU capital markets and supervision need to become more integrated. The ongoing deep recession increases the need for equity finance mobilised by capital markets. The eleven EU countries in central and south-eastern Europe which joined the EU in 2004 and after (EU11) are particularly affected by the ongoing consolidation of exchanges, which has diminished liquidity in smaller markets and in the traded securities of mid-sized companies. Corporate funding remains even more bank-dependent in the EU11 than in the rest of the EU. Equity capital, whether in the form of listed shares or directly supplied by investment funds, is particularly underdeveloped. Even though the sustained and superior growth record in the region compared to the rest of the EU should be a magnet for investors, cross-border exposure to traded equity in the region remains very limited. To gain broader acceptance in all EU countries, CMU will need to support more forcefully funding for small and medium enterprises (SMEs), and foster market integration throughout the single market, including outside the euro area. The immediate priorities for the EU should be to revise market regulation and facilitate capital market access by smaller firms. Lighter standards in dedicated SME markets should be widened for newly-listed companies, but should not be available to more mature listed companies. In this way, high standards of transparency and integrity, which have been bolstered by post-financial crisis regulation, will be preserved. The EU11 countries need to embrace corporate governance rules and greater transparency of company financial data, which would facilitate equity finance. They must also attract investors who will seek disclosure of environmental, social and governance performance of issuers. Much could be done to foster liquidity on national exchanges, including by embracing the inevitable further consolidation of exchanges and other infrastructure.

Abstract:
Quantum computing refers to the use of quantum properties—the properties of nature on an atomic scale—to solve complex problems much faster than conventional, or classical, computers. Quantum computers are not simply faster versions of conventional computers, though they are a fundamentally different computing paradigm due to their ability to leverage quantum mechanics. Harnessing quantum properties, namely the ability for the quantum computer bits (called “qubits”) to exist in multiple and interconnected states at one time, opens the door for highly parallel information processing with unprecedented new opportunities. Quantum computing could potentially be applied to solve important problems in fields such as cryptography, chemistry, medicine, material science, and machine learning that are computationally hard for conventional computers. Although it is still unclear which specific tasks can benefit from parallelized quantum processing, known as quantum parallelism, it is expected that solutions to a number of problems, especially those related to optimization, can be greatly accelerated by using a quantum computer. Though the field is still in its early stages, the anticipated opportunities offered by the unique computational power of quantum computers have attracted investment from not only research universities, but also startups, technology giants like Google, IBM and Microsoft, and directed investment by governments around the world. This cross-sectoral ecosystem has supported recent progress in underlying hardware, software, and algorithms necessary to make the computers work. The field has seen rapid advancement, however systems that can accomplish various kinds of computation, and especially those that can be commercially viable, are still likely to be decades away. There are expected to be some near- term applications on the horizon though, making quantum computing as relevant as ever. Currently, U.S. governance and regulation regarding quantum computing—a subset of the broader field of quantum information science, which also encompasses quantum communication and quantum sensing—focus on investments in the technical knowhow, collaborative research ecosystem, and human capital required to advance the technology. Given quantum computing’s potential for impact, especially in the fields of digital security, healthcare, energy, and machine learning and artificial intelligence, it is important for policymakers to understand the likely trajectories of the technology over the coming decades, as well as the pace of development both within the U.S. and abroad. Furthermore, policymakers must consider how to effectively promote the development, application and implementation of general-purpose quantum technologies to realize their larger economic and social benefits, while simultaneously mitigating foreseeable risks to privacy, safety, security, and inclusion.

The global transition from fossil fuel-powered vehicles to electric vehicles (EVs) will require the production of hundreds of millions of batteries. The need for such a massive deployment raises questions from the general public and critics alike about the sustainability of the battery supply chain, from mining impacts to vehicle carbon emissions. Growing demand for the mineral inputs for battery production can provide an opportunity for mineral-rich countries to generate fiscal revenues and other economic opportunities. But where extraction takes place in countries with weak governance, the benefits expected by citizens and leaders may not materialize; in some cases extraction might even exacerbate corruption, human rights abuses and environmental risks. Many EV proponents and suppliers are aware that supply chain governance problems pose a challenge to the evolution of the EV industry, but outstanding questions remain about how these challenges materialize. This brief, jointly published by UC Berkeley School of Law’s Center for Law, Energy & the Environment (CLEE) and the Natural Resource Governance Institute (NRGI) provides basic information on the EV battery supply chain and key battery minerals, such as cobalt and lithium, and addresses the following questions: What does the supply chain for EV batteries comprise? How do carbon emissions from EVs compare to traditional internal combustion engine (ICE) vehicles? What are the most significant challenges in managing the mineral extraction necessary for the EV supply chain, and what sustainability and human rights initiatives apply?

Abstract:
American businesses and consumers have an unequal relationship. Consumers generally are and should be sovereign because a consumer—not a seller, nor a third party, nor even the government—usually decides what to purchase. Consumers must like a business to buy its product or service. If a business has poor service, sales will suffer. And if a business is tainted by scandal, customers will flee. As courtiers of purchasing power, businesses go on bended knee to pay homage to the consumer. Typically, a business need not like a consumer to sell products or services. In most lines of business, a seller must sell to anyone willing to pay. And although there are types of businesses where a seller can legally refuse a sale, most rational sellers seek as many customers as possible.

This report addresses China’s approach to development in Central Asia, Southeast Asia, East Africa, and the Arctic. China has worked through the Shanghai Cooperation Organization to meet Russian demands for continued regional primacy in Central Asia, helping Beijing foster economic and social dominance, access strategic energy resources, and treat the Uyghur minorities as a problem of terrorism rather than a development issue. In Southeast Asia, China has worked through the Association of South-East Asian Nations (ASEAN) to meet regional demands for soft and hard infrastructure to legitimize China’s growing strategic presence. China is therefore able to undermine the regional economic and security foothold of the US alliance system and challenge the interpretations of the Law of the Sea that legitimizes the military presence and activities of extra regional powers. In East Africa, China has cooperated with the African Union (AU) and the East African Intergovernmental Authority on Development (IGAD) to address regional demands for hard and soft infrastructure without political conditions, to link antipiracy problems to problems of poverty, and to mediate local civil wars. This has helped China establish an economic and strategic foothold at the intersection of the Indian Ocean and Middle East, projecting power far from its shores. In the Arctic, China has established research stations that function as both environmental research laboratories and military surveillance stations.

This policy brief presents the summary fi ndings of a study on Promoting Financial Cooperatives (FCs) in Zambia that was conducted between 2017 and 2018 with fi nancial support from the Rural Finance Expansion Program (RUFEP), Ministry of Commerce Trade and Industry (MCTI) and the Zambia Center for Accountancy Studies (ZCAS). The study used both qualitative and quantitative approaches which included a situational analysis of FCs in Zambia, a study tour to Kenya and a census of Financial Cooperatives (FCs) eight provinces. The main objective of the study was to contribute to the development of FCs in Zambia by generating information on their performance. The secondary objectives of the study were to: 1. Undertake a situational analysis to develop a clear understanding of the landscape for the FCs in Zambia in terms of the regulatory framework, support institutions and the nature and level at which the FCs operate. 2. Undertake a Census of cooperatives to understand the opportunities and constraining factors for the growth of the Cooperatives movement in Zambia. It was envisaged that the study would provide evidence about FCs that could be used in the revision of the Cooperatives Act currently underway, aid MCTI understand the nature of Cooperatives and devise strategies for monitoring FCs. The study also aimed at providing information about the state of FCs that can used by the apex body of FCs and stakeholders such as Bank of Zambia.

209. Do We Need an EU Ethical Food Label?

Abstract:
Eradicating the exploitation of agri-food workers, promoting fairer food supply chains, and offering consumers effective tools to make truly informed food choices remain huge challenges in Europe. This report highlights the limitations of relying solely on food labelling schemes to meet these goals, and finds that voluntary certification schemes do not adequately enforce regulations or protect human rights. The report also argues, however, that the EU can use a number of tools to foster more just food supply chains, with ethical labels playing a role in that process as part of a “smart mix” of measures. The case studies in this report show that it is possible to have increased transparency in food labelling and supply chains, as well as better protections of workers in Europe and throughout the world. Additionally, the report explains how the EU can play an important role in providing food businesses with clear regulatory frameworks to ensure their operations do not harm workers or the environment.

210. Innovation and Less Harmful Alternatives to Tobacco: The Case of Nicotine Pouches Regulation

For some years now, tobacco-free nicotine pouches – a tobacco-free version of pre-portioned snus – have been available on the Swedish market. Although the use of the product is increasing and is marketed outside Europe, nicotine pouches are not subject to any specific product regulation – neither in Europe nor elsewhere, but we will most certainly see new regulation adopted in all important markets in the coming years. The interest in harm reduction as an approach to tobacco prevention and the concern about nicotine dependence will be two decisive factors for how legislators decide to regulate nicotine pouches. Sweden and Norway will most likely be the first countries with specific product regulations for nicotine pouches. They can also influence how other European governments will shape the regulation. The EU will most probably regulate nicotine pouches under the scope of the TPD. However, this will not happen in the near future. An indication of how the European Commission views nicotine pouches can probably be found in the implementation report for the TPD that is to be presented in May 2021. How the EU chooses to regulate nicotine pouches is influenced by at least three factors: Whether EU Member States calls on the EU to ban nicotine pouches, due to concern about the use of the product in Member States (which was the reason for the EU ban on snus). Whether there are already specific product regulations or national bans in individual Member States that new European legislation may be in conflict with. The number of users of nicotine pouches, and thus a public opinion critical to a new restrictive legislation or ban. This was one of the reasons e-cigarettes were not banned in the 2014 TPD revision. Action taken by manufacturers will influence how legislators will react. Strict self-regulation and dialogue with authorities can reduce the desire among some to opt for very hard regulations. Irresponsible marketing or sales can quickly raise demands for bans. The way the EU regulated e-cigarettes in 2014 may give an indication of how the EU will regulate nicotine pouches in the future. This would indicate a focus on warning texts and introducing a strict maximum nicotine level. Future regulation of nicotine pouches in the EU may leave considerable room for further regulation by Member States, and even national bans. This is true today for both traditional tobacco products and e-cigarettes in the EU.
