It is no longer sensible to regard biometrics as having neutral socio-economic, legal and political impacts. Newer generation biometrics are fluid and include behavioural and emotional data that can be combined with other data. Therefore, a range of issues needs to be reviewed in light of the increasing privatisation of 'security' that escapes effective, democratic parliamentary and regulatory control and oversight at national, international and EU levels, argues Juliet Lodge, Professor and co-Director of the Jean Monnet European Centre of Excellence at the University of Leeds, UK.

Meeting Europe's 2020 objectives of smart, sustainable and inclusive growth is even more of a challenge for the financial sector than for the EU as a whole. Smart, sustainable and inclusive growth is just the opposite of what the financial sector stood for, and how it continues to be perceived by the public. The huge regulatory agenda that is on the table should tame the financial sector, but whether it will help it to meet the Europe 2020 objectives is an open question (see European Commission, 2010a).

What should be the future institutional configurations of the second generation of the EU's Integrated Border Management strategy for the common external borders? The Stockholm Programme endorsed by the European Council on December 2009 and the European Commission's action plan implementing it published in April 2010 have brought back to the EU policy agenda the feasibility of setting up a European system of border guards as a long-term policy vision. This Working Document examines the origins of this proposal and aims at thinking ahead by asserting that any future discussion and study in this context should be refocused by initially addressing two central questions: First, what kind of 'border guard' and what kinds of 'border controls' does the EU need in light of the current EU acquis on external border crossings and the Schengen Borders Code? Second, what would be the 'added value' of any new institutional arrangement at the current stage of European integration?

724. On High Stakes, Stakeholders and Bulgaria's EU Membership

Abstract:
This paper argues against the view that Bulgaria's EU accession was premature and that the mechanism for cooperation and the verification of progress (CVM) is not delivering. The EU's continued leverage and the efficacy of the CVM are explained in a framework that goes beyond the dual-conditionality paradigm of incentives and sanctions, and beyond the unitary players model of EU–Bulgarian relations. In this framework, the CVM is viewed as an instrument for supportive reinforcement rather than for the imposition of sanctions. Furthermore, it is seen as targeting not just the government, but all Bulgarian stakeholders. The CVM is regarded as very effective at the level of public opinion and civil society, and as a mechanism that contributes to 'sandwiching' reform-reluctant Bulgarian governments between pressure from Brussels and domestic pressure for reforms. The CVM is also deemed useful for Bulgaria's further Europeanisation beyond the narrower pre-accession phase of 'EU-isation'. The paper suggests that eventual post-accession benchmarks might be appropriate in the process of further EU enlargement if properly understood as instruments for granting support and if discussed broadly with stakeholders beyond the executive. Concerning the efficiency/legitimacy dilemma, it is asserted that the CVM is an opportunity for increasing the EU's legitimacy.

Despite the lack of a global agreement in Copenhagen, momentum remains for the further development of EU climate policy, as indeed it does in many other countries. A 2010 Deutsche Bank report surveying the development of climate policies worldwide concluded that "…'the race is on' for countries to achieve a green economy". A wide range of EU initiatives on energy and climate are expected this year, providing opportunities to enhance the coherence and impact of EU policy.

Abstract:
Before the adoption of the Treaty of Lisbon, the several crisis management tools at the European Union's disposal were divided between two institutions: the European Commission and the European Council. The commission represented the community (the first pillar), and the council the intergovernmental systems (the second pillar). The creation of a new post of High Representative of the Union and the institution of a new External Action Service are intended to put an end to this commission-council dualism. The target of the reforms is clear: providing the EU with the capacity to adopt a comprehensive approach linking its several assets (including the military one) under a common, coherent, crisis management approach.

727. Election-Related Disputes and Political Violence: Strengthening the Role of the African Union in Preventing, Managing, and Resolving Conflict

Abstract:
Elections are the hallmark of representative democracy, allowing the people's regular input in choices about leaders and policy. Yet they are also competitive processes, unleashing conflict and tensions that, if not constructively managed, could potentially destabilize the fabric of states and societies. Since the new wave of democratization in Africa in the early 1990s, elections have become a core ingredient of popular participation in the governance process. At the same time, elections have spawned conflicts and violence and scrambled ethnic and regional alliances that sometimes threaten the social order, economic development, and efforts to strengthen regional integration. With the steady decline of some of the historic causes of African conflicts, elections have emerged as one of the major recent sources of conflict across Africa. The challenges occasioned by election-related conflicts and political violence underscore the importance of building institutions that balance competition with order, participation with stability, and contestation with consensus.

Abstract:
During the last two decades, law as a factor in European integration has attracted great scientific interest. Numerous studies and theoretical analyses have been published which have undertaken the task of examining and explaining the role of law in the progress of integration. The European Court of Justice (ECJ) in particular, as Europe's judiciary body, draws much attention in this context. However, the inflexible, mechanistic and universalistic notion of rationality that these works employ leads to serious misinterpretations and unjustified criticism regarding the role the ECJ takes in the course of integration. Within the frameworks of contemporary approaches the Court is perceived as just one more political player among other actors and institutions able to shape the EU in the pursuit of its own rational interests. By outlining the theoretical concept of context rationality, this article shows that the logics of law and judicial law making are based on a non-trivial and non-political rationality and cannot be understood appropriately without paying attention to the context of European law.

Abstract:
The notion of Portuguese exceptionalism resonated with the European political and economic elite for some two hundred years: there was a widespread belief that Portuguese society and government existed outside of European understandings of society, politics and authority relations. In the thirty-five years since the 25 April 1974 Carnation Revolution, the Portuguese political system has developed new mechanisms for debate, elections and policy adoption. Portugal is currently completely integrated into Europe as a member of the European Union, with a democratic government and a developing economy. Portugal's return to the overall pattern of European democratic institutions in the years following the 25 April 1974 revolution can be understood as a much needed corrective of both Portuguese authoritarianism and its associated notions of lusotropicalism: that is, democracy and Europe have replaced corporatism and the Portuguese overseas empire as two of the key defining elements of contemporary Portuguese identity. It was certainly a long historical struggle from monarchy to democracy: the contemporary Portuguese political system is currently dynamic, democratic, durable and European.

Based on a selective review of the outcomes of previous meetings, conferences, workshops, and papers highlighting climate variability and change research needs in the Pacific region, this paper presents a research strategy for increasing understanding of climate-society linkages in Pacific Island settings. The strategy provides a synopsis of emerging research goals and illustrative activities that users can rank according to their priorities. Grounded in the framework of the Pacific Climate Information System, the strategy is comprised of three key research elements: (1) research to enhance understanding of regional climate risks and consequences; (2) research to improve decision support and risk communication; and (3) research to improve climate adaptation capacity. We envision the strategy will contribute to enhanced understanding of scientific and societal knowledge of climate processes and their impacts and stakeholder capacity for building sustainable island communities for future generations.
