Abstract:
ICDS researchers Kaarel Kaas and Merle Maigre have completed a Policy Brief with recommendations and suggestions for Estonia’s engagement with the EU’s Eastern Partnership. The European Union’s Eastern Partnership establishes a new political instrument for the promotion of democracy and economic reforms in the EU’s eastern neighbourhood. Since the war in Georgia in August 2008 and the gas crisis in the winter of 2008/2009, it has become clear that the developments in Ukraine, Moldova, Belarus and the South Caucasus have a direct impact on the security of the EU and Estonia, as well. It is, therefore, in the interests of Estonia to provide maximum support for our eastern partners in their reform efforts and convergence with the EU.

Abstract:
Towards the end of the 1970s and beginning of the 1980s, Bolivia experienced a period of deep economic and political crisis, resulting from the international economic shocks that hit the country at the time and from the large levels of foreign indebtedness the country had acquired during the 1970s. The crisis was characterized by hyperinflation, continuous drops in GDP, economic uncertainty and political volatility. Starting in 1985, after a change in government, Bolivia embarked in a comprehensive program of structural reforms aimed at stabilizing the economy and at removing the structural constraints which precluded faster economic growth and increases in productivity. The reform package was implemented over a period of time which began in 1985 and lasted for approximately 20 years. The reform policies comprised measures such as the opening of the economy to foreign trade; price, exchange rate and interest rate liberalizations; fiscal adjustments; central bank independence; instauration of a financial regulation and supervision system; capitalization and privatization of public enterprises; pension reforms; decentralization of the public administration; strengthening of key public institutions, (e.g. the internal revenue and customs offices, and the national road administration), among the most noticeable.

967. Chronology of Security Sector Reform in Kosovo

This paper addresses the political and security events starting from June 1999 until the present time (June 2009). As it will be clearly elaborated in the context paper, the Security Sector Reform (SSR) cycle in Kosovo is split into three periods: - First period starting from 1999 – 2005 is referred to dominantly as the Security Sector Building (SSB). As written in the chronology below, the efforts were directed towards building security institutions such as: Kosovo Police Service (KPS), Kosovo Protection Corps (KPC) and other relevant mechanisms. This period is well known as the time when the responsibilities of the security institutions were reserved for the SRSG and locals had limited responsibility. - Second period starting from the end of 2005 until the beginning of 2008 is broadly known for the initial transfer of responsibility from the international community to locals. The Internal Security Sector Review (ISSR) is considered as a turning point towards building new security architecture in Kosovo and assessing the current state of the security sector. In addition, the establishment of the MoIA and MoJ and the shift of responsibilities from UNMIK to these ministries characterized the importance of the SSR during this period. - Third period is indeed affiliated to the declaration of independence and the Constitution of the Republic of Kosovo. The new security architecture in Kosovo allows the establishment of new security institutions such as KSF, KSC, KIA as well as the reform for police and emergency services.

968. Almanac Turkey 2006-2008: Security Sector and Democratic Oversight

Abstract:
Today it is vitally important that citizens examine the security sector with an aim towards democratization. In order to make such an examination more than just an useless exercise, it must be informed by objective data. Therefore, studies like the Almanac are an indispensable part of examining, debating and researching alternatives to the policies that public and private security actors impose on society, the instruments related to these policies and the solutions that these policies are aimed at. This second Almanac covers the three-year period from the beginning of 2006, when the first study was concluded, to the end of 2008. It also gives some information regarding the first half of 2009. In addition to examining the developments which occurred in the Introduction Ali Bayramo¤lu, Ahmet ‹nsel 2 Turkish security sector during this time, the Almanac also focuses on the discussions surrounding the position of security actors in political and social life. It attempts to summarize the historical background that triggered these developments and thus to elucidate both the continuities and the various divergences from historical patterns and trends in Turkish security sector policy. The most crucial debates in the history of the Republic regarding the political and social position of the security forces in Turkey took place between 2006 and 2008. The debates which followed the discovery of diaries belonging to retired admiral, Özden Örnek, gained new significance with the discovery in 2007 of weapons and ammunition that some retired and active-duty officers had hidden in their houses or buried. A clandestine network of relations between retired and active-duty military officers, police officers and civilians is at the center of the legal proceedings that have become known as the Ergenekon case, which remains on-going. The plans for a coup evidenced by other diaries and documents that came to light after the Özden Örnek diaries and during the Ergenekon investigation, as well as preparation for actions aimed at creating a general sense of insecurity in society, have demonstrated with amazing clarity just how important it is that security sector actors in Turkey be under the supervision of civilian political powers and, most importantly, the parliament.

969. Making Markets Work: A Review of CDM Performance and the Need for Reform

The Kyoto Protocol's Clean Development Mechanism (CDM) is the first global market mechanism in international environmental law. It has been much lauded for its success. However, doubts whether the CDM governance structure is robust enough to meet the challenges of regulating an international market mechanism in the long term are emerging. The Executive Board (EB)'s decision-making practice is often not predictable and many of its decisions have come as a surprise to project participants and technical project experts. Members of the EB often have multiple responsibilities which result in a complicated situation of conflicting interests. Finally, private sector participants in the CDM who have been aversely affected by EB decisions have no right of recourse and essentially little if any due process rights. This article argues that incorporating mechanisms to promote procedural fairness and creating an appeals process for aggrieved CDM participants will promote transparency and accountability in the CDM decision-making processes. This is essential for the sound operation of the CDM regulatory regime which will have a direct positive effect on the international carbon market. After conducting a comparative analysis of other regimes in which international bodies take decisions that directly affect individuals, most notably the system of targeted sanctions of the UN Security Council and the Anti-Doping Regime, as well as examining the World Bank Inspection Panel and the European Ombudsman as models of international review mechanisms, the authors set out proposals for reform of the CDM, including professionalizing the EB and the panels, securing better and more consistent funding, the elimination of political interference, and the introduction of administrative law-like processes.

970. Kyrgyzstan: The Challenge of Judicial Reform

Abstract:
Kyrgyzstan's judiciary is failing to act as a neutral arbiter of political disputes or as a fair channel for economic arbitration. It requires significant reform to gain the trust of the public and to assert its role as an independent branch of government. A failure to achieve reform would make it impossible to develop a pluralistic and stable political system over the long term and also undermine attempts to tackle widespread corruption and encourage development. Unless the government allows greater self-governance for lawyers and independence for judges, no amount of education or piecemeal reforms will create an effective system.
