1. Revising Organ Procurement Organization Guidelines to Obtaining Family Consent for Deceased Donation: An Anthropologically Informed Policy Proposal

Abstract:
Organ transplantation has become a widespread medical practice with public policy designed to increase rates of deceased donation. When individuals have not registered as organ donors, next-of-kin are called on to make donation decisions—requiring families to grapple with the often-confusing concept of ‘brain death’ and parse their understanding of what the deceased would have wanted. Current public policy is explicitly designed to promote high donation rates without clear regard to the experiences of donor-families; at best, these policies prime donation conversations to involve unethical practices, while at worst, the disregard of kin’s experiences may also diminish deceased donation rates. Anthropological literature has documented the often aggressive tactics used by transplant organizations that demonstrate a disregard for the emotional experiences of kin. In 2023, Congress passed the Securing the U.S. Organ Procurement and Transplantation Network Act, prompting the United States Department of Health and Human Services (HHS) to reevaluate organ donation policies and solicit requests for proposal for a new federal contractor to take over the network responsible for overseeing all organ sharing. This article leverages the relevant anthropological literature to provide guiding principles and proposed language amending the Centers for Medicare & Medicaid Services (CMS) Interpretive Guidance that HHS could implement as part of its modernization initiative. These principles aim to improve experiences for kin without lowering donation rates. The article recommends that HHS and its contractors collect metrics to measure the quality of Organ Procurement Organization (OPO) interactions, counterbalancing current benchmarks focused on procurement rates. It also recommends improved protocols to empathically and systematically support kin’s understanding of brain death.

Abstract:
With the onset of Russia’s invasion of Ukraine, JSC Alabuga shifted from centering on hosting domestic and international civilian manufacturing facilities at its Special Economic Zone (SEZ) to direct military production of military drones, in particular the Shahed 136 kamikaze drone under a supply and franchise contract with Iran. This shift has necessitated the large-scale procurement of a variety of different types of goods abroad. One of JSC Alabuga’s important procurement arms has been Drake LLC, aka Dreik LLC, which contracts with Alabuga Development Company, JSC Alabuga’s main construction and production arm. Drake’s role in outfitting military industries was recognized on February 23, 2024, when it was sanctioned by the United States. However, its precise dealings which warranted this designation have received little public scrutiny. The case of Drake exposes a part of Alabuga’s drone production supply chain and its broader interest in military drones in addition to the Shahed 136 drone. This case study reveals how Alabuga Development Company purchased in early 2023 via Drake and a third party in Kazakhstan, DRONE.kz, up to 30 Dragonfish drones from Autel Robotics, a major Chinese drone manufacturer with a strong U.S. presence, for modification at Alabuga for military use in Ukraine. The planned changes included extending the drone’s range, strengthening its ability to defeat jamming from enemy electronic warfare systems, and/or attaching a universal delivery system for a variety of ordnance, such as grenades and video-guided rocket propelled grenades.

Abstract:
The Ukraine war has highlighted among NATO allies the importance of planning for protracted, large-scale, and high-intensity conflicts. In this context, artillery capabilities have regained significance, with a clear emphasis on survivability, quality, quantity, range, but also on adequate munition stocks and production capacity. However, successful integration into a wider array of capabilities (including long range precision fires) and advanced Intelligence Surveillance Target Acquisition and Reconnaissance (ISTAR) capabilities are crucial for an effective artillery force. Meanwhile, in the maritime domain, recent events in the Red Sea have shown how naval artillery is gaining a prominent role as a cost-effective solution to defence from drone and swarming threats.

Abstract:
The relationship between trade agreements and the environment is increasingly a priority for policymakers and civil society today. However, some of the disciplines covered by modern trade agreements have not received enough attention when it comes to their potential impact on the environment. Financial services and government procurement are two such areas, even though they are increasingly consequential topics for international trade policy and negotiations. This blind spot merits greater consideration as the connections definitely exist: the regulation of government procurement and financial services can have positive or negative implications for environmental outcomes on the ground, which makes understanding these links a crucial task. Engaging in this very task, this report focuses on the EU-Mercosur Trade Agreement, with a particular attention to the case of Brazil. Using the Agreement on Government Procurement (GPA) and the General Agreement on Trade in Services (GATS) as an analytical base, the report examines recent and relevant trade agreements entered into by Brazil and the EU to contextualize and understand the links between environmental protection on the one hand and government procurement and financial services on the other. The insights generated are then applied to the analysis of the government procurement and financial services chapters of the EUMTA, in an effort to understand how these rules affect parties’ ability to regulate in pursuit of environmental outcomes.

Abstract:
The EU’s defence-industrial base was conceived during peacetime and, because of the ensuing market fragmentation, does not seem fit for purpose to deal with wartime. In an attempt to remedy this, the EU launched several parallel joint defence procurement initiatives (EDIRPA, EDIP, the three-track approach under the European Peace Facility). Between these initiatives, it is easy to lose sight of the forest in the trees of joint procurement. How do these parallel tracks of procurement tie in together? Are they not fragmenting collaborative procurement efforts even further? This CEPS Policy Brief sheds clarity on the interplay between these initiatives and suggests four pragmatic paths towards an overarching joint defence procurement framework while playing into the most salient deadlocks in joint defence procurement today.

This briefing assesses South Africa’s Renewable Energy Independent Power Producer Procurement Programme (REIPPPP). It acknowledges programme achievements while addressing challenges, including delays to the procurement process and financial issues facing REIPPPP projects. It underscores the necessity for electricity industry reform and more cohesive energy policies. It proposes changes to how investment decisions are made, and collaboration occurs alongside the REIPPPP process to promote private sector investment, develop localisation within the REIPPPP and reduce supply chain vulnerabilities. Lastly, it provides a thorough analysis to inform recommendations that will maximise REIPPPP’s role in realising South Africa’s energy objectives.

Abstract:
This research paper identifies the instrumental role of the integrative perspective in international procurement negotiations and evaluates how, in the specific case of BPN’s purchase by BIC, the long-term relationship approach provided the maximization of opportunities in international relations. The research applied a qualitative method that explored the case of BIC internationalization project within the CPSC (Community of Portuguese Speaking Countries) space and resorted to techniques of documentary observation, collected through interviews, official statements and communications. The study demonstrates that BIC strategy gave rise to subsequent negotiations with the same international partner, under conditions of a more cooperative perspective. Findings validate the relevance of an integrative perspective, but suggest that it is instrumental to competitive purposes and demonstrates that the entry into action of business economic actors is not unrelated to a strong involvement of States, through their governments

8. Procurement Data and Safeguards: Looking Historically and to the Future

Abstract:
Because nuclear programs depend on procurements, understanding such procurements has become an important aspect of safeguards today. This paper looks back at the development of this approach and draws out lessons for tomorrow. Past cases, recounted using open source data and Institute archives, are drawn from, among others, Iraq Action Team investigations, Iran inspections during 2003-2006, the Khan Network investigations, and the Joint Comprehensive Plan of Action. These cases illustrate important lessons about collecting and including procurement data more explicitly in state declarations and meeting inspection and monitoring goals. The cases also demonstrate the value of procurement data in facilitating the detection of irregularities in a nuclear declaration or verifying the correctness and completeness of a state’s nuclear declaration. These experiences and historical cases yield additional insights and lessons into ways to increase the usefulness of procurement data in future safeguards practices and methodologies.

Abstract:
This article examines how China’s twenty-first century Maritime Silk Road impacts U.S. national security. While the literature frequently discusses the Belt and Road Initiative, the Maritime Silk Road and its impact on U.S. national security is notably lacking. This article examines the specific impacts on the U.S. Department of Defense and other government departments and agencies. The main findings reveal that the Maritime Silk Road is a U.S. national security concern because it degrades operational security, alters military force projection, and bypasses ethical procurement norms. The author articulates the importance of U.S. action in response to China’s global port influence, as well as recommends ways to counter each threat China imposes on the United States through the Maritime Silk Road.

Abstract:
The Russian invasion of Ukraine on 24 February 2022 has renewed momentum on the long-standing debate on EU defence, convincing many that the time for concrete steps to meet this ambition – the building of a united European defence grounded in its own strategic and technological autonomy – has finally come. Talks have been ongoing for some 68 years – that is, since the French parliament sunk the European Defence Community project back in 1954. The manifest broadening of public consensus for the idea of European defence is not enough. Thorough technical assessments will be needed to identify priorities and strike an acceptable balance between reducing duplications, optimising expenses and the inevitable transfer of some elements of strategic and operational “sovereignty” in the military domain.
