1. Beyond the Weapon of War: Rethinking Gendered Narratives of Conflict-Related Sexual Violence

Abstract:
Conflict-related sexual violence (CRSV) has traditionally been understood as an inevitable byproduct of war, with rape framed as a biologically driven act of sexual gratification committed by men against women. This perception shifted following landmark rulings by the International Criminal Tribunals for former Yugoslavia (ICTY) and Rwanda (ICTR), which established sexual violence as a weapon of war. This article critically examines the "weapon of war" framework, which portrays militarized men as strategic perpetrators and women as symbolic victims, arguing that it reproduces harmful gendered identities and oversimplifies the complexities of sexual violence in conflict. The paper first traces the historical evolution of how CRSV has been conceptualized—from a natural consequence of war to a gendered and strategic tool of power—before analyzing the limitations of the weapon of war paradigm. It highlights the framework’s exclusion of male victims, female perpetrators, and diverse motivations for sexual violence—such as opportunism, material gain, and combatant bonding—as well as its failure to account for cases where armed groups refrain from using sexual violence altogether. Drawing on original analysis of over 4,000 redacted ICTR witness testimonies, the article demonstrates how the framework has constrained legal recognition, obscured lived experiences, and reproduced narrow narratives of ethnic hatred and gendered violence. It calls for a reframing of the gendered weapon of war concept to better account for the complexity of CRSV and to promote more inclusive approaches to justice, prevention, and survivor-centered redress.

Abstract:
Marital rape and intimate partner violence are controversial issues all over the world either because they are recognised as criminal acts and strongly condemned, or because they are silenced as something that belongs to the private sphere and should not be the object of public scrutiny. In either case, they are acts of repression and gender inequality. In this DIIS Working Paper, Meron Zeleke, associate professor at the Addis Ababa University, explores the issue in an Ethiopian context. She takes a point of departure in historical debates and outlines the development of global and regional norms. The Maputo Protocol on the rights of women in Africa explicitly condemns marital rape. Ethiopia has recently ratified the protocol but has made a number of reservations including in relation to marital rape. The main part of the paper is constituted by an analysis of the ambiguous law reforms when it comes to marital rape in Ethiopia. This analysis points to several different explanations of the lack of criminalisation of marital rape, but suggests that the recent change of government may create space for addressing the issue again. 4. Zainab’s Murder: Heinous Crimes, Speedy Trial and the Challenge of Procedural Rights

Abstract:
In early 2018, a seven-year old girl, Zainab Amin, was raped and murdered in district Kasur, Punjab province, Pakistan. The cold-blooded incident shocked the people across the country. These questions included the suspect’s confession before trial, the in-camera trial being completed within four consecutive working days, the cross-examination of 56 witnesses, and the paucity of time given to the defence counsel. In this paper I argue that although such heinous offences should be awarded legally warranted punishment, the courts must ensure that the special criminal procedure does not let go the principle of due process. I take Zainab’s case as an example to see whether the principle of due process and procedural rights of the suspect were ensured as required for a fair trial. The paper puts to critical light the chronological facts of the case (as reported in the press) and relies on applied jurisprudence to underscore the potential/danger of letting go the due process and procedural rights in speedy trials.

5. The Legacy of the International Criminal Tribunals for the Former Yugoslavia and Rwanda and Their Contribution to the Crime of Rape

Abstract:
The article analyses the over 20 years’ jurisprudence of the International Criminal Tribunals for the former Yugoslavia and Rwanda with respect to the crime of rape. It discusses how the attitude towards the prosecution of sexual crimes has changed since the Tribunals work began and what impact its jurisprudence has had on other attempts to define rape (elements of crime [EOC]). The article explores in depth the various definitions of rape given by the different chambers of both Tribunals. Consequently, it examines if the ultimate definition of the Kunarac chamber will prevail in international law. Not only are the weaknesses of the Kunarac definition that followed a pure consent approach revealed but the EOC of rape that opted for a combination of the coercion approach with one aspect of the lack-of-consent doctrine (incapacity) also face criticism. This leaves only one response – namely, that the elements of rape in international criminal law today can only be based upon a newly conducted comparison of national laws, thereby reflecting the general principles of the major legal systems of the world. The strongest accomplishment of both Tribunals concerning the crime of rape therefore lies not in the clarification of the elements of rape but, rather, in the revelation of a law-finding method, which is indispensable to the rudimentary field of international criminal law.
